    You could have still used that passport to complete the DS-260, as long as it's not expired you're good. Then apply for a new one and have the embassy modify your DS-260 for you once they received your file from the NVC.

    My husband's interview was today (08/01/2017) and his visa was approved!!!

    You can visit during the process. My husband and I visited and I was there for 5 months during the process. 
     
    Your best bet is probably a spouse visa since you get a green card and can get a job/us driver's license etc right away.

    Thanks! I hope you find out soon, I know the wait is hard! Depends on the embassy, too. Yesterday I called around 4-5 PM EST and it still wasn't scheduled, but the rep I talked to this morning told me it was scheduled yesterday. So it could be anytime now

    It will take a while for USCIS to forward your petition to the NVC. When this happens, your online status will change to "My case was sent to the Department of State". It takes about 2 weeks from when the NVC receives it until a case number is assigned. Since your case was approved about a week ago it's highly unlikely that the NVC even received it, let alone assigned a case number. 
     
    After you get your case number and IIN (Invoice ID number) you will have to complete DS-261 - Choice of Agent. Call the NVC and ask them to review this for you over the phone. 
     
    After completing the DS-261 you will receive the NVC welcome letter and the AOS fee will unlock and you will be able to pay it online. This takes about 2 business days to process. The IV fee will unlock a few days after the AOS fee shows as PAID.
     
    After the IV fee shows as PAID (again, it takes 2 business days to process), you may complete and submit the DS-260 form. 
     
    In the meanwhile, you may start gathering all the required documents: financial documents and civil documents and send them to the NVC along with the barcode sheet that they provided in the welcome letter, then send them to the NVC. Call them to confirm your scan date and then the waiting begins.

    it's not illegal to give birth in the US, nor is it illegal to visit your husband. The problem is that being pregnant and having a USC husband might make the cbp officers suspicious of your intent (even if you just want to visit) and put you on the first flight back home. 
     
    The best course of action for you right now is to probably get married, apply for CR-1 and by the time you get it, you and the baby will be able to fly to the US on a cr-1 visa. Def not advisable to give birth in the US as that can be regarded as immigrant intent (even if it isnt, especially because you will not be able to fly out for a while after you give birth). Also, consider the cost of giving birth in the US - especially if you don't have insurance yet - vs the cost of giving birth in Romania. Better to be safe than sorry especially if a baby is involved. We all miss our husbands/significant others, but your #1 priority should be the baby's well-being for now. 
     
    Also there is a very very very high chance of you being turned around if you enter the EU then head right back to the US. Big red flag there.

    You just need to register the marriage at the US consulate in Bucharest.

    1) You are ridiculously well off (Which I doubt, sorry)
    2) You have no idea how much a US birth without insurance really costs.
