    WOW! It's such a relief to have everything finished. It’s been a long, stressful, and painful process, but happy to finally have this all behind us.

    Congrats and thanks for wishing the rest of us well. I have similar timeline hopefully I am lucky as you are. I filed my FOIA yesterday so thanks for this information along with Sharing the info pass appointment on requesting a combo interview.

  2. Hello my I-751 with priority date is May 21, 2019 and N400 on May 30, 2021. My field location is San Francisco. I am outside processing time for N400 and a month away for the 3 years processing on I-751. I contacted twice USCIS and they forwarded to the field location but no response yet. I read filing FOIA can help so I submitted on April 13th. I plan to submit request with the Senator. Can anyone let me know if they been lucky in completing their process?

  3. Hello I hope anyone can share their experience. I attended a second interview in person (although consulate had offered to call) with my spouse. I believe this interview is what is referred to as Stoke Interview although the consulate officer said it was a marriage interview.

     

    I was asked to step outside while my wife was being interviewed. This took about 45 minutes and I was then called in and my wife was asked to step outside. I was interviewed for about 30 minutes going over our relationship info (how we met, when, etc).

     

    My spouse was then called in and this time we were both together. The office said that she had concluded her interview and will refer out case back to the visa department as they are responsible for making the final decision and do issue visas. She said that this is not a denial and consoled my wife who thought the first yellow form issued (221 G for Administrative Processing) was a visa denial.

     

    Based on VJ forums, I noted that folks were issued visa same day so not sure if it's because of the fact that it's a different consulate. Does anyone know if the folks doing the stoke interview are different from those issuing visa? Our interview was late afternoon so not sure if this also may be the reason why no decision was reached the same day. I will appreciate the input from member.

  4. Hello All. I decided to attend the stoke interview in person rather than getting a call. The interview went well and my wife was questioned for 45 min and I was questioned less than 30 min. The interviewer said that her department does not have authority to issue visa and their role is to do the interview. She said she will forward her case to the visa unit and assured us that it's not a denial. Does anyone have an idea what this means?

    Search here on VJ to find more threads about it... it's a no-holds barred type of interview, usually separately, and nothing is too personal to be asked.

     

    Thank you. The embassy said I will be called and mentioned Kenya's time. I'm not sure if this means they will call my phone or I have to be present physically. This is in 10 days and I'm in the US. Do you know if the embassy call petitioner by phone?

    Congrats Debkay. My wife had her interview on April and now she is in AP. I sent an email last week and was told that it can take up to 90 days or longer. 

     

    So I guess they are taking their time and nothing I can do. I believe they may ask me to file a waiver due to my wife previous non-immigrant visa misrepresentation. I just hope they reach the decision sooner as waivers take up to 10 months to process. 

     

    Do you know reason yours took 6 months in AP? Or they did not provide any answers?

  8. Hello All.

     

    My wife case is in AP and I suspect we may get asked to get a waiver due to misrepresentation in prior tourist visa (wife had indicated single when she was married).

     

    Not sure if I read recent posts correctly, are they now processing May 2016 submissions? How long does it take when they process May filing is it within the same month? This is really painful that approvals is taking this long.

Potentially i will also be separated from my husband in this process and that is what i am avoiding. It is a case to case basis for each of us. You cannot just attack a post just because you think their case is easier than yours, that is too shallow of some. And yes, this is a public forum ---of people needing help. i believe in ethics and being cordial even in a public forum for we are adults.     I don't think the purpose of this forum is to criticize people. It's obvious the level of difficulty for people is different and it's not cool to bash others just because they are trying to figure out a way to ensure a permanent stay. Your question is valid and eventually your spouse will relocate to the US and so allowing your visa to expire without considering all your options is definitely not an easy thing. There are legal options that allow you to buy more time and seeking an experienced immigration attorney will be wise. You should also reach out the the VJ member who successfully was able to manage this exact situation you are going through. Good luck.

    You are welcome and please ignore all the negative posts which I'm glad were removed by administrators. At the end of the day you make the decision that works for you. I understand how time consuming it is to file and eventually you husband could relocate back to US which means their is a chance of separation that is brutal. Seek legal opinion and buy as much time that will legally allow you to maintain your status. I wish you the best.

  11. Thanks Ben&Zina. I know we definitely in tough spot and wished my wife never applied for the non-immigrant visa. I'm not sure why the consulate should not have asked us to file for waiver during the interview as it seems some VJ members have been told during the interview to file for the waiver.  I know the I-601 waiver processing takes months and was hoping they made the decision during the interview. The consulate officer asked my wife for pictures (she asked for all 78 pictures) and social media communication. I sent an email to the consulate and they said it takes up to 60 days to complete AP review and could be even longer so I agree with your advise to seek congressman/senator help.

     

     

  12. Hello forum members. My wife had her interview last week (CR1) and was sent to AP. The issue is last year she had applied for a non-immigrant visa and she indicated single when she was married. She explained the reason for the lie and consulate officer asked for additional evidence and then looked at the pictures and social media copies. Afterwards she said she will review further and put the case in AP.

     

    My wife non-immigrant visa that had the false information was denied last year. I believe it's possible that the embassy may ask for us to file a waiver. What I would like to find out if the consulate has previously issued visa for similar situation as ours? If they had decided that we needed a waiver based on the incorrect information on the previous visa application, should the consulate officer not have decided during the interview that we file for a waiver (I-601)?

    Yes, I have sent several emails but they always tell me that they will contact me on the way forward once the process is done. Just recently, I sent them an email asking why my case is taking too long and they responded by saying that they are not authorized to give out any information concerning administrative processing!! So now I'm just waiting.

    Sorry about the delay and indeed it's surprising. Where is your spouse country of origin if I may ask?  Did you consider contacting your senator?

    Did you send your inquiry via email to the consulate? I have my relative parents who were in AP for a long time. She sent an email directly to the embassy and they indicated the document they were missing/waiting for.

    I believe when you contact the embassy they do provide a reason why someone is in AP. The embassy emails is provided below. They do respond within 24 hours.

  15. I will advise you to use the approved medical clinic that the Embassy has provided. My wife is from a neighboring country called Uganda and her visa is being processed in another country called Kenya. I asked the embassy if she could get her medical in her country of residence since they have the same Medical provider located there, but the consulate responded as follows, " Please note that the medical examination must be done within the consular district". 

    I even asked if the DHL pickup city for he visa can be changed to her country of residence or at the border and the embassy response was as follows, " Please note that, DHL services are available within Kenya only". So in short, the embassy has a process and if you deviate you risk doing your medical twice. Also I don't believe the medical cost in US will be $30 as we all know how medical cost are excessive. I recall I got yellow fever vaccination here in the US when I was travelling to Africa and it cost $112 and that was 10 years ago.

     

    If you still looking at saving, I will suggest you do the following:

     

    1) Check all the medical requirements from the embassy and ask them if they will accept medical results from the US.

    2) Find out the total cost from this Medical clinic in US and check with Mexico consulate if they approve this facility.

     

    If I was you I will just go with approved medical clinic as they are aware of all the requirements from the embassy. Good luck.

    Review department: Jan 18th

    CC: Feb 21

    Interview scheduled Feb 28

    Interview date Apr 11 in Nairobi

    NVC and embassy are mystery places, my cc was Feb. 16 and I got my interview date scheduled at Feb. 17th!! 

    I was kind of excited and overwhelming at the time. have been waiting so long no update, and then drop u two big gift at short time, hahahaha

     Yes that's true Parsha and thank you. We wait and wait and get frustrated and angry then you get gift of CC and then interview when least expected. I wish everyone the best as well as NVC has had delays mainly due to holidays and weather. Winter is now almost over and could be a good sign for others.

  18. Hello all and wish the best to everyone. I just received an email with interview scheduled for my wife. This was pretty quick as I was told Nairobi embassy schedule can take up to 3 months. In fact, my relative had to wait 3 months from CC. Below is timeline:

    First Scan date: Sept 27, 2016

    RFE due to missing to date AOS: Nov 17,2016

    Second Scan date: Dec 2nd, 2016

    Supervisor review transfer: Jan 14

    Review department: Jan 18th

    CC: Feb 21

    Interview scheduled: March 1st (scheduled for April 11th in Nairobi).
