Does anyone here have the same situation? filing I-130 petition for minor child. Is there anyway i could speed up my petition since my child are minor?

I don't think you can speed up the process unless you have a special situation - minors aren't a special situation. I filed for my two sons, 9 and 11, in Sept 2022 and we've just gotten to the NVC approvals and waiting for the interview times.

  2. I am bringing my two sons, aged 8 and 10 from Philippines to the US. I submitted everything to NVC, last week, then got this last night:

The National Visa Center (NVC) updated the status of your immigrant visa application. Please go to the Department of State's Consular Electronic Application Center (CEAC) at https://ceac.state.gov/IV. You will need your NVC case number and invoice ID number to log into your account.

Once you have logged into CEAC, please look in your message box or on the Status Chart at the bottom of the page. If NVC has feedback on any items you submitted, there will be a new message with details. If not, please simply follow the updated instructions on your Status Chart to complete your case. If any column says "Pay Now", "Invalid Doc", "Incomplete", or "Re-Opened", that means you must take action by paying a fee, submitting a form, or uploading a corrected/missing document.

    Regards,
    National Visa Center,
    U.S. Department of State
    https://nvc.state.gov/ask

However, after logging in, I see no changes or messages in the case. I've looked multiple times. Anyone have an idea why this is?

Hi All, creating this thread for all who's I-130 has been approved and moved on to NVC stage - to discuss specific questions, wait times being experienced etc

I started the application for my parents in March 2023, on March 8th 2024 I saw the approval document show up for both parents under the documents tab however I haven't received anything from NVC yet, and one parent says approved/closed and the other still shows pending/  months to decision even though the Approval letter shows under the documents tab, I believe there are delays to the status update and this should also show approved soon.

My question is how long does it take for NVC to create the case and send the welcome letter after USCIS approval? what wait times is everyone experiencing for NVC to review and DQ the case/ ready to send to the consulate, once all documentation are submitted? it would be very helpful to share your experiences. Thanks!

We just got ours, like last week. Once the documents show up, it was just a couple days time. I just finished submitting the NVC documents, yesterday.

They should become US Citizens the moment their passports get stamped upon arrival.  No need to pay the $220 Immigrant Fee.  Go get their US passports right away with their endorsed visas and your naturalization certificate as proof of their US Citizenship.  If dad is remaining overseas, to get their passports you will need a DS-3053 https://eforms.state.gov/Forms/ds3053.pdf from him for each child, notarized at the US Embassy.  It's free.  Some people might consider filing N-600 for a Certificate of Citizenship for them.  It's expensive and not strictly necessary because their US passports would be proof of US Citizenship, but having a Certificate of Citizenship would remove any question about citizenship that might come up later in life.

    Thank you!

OK. And you’ve notified NVC of your citizenship and submitted proof to them? So they will now be immediate relatives, not F2A any longer and no wait for a visa.

Either way though you’ve applied for an immigrant visa (green card). And I think they’ll get citizenship upon arrival but will let others with more knowledge comment on that.

    Good luck.

Yes, I've updated with NVC. Thank you for clearing things up for me.

Your profile says F2A? So if that’s right you’ve applied for immigrant visas for them, and they’ll be green card holders on arrival. But that’s also for children of LPR’s, and you say you’re a citizen?

If you can clarify what you’ve applied for, who ‘we’ is, and give the children’s ages, then people can try and help.

I filed I-130's for each of my two sons, who are 8 and 10. I filed while I was a Permanent Resident, then I became a citizen.

    I think it's an an F2A. I'm not sure.

The reason for the length of time is because their father decided he didn't want to come, and I had to start over, and file for them seperately because they were derivatives of his visa.

I'm just not sure if there is something I need to do about my sons citizenship. I'm trying not to make any mistakes, it's taken me a long time to get this close.

That was fast, look what I received this morning:

    To Whom it Concerns:

The National Visa Center (NVC) recently received your immigrant visa petition from U.S. Citizenship and Immigration Services (USCIS). Your petition is now waiting for data entry into our systems.

Since your case is not in our systems yet, we cannot make updates.

As soon as your case is in our systems, we will send a Welcome Letter and instructions. Then, if you still need help updating your case, you can contact us by using one of the methods listed on https://nvc.state.gov/ask.

For current processing times, please visit our website: https://nvc.state.gov/timeframes for English or https://nvc.state.gov/plazos for Spanish. If your petition was approved before the dates NVC is working on, please resubmit your inquiry.

You can also begin to familiarize yourself with the documents NVC will request at that site.

Most applicants would want the I-130 to take longer for F2A, to protect the beneficiary from aging out, but I assume your sons are very young so there’s no danger of that?

    Yes, they're 8 and 10.

I believe you can get a divorce locally in US. Getting the divorce recognized in PH can be done but not mandatory. You will be seen as divorced by every country in the world but the Philippines. If you have not reclaimed your Filipino citizenship, I advise doing so before you get the divorce done.

Can I ask why it is important to reclaim my citizenship before divorce?

  11. Hello,

I had a petition filed for my filipino husband, but he decided he didn't want to immigrate to US, so I withdrew it. Also, he has another woman and a new baby. I am a Philippine immigrant, now a US citizen. Can anyone give me a liilte guidance on, if I can divorce him without going back to the Philippines? I was looking at some online divorces, but they seem too good to be true. Thank you, so much!

You go ahead w ur original plan to file I-130 for kids, apply for N-400 ( at same time if you can afford it). I suggested claiming old priority date only as a protection in case your N-400 gets delayed or Visa is not current or goes back..AND I suggested you SMILE and stay strong even though MAN who broke your heart AND seems to multiply faster than bees pollinate …is trying to block your childrens coming here. Good luck w getting custody for them .

You make me cry - in a good way. Thank you!

    Derivative Child

The derivative child of a principal beneficiary may be accorded the same priority date and classification as the principal provided that:

    • The derivative child was acquired prior to the time the principal either adjusted status or was admitted to the United States as an LPR;

    • The child continues to qualify as a child under the statutory definition (unmarried and under 21 years old)[42] or otherwise under the provisions of the CSPA, if applicable;[43] and

    • The principal remains in LPR status at the time the derivative adjusts status.[44]

Does this mean when I file new petitons for the children,  I can't become a citizen until after they arrive here?
