Not all of us VSC'ers are so lucky, ours seems like its taking forever, neither of us have a criminal background and we didnt use a marriage broker, my rfe was because i forgot to send a copy of my marriage license from first marriage to show name change, it seems like it would be a pretty straightforward application, but here we sit still waiting, even after 4 consective business day touches in a row -.-

  2. After you sign your case with the USCIS you will recieve notices by email and snail mail.. Though from what i have seen on here you wont always get both. Some people have been approved and never got the email and others been approved and never got the snail mail copy.

    To get your case number you need to wait for your NOA1 in snail mail or for your check to be cashed and then get the number off the back of it. My NOA1 was sent out on Nov 3 but I didnt recieve it in the snail mail till like the 14th. My check was cashed on the 9th, so I used to that to get my case # once I had registered it then the website told me when my NOA1 was mailed out.

    Pretty much as the title says.. I was thinking of that today, the email I used with uscis site is my yahoo email I have had the same email for about 7 years now and get alot of stuff sent to my spam folder (usually always spam) but Im in habit of just clicking empty on it and never really checking whats inside.. Im pretty sure I havent received any emails from uscis, but now just curious if i should be paying closer attention to my spam box or if anyone ever did have any of the emails sent there. Would suck to miss an email from them for that reason lol.

  4. Well we've filled everything in on the I-129F form but we're a little stuck on the section asking if the alien fiance is currently in the US. I am in the US (alien fiancee) but only on a 90 day visa waiver and i'll be going back to the UK in Feb. I just arrived and we wanted to submit the petition while i was here visiting so that we dont have to wait so long apart from each other. When i entered the US i told the immigration officer i was here to visit my fiance so i wasnt lying and i will be returning on the 14th feb, when my flight is booked. Do i still need to put in the information on my arrival/departure record? Will they think im trying to go against the system if i say im in the states as a visitor? I called USCIS before I went to the states and asked if we could file the petition while i was in the states visiting and they said yea. Does anyone know or anyone have any advise? Im worried now!     I filed my K1 through VSC Oct 31st my fiancee is from the UK he was here with me when we mailed it off and stil here till Dec 4. You should answer honestly on the I-129f and say that you are here and fill in the information. To my knowledge it isnt going against the system being here when you file the K1 as long as you do leave on your scheduled depart date. I felt if anything it added more proof of our current and ongoing relationship. I attached a seperate sheet of paper explaining him being here and his plans for the visit and just more confirmation that he did intend and will leave on the 4rth as his depature date stated. And so far no troubles from the VSC about it. I think in my opinion it would hurt you more if you were caught lying to the USCIS in anyway then just going ahead and being 100% honest.

  5. I've seen a lot of topics regarding the foreign fiance traveling to the US during the K1 process, but what about the US citizen's traveling to foreign fiance's country? I know you have to be in the US to start the K1 process, so does that mean that they don't want you to leave? My fiance had to apply for a waiver, which he was granted, and we knew our process would take a bit longer then most, so I decided to "visit" his country for 5 months. Would it be helpful or would it hurt us if he mentions this when he goes to his final interview in his country? Is the only reason this is discouraged because of the economic standpoint (no earning the 125% of poverty level for 2 people for 3 years?)

    I dont think its ever been discouraged for the US citizen to travel to their fiancees country. Alot of people do it, I plan on doing it myself if the wait gets to be to much for me. Alot of people go to their fiancees interviews with them, while you wont be allowed in the actual room during the interview you can still go to the embassy with them. As far as not meeting the poverty lvl, I think you only have to be above the poverty line for the past year not the past 3 years, and if going over to visit them will mean you wont meet the income requirements for this year Im not sure how that will affect the situation.

  6. Hi Everyone! Congrats to everyone that was approved or at least moved one step closer.

    A weird thing happened when I logged on to check out my status today. The message had changed and said an OS155 had been mailed out on 10/28. I thought "great, what does that mean?"

    Anyway, must of been some kind of fluke because when I logged on again a few minutes later the old message was back.

    Anyone had something like this happen before? :wacko:

    If not a fluke only other thing I can think of is maybe an RFE, I dont think you case status changes when you get one of them, only thing to do really is wait it out and see :/

    Going ahead and starting to get things together for the 2nd part of our journey, I have a question about the i-134. I seperated from my first husband 3 years ago, I left him and left him everything I just wanted to be away from him, so the past few years have been rough on me and this year have I really gotten back on my feet. This year Im making well over 24k for my annual income, but the last 3 years I didnt even break 13k. I see that most suggest sending them your past 3 years worth of tax returns but for me this wont prove I make enough to support him. Do I send them anyway? Is just the annual income I am making now enough? Since it isnt 2007 yet I dont have any tax returns for this year. I have saved my pay stubs for the past 6 months and been employed at my current job for just over a year. Is this enough?

  8. Im not confusing the issue, Im using it in how it applys to her situation. She asked if she could get married on the VWP and they stay here in the USA until they got the green card. In her case using the VWP to get married to stay in the USA is how it applys to her.

    The key words you seem to be missing in my posts is Im not saying just with the intent of marrying, I said with the intent to marry SO YOU CAN STAY in the USA.

  9. off of what I can remember:

    It is illegal to come over on the VWP with the intent to marry, unless you plan on returning to your home country after the marriage.. On the VWP you are agreeing that you are NOT coming over with the purpose of immigrating, so if you enter on the VWP with the intent of getting married so you can stay in the USA it is Illegal.

    Anytime you are denied entry into the USA it is recorded. If you are denied entry on the VWP you will never be allowed to use the VWP to enter the US again unless you file an appeal and it is approved. Getting your K1 approved does NOT guarentee entry into the US, You can still be turned away at POE if they feel like being asses, if you are denied entry you will be redflagged, once you are redflagged you will always be scrutinized closer at POE the next trip, Having a Visa doesnt mean POE still cant turn you away.. SO maybe not the actual process but theres just something else in the back of my mind I cant bring to light, that says being denied POE affects the actual visa applications too.

    I am NOT a Lawyer, and not giving legal advice. Dont take my word for it, it is just suggestions and advise based on my experiences so far. I talked to a lawyer for that reason myself. I was getting too much conflicting information and too many "ifs""ands"and "buts". I suggest to everyone who has any doubts questions concerns to get at least a consulation many lawyers will give free ones.

    just as an add on:

    If you dont think its illegal find someone guillible to tell the consulate at their AOS interview that they came over on the VWP with the intent on getting married and did get married so they could stay in the USA with their loved one, or just tell them at the POE when you get here under the VWP that you are here with the intent to marry someone and stay till your AOS is approved and watch how fast your butt is put on a plane back home. This much I am 100% postive on.

    My fiancee and I thought about it too, very long and very hard.. Its weird how the getting married part actually works but In very simple terms its like this.. If someone comes over on the VWP with the intent of getting married it is illegal and can lead to being deported and a 10year or more ban from the USA. If you can prove that your intent was not to get married when they came over then its okay in that grey area of the law. Now since its hard to prove intent either way its not really a safe route to take. I would strongly advise against it, and at the very least definately seek legal aide before doing it. In the end we are doing the K1 visa, cause when we sat down and thought about it, we hate to be apart and it kills us but being apart for a few months is way better than him being deported and possibly banned from the US if we couldnt prove intent.. ALso since you have already filed for a k1 and they are here with you (if i understand right) i think it would be very hard to prove you didnt have marriage plans when they got here.

    What we did... On VWP you can visit for 90 days in 1 trip as you know. My fiancee came here on a 88 day trip and we filed our K1 while he was here which is allowed, they will ask you on the I-129f if the beneficiary is in the USA and when they plan on leaving. We are hoping to get approved in this 88 day time and being with VSC its very likely, then he will return to england to wait for interview minimizing our actual time apart to what we hope will only be 2-3 months or less. Its what I would recommend to anyone who can actually do it this way.

    Also I dont think you can get an extension on the VWP, but as someone said you can leave country and come back for another trip. Heres the catch on it though.. 1. Very risky to do while K1 is pending and you can get denied at POE because of a pending k1, which will hurt your K1 process. 2 Is the length of your second trip, the VWP allowed 90 days per trip but the unspoken word is up to 180 days in a rolling year.. Usually anyone asking to spend more than 180 days in a rolling year in the US on the VWP gets denied alot at POE. Which once again will hurt your pending K1. WHich makes sence because the VWP is just for vacations, visits, etc. If you are spending more than 180 days in the USA than you are spending more time here then the home country so it would be technically considered living in the USA.

  11. Hi again, from my last post most of you know i just recently submitted my K1. I havent got my NOA1 in the mail yet but I got the copy of the cashed check and got my case number off the back,*Thanks to whoever posted that tip about getting it off the check dont remember who it was but big ty!* Now heres my question. I went to the gov site and registered with my case and email, and when I look at my case all it says is:

    Current Status:

    Your I129F PETITION FOR FIANCE(E) was received on November 3, 2006. We will mail you a decision as soon as processing is complete. You can use our processing dates to estimate when this case will be done. Follow the the link below for current processing dates.

    So when you get *touched* what does it say and does it show it on the same page? And is this my NOA1? or will it actually say NOA1 when I have reached that?

  12. Wow quite a few of us for Halloween lol, A party sounds great! Mine was recieved today and signed for by P NOVAK. Now to wait for the NOA1 with our case number so we can monitor our case obcessively every hour of the day, which is Im sure what we are going to do for the first few weeks lol. Heck I was so excited just when I checked the confirmation and saw it was delivered today and signed for that I called my mother to let her know lol! :lol:

Dont know how much this will help you since you dont have any pictures, Im kinda in the opposite boat we have tons of pictures togther but little of other evidence besides the airline tickets, so I thought of a creative thing to do with our pics, since he is coming for another visit before we file for the k-1. Alot of the places where I live especially banks have huge electronic boards/signs in front of them that flash the date/time all throughout the day. I figured we will get a pic in front of one of these huge signs while its showing the date and time (maybe even kissing so it shows we are there togther just not in the same place and the same time :P) Dont really know if a picture like this would be better but Im guessing its worth a shot.

  14. Its heartwarming to hear that since my boyfriend is coming in from UK in Sept and planning to stay till Dec. We arent mailing off our K-1 till Sept, but we have had plenty of worries about them allowing him in for so long, but sounds like your k-1 was already files when your fiancee came to visit and they are staying there the 3 months with no problems! I hope our next trip goes as easy as this!

  15. OKay well not customs then, whoever questioned him about his intentions on arriving in the US we didnt have any problems the first trip.

    Dont really understand your 90 day comment? You dont have to use all 90 days you can set the trip for anytime you want up to 90 days, but i have read on several websites that once you state the purpose of your trip whoever it is your talking to has the right to determine the actual length of your stay, Ill see if i can find the links to those sites and post them back here

    and yeah we already have the return ticket.
