I don't get why people are putting service requests in while they are on their 75th day, honestly. Most of the time people hear they are within current processing times. Takes an officer off someones case to look at your request because you can't wait for another 15 days.

Its perfectly allowed. I'm sure everybody can make that decision for themselves.

all interesting reading- we filled mid September NOA received end of Sept, Biometrics done late November in Detroit. Received RFE for more evidence re his income as self employed. NOA that they received was Dec 20th. Still no AP or EAD put in a case update request mid January to be told case reverts back to 0. I thought the AOS would take longer re the RFE but I thought it wouldn't affect the EAD and AP. Desperate to get SSN for my child for health insurance (need it to finalize paperwork). Were not in a hurry for me to work though my AP wold be nice as would like to travel to Niagara Falls. My case numbers are MSC so are all my cases at NBC even though we had bios done in Detroit. I'm so confused now.

Try putting in a service request 75 days after December 30th, should be soon. I just put in mine yesterday and my AOS was received December 7th.

I have to agree with Ebunoluwa. If you are going to apply based on financial hardship these other details don't matter whatsoever, all they want to know is you have a job offer from a company and you really need the job due to financial hardship. That is all.

I am not in a position to make the call on the criteria involved on that and would forget about it and go the financial hardship

    route.

Ok thanks for the info! Could you just explain the steps you took and what you handed in when? Did you hand in the proof of financial hardship together with the job offer?

  4. Hi Guys!

I applied for AOS (+ EAD and Advanced Parole) back in December and USCIS received my case on December 7th, so exactly 2 months ago.

After I just called USCIS I am totally shocked by the information they gave me. I'm not really in a rush for the green card or advance parole but I need to start working asap to support my husband financially. The gentlemen I spoke with suggested that the National Benefits Center is currently processing EAD applications from September 11th, so that I could expect them to START working on my case in around 3 months.

I already heard that the 90 day EAD processing time promise is not valid anymore, and I UNDERSTAND that the green card takes a long time but can they really expect an immigrant not to work for 5 months (2 months waiting now + 3 months) before they even look at my EAD application?

From what I've read here, most people have received their EADs in around 2-3 months.

Do you think the information the gentleman has given me is correct?

Is there anyway I could expedite the process? I could probably get a job offer but we don't necessarily have financial hardship (although its not easy atm)

I would really appreciate your advice.

    Thank you in advance!

    Hi everyone,

One important fact is that the marriage with the first wife is not registered. It was a presence of a few people when my father married my stepmother. There is no registration that could be produced to show that he is registered and married to the first wife but he does, however, have children from the first wife.

Lying to USCIS is never a good idea. If your father practiced polygamy he has to disclose it.

"in Al Sharabi v. Heinauer (N.D. Cal. Sept. 7, 2011), upholding the immigration authorities’ reliance on Matter of H, 9 I. & N. Dec. 640 (BIA 1962), and Matter of Mujahid, 15 I. & N. Dec. 546 (BIA 1976). Mujahid, for instance, held that “even if the marriage is valid where celebrated, it is void as against public policy in the United States because it is a polygamous marriage and, therefore, cannot be recognized as valid marriage for immigration purposes.”

"A) Practicing polygamists.-Any immigrant who is coming to the United States  to practice polygamy is inadmissible."

So your parents are not considered married by the definition of USCIS. Also they are practicng polygamists. So they are BOTH inadmissible. There is no way to make a statement at the Embassy along the lines of "yes we are currently practicing polygamists however we promise to stop when we enter the US". You either ARE a practicing polygamist or you are NOT.

    Interesting!

Do you know if the situation changes when of the wives is divorced?

You are right that both wives must be treated with justice and fairness and must treated equally but also Islam does not stop you to divorce for whatever reason. Islam gives you the right to divorce for whatever reason you want the divorce.

I am here finding immigration answers to my questions and not into religious debate, however, I don't oppose such debates that help us get know each others' views and beliefs resulting in a healthy society and country and ultimately peaceful co-existence.

    Love it.

But just to clarify: I'm not trying to get into a religious debate either. I'm just trying to say that USCIS might assume there to be a need for your father to LIVE with his wives, which would obviously be a problem for them. So to be proactive you might want to explain how you see it.

    Best of luck.

She will stay with my half-brothers back in Pakistan. She does not even want to come to USA even if my father wanted to but that is not the case.

Here is what I think. My father will have to disclose this at the embassy once we pass the NVC review and provide a "Non Objection Certificate" describing that my father's first wife is ok with him living  in US and that she will not and have no intention of moving to USA (because this would be, in my opinion, polygamy to have to two wives PRESENT in US.

Doesn't the Qur’an prescribe that you must deal with both wives on basis of justice and fairness? Meaning treating them equally. So wouldn't him living with only one of them and his first wife being in another country breach that notion? The way I see it, it could result in USCIS assuming that your dad wants to bring his second wife as well and thus practice polygamy in the US.

  9. Hi Guys!

I sent out my AOS package (Form I-765, Form I-485, Form I-131) to adjust from a K1-Visa within the 90 days at the beginning of December.

Tonight I received three text messages providing me with three different receipt numbers and informing me that my Form I-765 & Form I-131 have been received and that my fingerprint fees for form I-485 have been accepted.

If someone could answer the following questions I would be really grateful:

Concerning the Form I-485 it only states when I check my case online that the fingerprint fee has been accepted. Is it concerning that it doesn't acknowledge a general receipt of the application and doesn't mention the much larger fee ($985) for Form I-485?

I would really appreciate some input! I am a little concerned because my K1-Visa is going to expire in a few days.

    Thanks so much in advance!

  10. Hi Everyone!

I need some advice for my K1 AOS please!

My husband and I are about to file for AOS and I am very confused with regards to the Medical Exam. I had my medical exam as part of the K1 Visa application process done in Algeria (where I was interning although I am a German citizen) in September 2016. Even though it generally says that no second medical exam is required if you apply within a year of the first exam I am confused with regards to the vaccination requirements.

It says on the I-693 Instructions that: " Even if a new medical examination is not required, you must still show proof that you complied with the vaccination requirements."

I'm unsure how I'm supposed to prove this without another exam? I didn't receive any documents from the panel physician in Algeria. I only received a sealed envelope which I passed on to the US embassy. I have my little yellow vaccine booklet which shows my vaccines, does that suffice as prove?

Or do I need to have another medical exam done?

Thanks so much for any advice!
