    The expiry date on the visa is the last date he can use the visa to enter the US, but it is up to CBP at entry to decide how long to allow him to enter for, up to 6 months. 6 months is still most common but I have seen reports of 1, 2 and 3 months being granted. I would say, with a short duration single entry visa he will almost certainly be asked about his stay by CBP so ensure he has proof of his ties to go back to India with him in case he needs to show them.

    Okay, makes sense. I guess the only dilemma we have right now is that rather he should just re-apply for renewal in June and try his luck if he gets approved or not, or 2nd option is to come to US in June and see what CBP gives him in terms of time on I-94. Hopefully CBP doesn't give him only 5 days (till time his visa expires).

  2. Thank you for your reply. He applied earlier as there are processing delays going on due to COVID and typically they give minimum 6 months validity sometime with multiple entries. He didn't have idea that he will only be given 3 months single entry. 
    Another thing I just realized is that I-94 at POE, does anyone know how long they give you to stay in US on I-94? In his case lets say he enters US on June 25 (visa expires June 31), will they only allow him to stay till June 31 on I-94 stamp or will they give him 3 months or 6 months (I know 6 months is maximum) from June 25th? Thank you.

  3. Hello, this question is for my cousin who recently applied for tourist (B2) visa at Mumbai consulate in India. When he got his passport back he noticed that he only got single entry with 3 month visa validity (US visa expires in June). The thing is that he was not planning to travel until later this year as he has commitments in India in June (medical clearance exams, pending covid vaccine etc). What are his options at this point? If he doesn't come to US on this visa before June, is he eligible to apply again or renew it? How will that application go (what are his chances of approval or renewal at that point?)? I want to know if someone was in similar situation and can offer any inputs. Thank you for your help in advance. 

  4. Question: Are you both Hindus?

    If so then you must perform Hindu wedding ceremony and then only you can apply for Marriage certificate from your local municipality. In that application it asks for Priest's signature who performed your ceremony along with one or two pictures from the ceremony. I suggest you look up Hindu marriage act, there are no court marriage in India for person of same religion, if you both are same religion you must perform ceremony first. 

     

    One thing you can do is that perform a small ceremony right now, take bunch of pictures and than apply for your marriage certificate and file your petition based on this. And later when you are ready you can do typical grand wedding......but if your interview is scheduled after this grand wedding takes place be ready to explain if CO asks about it or if they do any deeper checks!

     

    I have been through the whole process just last year. 

  5. My cousin recently applied for a F1 (student visa) at Mumbai consulate in India and was denied. He said that interview was going well until CO asked him if he has ever applied for US visa to which he answered "Yes" as my mom has filed F4 visa for my uncle (F1 applicant's father) and this application was approved with USCIS in 2009 but case won't open at NVC till at least next 4 to 5 years. CO told him that since his father already has immigration file pending he sees him not returning back to India after his education as by that time F4 file will open up. 

     

    My question is that is it possible for my mom to cancel F4 petition for her brother? If after that my cousin applies for F1 visa again would his chances improve of getting a visa? He can say that he has no pending immigration file at that time and show appropriate papers from USCIS. The reason I ask this is that my uncle is not interested in immigrating to US, he may apply for tourist visa some day but he doesn't want to settle in US but my cousin would like to complete his further education in states.

  6. My wife is entering US for first time on CR1 visa, she will get Green card once she is in US. What should she write on customs declaration form for country of residence? Should it be India where she was born and where she has been living till now? or should it be USA where she intends to live from now on?

    I had the worst thing possible happen today.  SD is 1/25. logged in this morning to find that status changed to "AT NVC" then called and got through after 30 minutes on hold to be told the case isn't even being reviewed yet.  Called back, got the same answer from a different rep.  I logged back in and the status message reverted back to the same "Action Required Status."  No checklist, no CC, nothing.  Just a cruel joke?  

    Are you sure you didn't type in a wrong case ID first time you checked?

    Heres my situation.

     

    Meetings: i did not meet my wife until we got married (we chatted, talked face timed)

     

    Courtship: whatsapp msgs, facebook, whatsapp calls.

     

    Relationship: gift cards, chats, online calls.

     

    Travel: i only went to the country once when i was getting married. My mother traveled with me.

     

    Photos: i have alot of wedding day photos and post wedding day photos.

     

    Wedding: there was no wedding announcement or invitation cards.

     

    Her parents are deceased so they were not in the wedding (ofcourse). Her brother arranged the wedding there

    One more thing to submit is an affidavit from someone close to you who attended the wedding basically stating the details of the wedding.

    Okay Thank you. Sorry for all the questions but when you fill your information out on the above website it asks for mailing address do we put our actual mailing address here, does this mean our passport will be delivered to this address after visa is granted? Or do we have option of picking up our passport?

    Just got off the phone with rep from Mumbai consulate. Apparently the customer service department works 24x7 Mon-Fri. 

    He confirmed that Bio-Metrics and Medical can be done at any consulate in India and doesn't have to be the same location as your immigrant visa interview.

    At first he thought I am trying to change the interview location which is not possible, but I later clarified that I was referring to just bio-metrics and medical.

    One more thing he had mentioned twice is to come to the consulate exactly at the scheduled time as there is no place to wait around.

     

    He is very helpful and responsive. 5 Stars!

    I would say wait till you get your NOA1 and than call them with your receipt number. It is likely that they will ask you to re-submit I 130 form with new passport copy.
