  1. Hi everyone. I became an American Citizen in the end of Mar of this year. I applied for my passport at the end of Apr and just used conventional time because I wasn't planning to do an international trip this year. Unfortunately, my mom is sick and is at the hospital. Her situation is not good, but she has chances to get better. I booked a flight to next Friday and called the passport office to try to get an appointment to get an urgent passport. They just had an opening at the day I was traveling. I decided then, to apply for the expedite process, but the chances to receive it before my travel date is very low. Then, I'm thinking in travel just with my foreign passport and wait for my passport there. My husband is planning to travel there when he gets my passport (he is afraid that shipping the passport it may never get there). Anyway, do you think I could have a problem in doing this? I have read about that when you are an US citizen, you should travel with your American passport to leave the country. And some people said that would not be a big problem in traveling with a foreign passport, I just would need to have it to enter back. Thank you for your insights!

    Do you think would have a problem that this file is in archive? This means that they don't issue combo cards anymore? And did they give one to my sister-in-law?

  3. Hello everyone, 

     

    My brother has a pending adjustment of status. He got his work card and didn't have any problem in applying for a limited driver's license. On his card says he falls under category C09. However, his wife received her employment authorization with category C09P. It says she can use as advance parole. She went to DLD to apply for her learner's permit and they didn't accept her employment authorization because of the P. For what I understand, this P means that this is a combo card, valid for work and travel. I think they don't understand there, the lady was saying the P means parole and may think that this employment card is not valid. She asked to my sister-in-law to bring her I-797 notice showing that she has an adjustment pending. We will go back there next Monday and bring everything they have. But my question is: Does the USCIS still issue work/travel combo cards? I saw an article saying that they were discontinued. I am trying to search for good sources explaining what this card means. Any ideas would be appreciated. Thank you!

    EB2 NIW seems to be the flavor of our time the sheer number I have seen of late makes me suspicious 

     

    Visiting another country with family and children and presumably all the other documentation strikes me as odd, I assume this was the plan but why not get everything sorted before hand?

    Well, he came to visit before so I had not idea that he would want to stay this time. If he had told me about his intentions I would had talked sense into him. But now...let's just see what will happen.

    I don't know how to explain how it works. I know that he will be out of status, but not illegal because he will have a pending adjust case. If the I-140 is approved, it kinds goes back, something like that. Another day I watched a video and a lawyer explained very well how it works.

    But even with concurrent filing he'll still need to be in a valid non-immigrant visa status until the I-140 is approved, which is unlikely, IMO. 

    For everything I read and the lawyer confirmed, the EB2 niw filled together with the adjust of status gives him the right to wait here while his case is being processed. If it was the EB-3, he couldn't do it together.

    Well, the lawyer said it would be too risk  if he didn't do all the process with him and bla bla bla. So,  my brother got scared and have  decided to pay for the whole process with him. I'm just happy that I didn't have to pay a dime to a  lawyer for any of my immigration applications.

  8. My brother decided that he wants to apply for the EB2 NIW. He is already here in a tourist visa. He is planning to work with a lawyer to submit the form I-140 and it all the needed documentation for the application. I told him I could help to fill the forms I-485 and I-765. He will talk to his attorney about this possibility. My question is: That would be possible to submit the adjustment status process separated from the I-140 and not done by the lawyer? Or if he sends application done by a lawyer he can't submit the other applications done by someone else?

    I would like to share 2 situations involving this form. One is about my sister. When she married her first husband, she didn't know he didn't make enough money so when he applied for her green card they were  requested to have a sponsor. He asked his parents, but they didn't sign it. Because of that, my sister was married for 4 years without a green card until he died from a heart attack and left her with 2 small children. It was a very hard situation for my sister. She later was able to get a green card, but life would had been better if she had gotten at that time.

    Second situation is about myself. When I got married to my husband I also didn't know that he didn't make enough money (he was self-employed at that time). When he applied to my green card, we were requested to find a sponsor. He asked his parents and they decided to be my sponsor. They also had those questions, but we explained to them what really was. Now, 4 years later, life is so much better. I can work and be productive in this country. Our finances are so much better. We never needed the government help for anything. Because my in-laws, I will be soon be applying for my citizenship.

    Have been a while I don't post here. My life changed  alot lately. I got remarried recentily ( not to  my ex abusive husband) before a decision of my VAWA petition. I know that for doing that, my petition will not more be vailid. My new husband is preparing the forms I-130, I-485 and I-765. I have some questions about it. First, should I send a letter to withdraw my VAWA petition before my new husband send his petition in my behalf? What can happen if he sends  his petition and they figure out that I had a pending VAWA petition? I ask because in the forms that we are filling they ask if I have an Alien number. I have one because of my petition and I puting there. Or should I not put my alien number on the new application?

     

    Sandra, could you help me with these questions and anyone that can help. Thank you!

    You need to complete a new l-765, mark the box at the top stating " Renewal of my permission to accept employment ", and enclose copies of your current EAD and I-485 receipt NOA. If you paid your AOS you don't have to pay for renew I- 765 . However, if you had fees waived you will need to include again an l-912 fee waiver request alongside the l-765. 

    I got this information form old posts, so please, someone can correct me if I gave  a wrong information.
