    On the other hand I humbly wish to submit thus;

    - the purpose of all of us being here is for the knowledge it offers and the fact that we are all knitted as one family here for one purpose - becoming USC happily with our families

    - the fact that we share our stories and update is because all of us are adjusting our status from whichever status we entered the US to that of a permanent resident

    - the fact that USCIS is an unbiased umpire in adjudicating our cases and them and only them alone know the way and method they do that and the procedure they follow

    - that if not a family-based adjustment that majority of us are doing owing that we married a USC what other type of adjustment are we doing

    - the essence of the classification of tourist/student etc here is just to help visajourney in their statistics which have helped most of us calculate how long it takes to adjust status and perhaps other threads aren't busy and detailed as these ones

    - That USCIS do not have preferences in ways the treat or handle our cases and as such I humbly urge us here to share comments and suggestions that will alleviate the already frustrating and nerve wrecking process instead of asking "which visa you are adjusting from"

    - I sincere appeal to all to encourage and not discourage others, it is not our duty to legitimize who should be here or not.

    I second what you say!!!! 

    We all just need to remember we need to be here for each other. Remember the reason you signed up for visa journey in the first place, its to share your story and find people that are going through the same journey, I would also like to remind everyone that although yes this is a forum for K1 filers, the student, tourist, work based adjustment forums are either so small, with no alot of traffic, or non existent, we are here because we want to be a part of your community and our journey (apart from the waived interview most k1s have) is the same, so really it doesnt matter at this stage what we are adjusting from. 

    Just be positive, and supportive of each other, thats all that we all want. :)

    Grrr just checked the USCIS website for current processing times. It was finally updated on May 26, 2017. Either they didn't update it correctly or they are wayyyyy behind as it said they are currently processing applications from December 2016. But yet I remember it being the same December 2016 before they updated finally. So I'm guessing it's inocorrect at least I hope so. If they actually are only on December this is gonna suck! I think I'm going to put in an inquiry can't hurt any thing as I'm at Day 76 and they tell you to submit one on their site if it's been more than 75 days since you last heard from them.

    After reading your post I went and checked their website, they are processing applications from December 2016 for EAD but it was updated on March 31, not May 26, so thats good news.

    I really hope I'm not the only one being obsessed with checking their stays on the USCIS site and/or app? I've settled it up to get emails and text messages but still need to check at least 3 times a day. Just in case. 😅And I also know that they don't update their site sometimes. I had that with my K1 visa. So the postman is eagerly awaited in this house too.. 😂 ow well just trying to see the humor in my craziness.

    Don't worry..... I check my status every hour :P I mean not literally but everytime I think about it, i check just incase they've updated it. Doesn't matter what time of day! :P

    Yeah there is quite a bit going on with the ones who filed at the beginning of February, but it means the process is moving, so it wont be long before the April filers start getting the same notifications

    heyyy :) yes I remember you posting on the March group about your situation :( I hope you've had a more positive journey since re-sending. 

    Hopefully I can bring some of the positive vibes from the March group to the April group, thats pretty much all I do, spread positivity. :)

    69 Days starting from my priority date of March 10th.
    I did not request for expedite.
    I am still in shock right now because I am expecting this middle of next month.

    Yeah I understand how you feel, we all do! Everyone wants to be able to work asap, I've used up so much of my savings, and movingly into a new apartment in July. It sucks that you aren't able to get your driving license without EAD

    Also, if you are really concerned about your RFIE/RFE affecting your EAD give USCIS a call, the woman I spoke to was lovely, pulled up the info on my RFIE, asked for my receipt number for my EAD looked at my case and told me it wasn't affected that badly :) only affected by the number of days it takes me to get the RFIE sent back in :)

    I did endup including my dad's I-864 along with tax for 2016, copies W2 and other income forms, copies of paychecks since self-employment, and explanation letter from my dad explaining the situation. We did throw in wife's DS-3025 because it wasn't sent before and this way it hopefully will be on the record before it expires. We'll see how it goes.

However a RFIE (Initial evidence) reverses the entire time back to 0 from the day the requested documents are submitted. That's also what USCIS describes in the quote. 

    The USCIS lady told me the exact same thing even though I told her that technically if the RFIE is done before the biometrics it shouldn't affect the application since USCIS doesn't start processing until they have the biometrics anyways. She obviously didn't agree with it and said that I need to take the day the status changes to documents received as my new day number one and then start counting. You can find lots of threads about this topic. 

     

    I-765 is filed concurrently with I-485 and vice versa 

    Ok fair enough. yeah i know their are lots of threads and I'm aware I can go and search through VJ, but I like to stick to this thread specifically for the positivity and support.

    Here's what I posted a little while ago in this thread for someone who asked the same question: 

    Some people say it does, others say it doesn't. Really, it just seems very you get lucky or not. An RFIE according to USCIS reverses the processing clock back to 0 and affects all the concurrently filed applications with it. While there's been people that had as a result EAD wait times of 150 days and over (look at November 2016 forum) there are people who got an RFIE and got their EADs within a normal processing time frame.

    • In certain categories, we cannot process your Form I-765 until after we approve another application/petition because that approval is the basis for your application for employment authorization.

    I may be reading this the wrong way, but although I also kinda knew about the reset back to 0 when you receive an RFIE, however after reading over your post, which I think i've actuall read when you posted it the first time, it seems to be saying that it just extends the wait time, so they pause the process until they receive the RFIE and all evidence, and then they resume again. So if i take a week to send in my evidence, surely that should mean that my 90 days is only extended by a week, I don't know thats what I understood  "the processing time is extended when a request for evidence is issued for any form filed concurrently with form I-765"

    Did you get everything sorted out already? I came up to another issue. My dad is self employed now and has been worked as sub-contractor since March. Prior to that he was unemployed (we worked for same company and got in same situation) and received unemployment benefits.

     

    So I am trying to figure out what to include as proof for his current income and about including a signed letter from him explaining the situation.

     

    Yeah we are almost identical, apart from our biometrics being different. :)

    Ermmmm its kinda sorted, but i'm not gona be able to send my RFIE back for another 2 weeks. We have asked someone to be our co-sponsor, but now I've got to wait for them toget all their evidence together, and then we got to drive to collect the evidence from them. But I need to ring tomorrow to double check and make sure if someone is retired can use their 401k and social security payments as income.... its just not the situation I want right now. 

  11. So this isn't really that interesting, but I just thought I would post a little update on my case, and RFIE. More just so if anyone else encounters this issue, it could put their mind at ease :) 

    Basically, I recieved my RFIE this for the I-864 because my husband was more sponsor, however his income was made up of work and financial aid from school (which after phoning this morning we have confirmed that they do not accept as a means of income). Nexy hundle, my husband started a new job, and has been their for a month, so he is now no longer allowed to be my only sponsor because you have to be at the same job for a consecutive 6 months, so his new salary wouldn't be accepted. This left us with one option,  co-sponsor. Which I didn't really want to do at this stage becasue I wanted to turn this RFIE around and get it sent back as soon as possible. So fingers crossed for a smooth road from here.

     

    I do have one question, thie RFIE has only the receipt number for my I-485 and my EAD application still says 'case received' and hasn't changed since receiving the RFIE, does this mean that the RFIE doesn't affect the speed of which my EAD is being processed?

    Although I can't help you with your specific situation, I just wanted to let you know I got an RFIE for my i-864 for my husbands income not being enough and not having a joint sponsor, so just wanted to let you know you aren't alone in this situation. :)

Last wednesday I called USCIS trying to know when is my bio appointment, and they said an officer would call me back within 3-5 days. Today I called back again and they told me to wait until June 4th. My schedules are really tight for the rest of this month and beginning of June, and they said they just could not tell me when is my bio appointment.  So have you ever tried to talk to an officer and how did you request it? Thank you!!!!

    Yeah its a slightly more complicated situation. We were gona ring this morning to double check and make sure we didn't need to include anything else, but it was virtually impossible to get through on a Monday morning as everyone is trying to ring to sort their problems out. So gona try tomorrow. I would have been fine with getting a joint sponsor, but it just isn't a lot of time to be able to get all the stuff from someone else, and I just don't want to be spending all my time running around after someone else to make sure I can get this sent in on time. :) 

    fingers crossed that the new job employment letter will be enough proof of the new job.

    That actually makes ALOT of sense, id never thought of it that way of them seeing it as a loan! I feel like that's super obvious too! you might get lucky and they may not ask you for it, but in my RFIE, it said that we hadn't provided significant evidence to prove his earned income. So get the pay stubs ready and then you can just send it right back :)

    I mean I explained in the first post that my husbands actually got a new job - and before we were using his school money and income to be above the poverty guideline, now with his new salary we don't need to use (not that they accept it) his school money. But it's just a case of whether they will allow us to use evidence of his new job as he has only been there a month. 

    Honestly if I get a joint sponsor it will just take way longer than I would like to get the RFIE sent back because there is so much evidence to gather from them and I don't want to spend all of my time chasing them around so I'd really rather not get a joint sponsor.
