  1. I am thinking of 2 things right now.

    1. How many years of income tax returns or bank statements do I need to provide. (i. e to prove residence in the USA)

    2. Does the embassy require any medical documentation of the pregnancy. For example doctor visit notes, ultrasound reports etc.

Any asistance in this regard will be highly appreciated.

  2. I am a US Citizen. I filed an I-130 for my brother about 2 years ago. At the time of filing he was single. However, he just got married last month.

Do I need to notify USCIS of this developement? Perhaps file some kind of addendum notifying them that he is married now. Or do I simply wait for his petition to start processing and then provide proof of marriage etc ?

Any assistance in this matter will be greatly appreciated.

  3. My spouse can file her N400 as soon as 8/24/20.  Given the headlines in news about funding issues due to covid-19 and other issues, should I go ahead and file the N400 anyhow. Of course, I expect it to take much longer to process due to the circumstances ? I am divided on whether to go ahead or not and will appreciate any feedback. Thanks !

  4. Hello, I am sorry to hear of your situation.  I had a relative who was in a similar situation. She was traveling back to her Dubai (where she has lived most of her adult life) form Karachi, Pakistan and was refused entry due to Dubai. Thankfully her son got her back to Pakistan by purchasing a plane ticket.  It is maddening to manage all the restrictions and covid poicies, especially across the globe. For the most reliable information on entering  the USA, I would go to the US Customs and Border Patrol  (CBP) website or contact your local US Emassy.  This link to CBP might help

There are multiple resources on entering the USA  on this website in addition to what I have provided.

I wish you all the best.

  5. Hello,

My spouse came here last month and we came across an issue where we needed to go to the a USCIS field office  and speak with an immigration officer directly. The nearest USCIS office is in Chicago. The way to do that is go to the USCIS website and schedule an appointment. Given that this is the only field office serving Chicago (3rd most populous city in the USA) getting an appointment is extremely difficult. I kept getting a message that no appointments were available and to try back later.  This was extremely frustrating as you get the exact same message every single time.

So, here is what I did. I contacted the office of my congressman and they went to work on immediately. However,  I happened to be up at 1:30am and out of the blue I decided to see if any info pass appointments were available. Lo and behold !!! They have not one but literally 10 available slots. I have the luxury of choosing a time that was convenient for me ! How about that ?

It appears they update the available time slots at or around midnight. Though I don't know the US time zone. I am in Central.  Also the earliest date you get will always be 14 days out.

    I hope this helps someone.

  6. The agency that stamps your passport is CBP (United States Customs & Border Patrol). That is why you were referred to them. However, I think it will be wise to wait for the green card arrives. I have the exact same issuy. I have however contacted my congressman just to be on the safr side. I would rather get the correct green card the first time around rather than mess around with additional forms and yet even more waiting.

  7. My spouse just went through tgis process and was approved for a visa earlier this month.

Based on our experience, the CEAC website sometimes is slow to update. I would not worry about the ceac website and use the correspondence you have received from the NVC or the US Embassy, Dhaka as a more efficient way of tracking your progress.

As always we are here to help :)

  8. You are currently in what is called AP (Administrative Processing).  Once you are in this stage, the amount of time can be indefiinite.

Given that in a few days it will be one month from the day your were advised that your visa will be ready, I would recommend contacting your US Senator for assistance or the Ombudsman

    Ombudsman link:  https://www.dhs.gov/case-assistance

Who is your senator ?   https://www.senate.gov/general/contact_information/senators_cfm.cfm?State=IL

You didn't apply as anything but the spouse of a US citizen.  Nowhere did you indicate CR1 on any paperwork.  It's just a spouse visa process for spouse of US citizen.  THe correct visa will be issued, no matter what you had in your mind when you filed the petition or applied for the visa.  Even if the visa would be issued before your two-year anniversary, entering the US AFTER the two-year anniversary would result in IR-1 status.

Oh wow. That really explains it all. I truly appreciate your help !

  10. I am going out on a limb here, but do have any money transfers (Western Union, Moneygram etc). How about greeting cards or presents mailed to each other. If so, you should only need the empty  envelopes, given they clearly show the sender/recipient  and the post marks by the postal/courier services. How about flowers you may have sent each other? A receipt from the flower shop/website showing purchaser/recipient names and addresses can help. Emails are also great way of showing proof of marriage.

These may look feeble or far fetched ideas, but we used them successfully. My advice is simple.. the more solid your documents that establish a relationship, the more likely you won't be asked many interview questions as well as a speedy processing of the visa.

Of all countries, my spouse is from Pakistan.  Her interview was quick. In 15 mins she answered about 12 questions. However they were very simple and closely related to each other.

And was rold she w get her visa in 15 days but then n reality it waz ready in 2 days!

I wish you all the best!

If you are married for 2 or more years at the time of entry into the US on an immigrant visa, you will get the 10 year green card (no ROC required).

Not sure what you mean by 3 and 5 years...? LPR status is granted right away and the green card will arrive shortly afterwards. After 3 years of entering the US on the immigrant visa - if still married to the USC petitioner - you can qualify for naturalization. Otherwise, you need to wait 5 years.

Sorry for being confusing. But you understood my question and answered my concern. I really appreciate it

  12. Thank you my friend

If you have been married 2 or more years by the time of POE, they would have to process it as IR1. They asked us how long we had been married when we went through POE together a few months ago. They will have that information and make sure you have the right visa.

So did your spouse get a permanent green card after 3 years or 5 years after POE ?

  13. Hello,

We got married a bit over 2 years ago. My spouse will be entering the USA next month.

When I applied for her over a year ago, we were of course married less than two years therefore it was CR1. However, since this is no longer the case I wish to avoid the CR1 and have my spouse get IR1 at time of entry. Some have said to let the CBP officer now at the POE and he/she will process it as IR1.  Since my spouse is still overseas, I was wondering it there is anything I can do beyond just verbally advising the CBP officer (and hope to god he/she is listening). My spouse can visit the US Embassy or if there is something I can do on the US side, I will truly appreciate any advice.

    Thanks

(stay tuned for my review of my spouses CR1 visa interview at the  US Embassy in Islamabad - Pakistan)

Congrats!! Quick question though. Did you get the interview letter (date) after receiving the CASE COMPLETE email? If yes, then how many weeks after the case complete status email? Thanks and I wish you all the best!!!

Case complete means the NVC is all done with the processing and is now waiting to get interview dates form the nvc

The NVC receives appointment dates once every month.

I received the interview date 2 weeks after case complete.
