  1. Everything you need is here in this checklist:

     

    1. Payment as required by USCIS. Use a personal check so you can track the payment. Money Orders are also accepted. Read the Guide to Paying USCIS Immigration Fees.
    2. Cover Letter. Should include a description of what your are petitioning for (I-130), a table of contents (list everything in the packet). If you need additional room to explain your case, attach a separate sheet (list the attachment on the cover sheet). Make sure to sign and date the cover sheet.
    3. Form I-130: Petition for Alien Relative
    4. Copy of the full Birth certificate (front and back) for the US Citizen or a copy of ALL pages of the US Citizen's passport. This is used to establish citizenship.
    5. A copy of petitioner's proof of naturalization. (If applicable)
    6. A copy of petitioner's proof of permanent residency. (If applicable)
    7. A copy of the intending immigrant's birth certificate and/or passport along with English translation. (If in any language other than English) (no longer needed)
    8. A copy of your marriage certificate (If not in English then again get a translation)
    9. If either you or your spouse were previously married, submit copies of documents showing that all prior marriages were legally terminated (court certified copies of the petitioner's and/or intending immigrant's divorce documents).
    10. A copy of a prior spouse's death certificate. (If one or both of you were married before, and the prior spouse died)
    11. Two passport-type photos (see specification) of the petitioner. Write the full name on the back of each photo. Place in a plastic bag and label the bag "Photo of <Insert Name>". Attach the bag to a sheet of paper and place behind the corresponding I-130.
    12. Two passport-type photos (see specification) of the non-US Citzen spouse. Write the full name of the beneficiary on the back of each photo. Place in a plastic bag and label the bag "Photo of (insert name) ". Attach the bag to a sheet of paper and place behind the corresponding I-130.
    13. Evidence of a bonafide marriage (see note below for what to include)
    14. Form I-130A: Supplemental Information for Spouse Beneficiary
  2. If there is anything that doesn't apply to you write N/A. Personally, I wouldn't ignore the gap. It's best to give them as much info as possible. There is space at the end of the forms that should give you room to write more addresses if need be. I think it's better to be thorough than to be unsure and risk the possibility of filling it out wrong. 

  3. I'm from Canada and I married my husband during one of my visits to him in the USA. We went to the courthouse and got a license, and we were married the next day. I went back to Canada, and I visit the USA often. I don't know if this is the first time going to your spouse's country, but it looks better to USCIS if you visit each other a lot. We compiled the i-130 together and he sent it. No issues.

  4. The i-130 instructions say 

    "If you need extra space to complete any item within this petition, use the space provided in Part 9. Additional Information or attach a separate sheet of paper; type or print your name and A-Number (if any) at the top of each sheet; indicate the Page Number, Part Number, and Item Number to which your answer refers; and sign and date each sheet."

    But what I am unsure of is: what do you write for the item number for additional employment information? You are supposed to write the number you're referring to, but employer 1 and 2 have different item numbers. Please help! Thanks!

  5. Thanks for all of the information, everyone. My fiancé cannot move from the US because he has a daughter who lives with him part time. So, it looks like we will continue to visit each other until it all gets approved. Has anyone used an immigration lawyer? Someone I know recommended one to me and she said he was extremely helpful. Is it worth the money? 

  6. I'm brand new to this thread, so please bear with me. I am a Canadian engaged to be married to a US citizen in the fall. I have been researching online about everything we need to do. My understand is he has to file a petition for alien relative as well as an affidavit of support. What else do I need to know? Please help!
