  1. Interesting.  It's been just over four years and I haven't done a K-3 since. I have submitted dozens of I-130 for Vietnamese and only the one wanted the K-3. Normally both want the time the extra time to make arrangements and finish business dealings.

     

    Thanks for the stats and information.  I find it interesting that CIS is operating in this fashion; But not entirely surprised.

  2. I went with my wife and actually was able to listen to the questions the office was asking. He asked questions she clearly didn't understand and at that point I looked at him and raised my hand. He motioned me over and I politely told him she didn't understand and I ask permission to rephrase the question. He allowed it and she gave him the answer. He the. asked me questions. One was how often I visited her. I told hi.it was my 5th trip and I stayed 8 weeks on each trip. He looked surprised and I offered my passport as proof. He declined and at that point to her. "Welcome to the United States."

  3. I would like to hear from US Citizens that married in Vietnam. 

     

    How is your name written on the Vietnam Marriage Certificate?

     

    Is it First Middle Last or Last Middle First? Are you of Vietnamese origin?

     

    Mine is First Middle Last and I have no Vietnamese heritage. Two of my friends, one born in Vietnam, the other in USA, have the names on the certificate as Last Middle First. I'm curious as to what the Vietnam rules might be or if there might actually be a mistake on my license.  I need data to assimilate a proper conclusion.

  4. The NVC has a history of switching the First and Middle name on cases where the country passport does not follow the standard of LastName, FirstName MiddleName.

     

    I am working with two U.S. Congress Senators on this issue and they are bringing this to the attention of the Department of State and NVC. The big question is how often is this being done at NVC and what countries are affected.

     

    If the Administrators here will give permission, I want to gather information to present to Congress.   

     

    I am wanting to gather information on cases from January 2018. First I just want to know the month and year the case was created at NVC, the country and how the name was changed.  This is a serious issue and can cause several problems. I have worked on dozens of cases and have seen this issue to many times. I spent 22 months getting my wife's name corrected. It caused issues with Social Security, IRS, DMV and others.  I have three other cases at NVC and the names have been changed on them. 

     

    If the Administrators will allow, please post a reply with non-confidential information. I am hoping to gather enough meta data to show this is a bigger issue than NVC admits.

  5. Think this is high what till you get to US

    now, let me vent

    applicant pays for application, processing fee for affadivit, visa application and cost of visa if granted, plus trips to meet you

    i had to apply 3 times and took 6 years and USCIS said i came back right after marriage so i had to go back for honeymoon even thought the marriage trip was 2 months

    5 trips, (one lossy lawyer for 2nd application) and all the fees 3 times plus his flight to come to US

    try just over $35000

    BTW all this i can show

    I've made three trips, two big parties and one I-130. Nine months and $10,000 later and I'm still waiting,

    Add another $2500 to bring her here. It's not cheap.

  6. I ran into this exact problem. Here is what you need to do. File your 2015 tax return ASAP. After the gets here and get her SSN you can file an amended return.

    i had to file 2 amended returns. My wife would have gotten denied at the interview I hurried up and filed and got the tax transcript and sent it to her.

    Like literally 1 week before her interview. I also did file an ITIN number for her and it was denied. Waste of time don't even do that get the taxes filed ASAP because waiting longer you might have to file 2016 with out her. My wife didn't work at the time so it worked out for claiming her as an exemption when she did get here after we got her SSNumber.

    This will avoid all the red tape and filing for an ITIN which she probably won't get anyway. Don't delay that 2015 any longer.Thank you for your

  7. I wholeheartedly agree with frontgear. I'm currently in HCMC, and had our interview earlier today. Many of the people who were there alone, were visibly nervous and scared. Most appeared to get blue slips, and I can only imagine how devastated they must have been feeling. At that point, they needed their significant other more than ever. Even I wanted to give them hugs, and I'm a borderline hermit. I went in to more debt and will likely miss Christmas at home, but even if it were 10 times that, it would be worth every penny so that I can be here for her. So, imho, even though you aren't required to, you should go to the interview with her. Feel free to ask questions.

    I'm still in Denver waiting for the interview date. I'm not worried about my wife but I am interested in how things went for you.

  8. The IRS was very helpful and I had called them from Canada a couple of times with questions. I have successfully and with ease filed U.S taxes with my husband.

    Make sure your wife has a valid passport.

    She will need to send a certified copy of the passport to the IRS. The passport has to be valid for 6 months beyond the application date.

    Depending where she is from, North American countries have differently negotiated legal treaties than others.

    I would give them a call. Take good notes and be magnanimous ... it's quite an impressive opportunity they give us. The option to file with our U.S spouses.

    Why can't you file your taxes Married Filing Separately and put NRA for non-resident alien at the place where it asks for her SSN?

    Once she comes to the US and gets her SSN you can amend your taxes to Married Filing Jointly.

    That's a great idea. No need for them to keep my $13,000 any longer than necessary.

    Me too. This is the first year with her. My former accountant retired last year and he turned over his clients to her. I have to wonder if she only got some.

  9. I received an email this morning stating I have missing Financial Evidence and I will need to send these documents to the principal applicant. It states I am missing my 2015 IRS transcript. This is a Catch 22.

    I can't get an IRS transcript until I file a 2015 tax return.

    I can't file a 2015 tax return until my wife gets a SSN.

    She can't get a SSN until she comes to the US.

    She can't come to the US until she gets a Visa.

    She can't get a Visa until she has the interview.

    Has anyone else run into this problem?

    In the mean time, I have asked my accountant to provide me with a hard copy of the return to be filed, a letter from her and the IRS explaining why it has not been filed.
