    No worries. Sometimes in the US you will see the the "given name" split out as first name and middle name. I rarely use my middle name unless it is a situation like this where they want the full legal name, but here it is still counted as part of your given name since legally it is part of your name.

     

    I also wanted to make sure that she didn't just add your surname to hers. Some cultures do that, so then her surname could have been "Kelly Reyes", "Reyes Kelly", "Kelly-Reyes", or "Reyes-Kelly".

  2. So for the first part (before you got to the "other names" question) it should have been:

     

    Surnames: Reyes

    Given Names: Mary Kelly

     

     

     

    For the "other names" it will be:

     

    Surnames: Kelly

    Given Names: Mary Hope

     

     

     

    Sorry, wasn't trying to make it difficult, but it's not safe to assume that she had already updated her passport. And the names were getting confusing. Just wanted to make sure I had them straight.

So then I tried finding more information and found the stupid RYE thread which confused me more. But if photocopies worked at the NVC stage then that's awesome bc I already have those ready to go. But he will need originals/or certified copies for interview in Haiti? Do they get returned to him there?

    Unless you provide some links then I can't really comment on what you have seen.

     

    Official guide here for the NVC (http://www.visajourney.com/wiki/index.php/NVC_Process) also agrees with what I said above. And everything that I have seen (both USCIS and NVC) says to only send copies (photocopies) of documents unless originals/certified copies are specifically requested (RFE, interview, etc.) or unless it is the actual forms being submitted (i-130, i864, etc.) and even some of those are allowed to be scanned copies in some instances.

    No worries, I am completely familiar with this. My husband's English is pretty good but he still get tripped up. There is a lot of subtlety to the English language which isn't always present in other languages. My Mandaring teacher always used to get confused when we would ask her subtleties about translating between Mandarin and English, often times the variations in English all meant the same thing to her but in reality they have very different meanings.

     

    Edit: But yes, without that help information there it is very confusing what they want. The government is not famous for its brevity or clarity. :jest:

    Question 2, After the "other surnames used" question there is another question below that "other given names used".  I don't put anything there because she has not used any given names other than her name. but when I'm finished and click on the next page it doesnt go to the next page saying i have to answer the question "other given names".  So is it ok or do i have to put "Does not apply or none" to that question.  

    As it states in the instructions the surname and given name in the first part (before the "other names" question. Should match the name her passport. If she hasn't updated her name in her passport then that would still be her maiden name.

     

    Then in the "other names" fields you would enter the new surname and her given name (even though this is the same as above).

     

     

    If however, she has updated her passport, then reverse the above and her maiden surname and given name will  go into the "other names" fields.

     

    Does that make sense? "n/a" and "none" are not valid entries here, you just need to fill in the name in her passport/travel document in the first fields, then the other name will go in the "other names"

    Why do you think that it is not true? The instructions that they provide (https://travel.state.gov/content/visas/en/immigrate/immigrant-process/documents/Supporting_documents.html) clearly state to provide photocopies of everything and bring the originals to the interview (for some some documents it may also be required to bring another copy to the interview). The only document that would be sent as an original is the i-864 (aos) from the petitioner.

     

    Where the discussion of "certified" copies is that the original that you bring to the interview must be either the actual original birth certificate or a certified copy (which is recognized as an actual official copy). You can't provide a photocopy as the only version at the interview in place of an original or certified copy. Certified copies come up because for some documents the original document does not leave the possession of the government agency that maintains it.

     

    For example, my original birth certificate resides in a government office somewhere. I can not get that document and take it somewhere, it always remains under the possession of the government office. Instead they can issue a certified copy of the original document. This means that they are certifying that it is an exact copy of the original document. I can then maintain this certified copy in my possession and use it in place of the original document. In this example, I would make a photocopy to send to the NVC and then take the certified copy with me to the interview.

    Not a problem. It was just that I saw it and then got confused. Either way works since you may end up with questions about either her or your situation.

    No, they are just trying to link up DS-260's for spouses. But it doesn't apply to you. Several people have gotten tripped up on that recently, but they didn't realize till after they submitted. Just answer no to both of those and you will be fine.

     

    Just to make sure that I understand correctly. You are currently an LPR (green card holder) and now you are petitioning for your wife? Sorry, I'm not as familiar with the visa categories for people other than the spouse of a US citizen, so I'm not certain if the FB-2 visa you have listed on your profile is the visa that you entered on or if it is the visa that you are applying for to bring your wife over. 

  9. From what I understand you are probably better off using a us based address. It is my understanding that the notices will only be sent to us addresses, and mail forwarding (like for a change of address) will not work for the notices from uscis. On the I-130 there should be a section to fill out a mailing address along with "in care of". You should probably use that and have things sent to a friend/family member in the us who can then scan them and send them to you, or simply forward them to your address abroad.

  11. Since your's is a DCF filing I'm not really sure, that process is quite a bit different from the standard IR1/CR1. Maybe check out the DCF specific forum (http://www.visajourney.com/forums/forum/82-direct-consular-filing-dcf-general-discussion/) and also check out the Thailand forum (http://www.visajourney.com/forums/forum/151-thailand/). Perhaps one of the moderators can move this thread over there for you so you will be more likely to get the help you are looking for.

    Well, that may be true, but I have also seen VJ members report that they spoke with people at NVC who told them that while the 2D barcodes are on the I-864, they aren't actually used. See this post from just a couple of weeks ago.

    So it really isn't clear if what the "correct" option is. I believe you that people have received RFE's, but others have received conflicting information. In a similar fashion, the I-130 guides here say that the beneficiary's birth certificate is no longer required, but I know of several cases recently where people were issued RFE's for just that reason.

     

    And in my case I am using the I-864EZ which does not have a 2D barcode, so it really does't matter if I fill out mine all electronic, all by hand, or some combination. OP will have to decide what they want to do.
