    I see there being a clear connection as you file the I-751 jointly as a married couple unless you are separated. 
     
    My argument is that it should not be open to interpretation and that it really does matter how the instructions are understood as this could lead somebody to not include the biometric fee, (thinking that they may not be necessary and can save themselves $85) and cause either severe delay in an already lengthy process, or denial; hence why I've felt the need to clarify.
     
    I just want to point out this is not a personal, I just want to make sure the correct info is out there.  
    I'm curious to know, what stage you (or your spouse, as you stated you are a U.S. Citizen) are at in your process I see you don't have a timeline on here?

    (eyeroll) No, you are wrong. A post above already explained this, but you decided to ignore it. The exception is for the spouse of the applicant, not for the applicant-spouse.

    So that this does not lend itself to misunderstandings, those who are not obliged to send the fee for biometrics service are the spouses (US citizen or permanent resident) who are making the request to remove the conditions in the residency of the spouse.

    My wife has her biometrics appointment tomorrow and her letter was sent out on the 2nd of November. If your biometrics appointment letter was really sent out on October 25th, you maybe past your biometrics appointment. Let's hope that's not the case as USCIS considers failure to appear for biometrics appointment as an abandonment to your petition. I strongly suggest you call USCIS as early as you can tomorrow and try to talk to a higher tier (Tier 2 or 3) officer to hammer out the details.

    Hey!
     
    Just to clarify, it says 'if you are the U.S citizen or lawful permanent resident spouse', not if you are the spouse of a U.S. citizen or a lawful permanent resident.
     
    In terms of this application, the 'spouse' is the person who is either a citizen or a permanent resident through whom the conditional resident obtained their conditional residency.
     
    It is worded badly, but it isn't referring to the conditional resident who DOES have to submit for biometrics.

    It says it on page 2 of the USCIS instructions for I-751 filing, however I think it has been confused; here is it says:
     
    Biometric Services Fee.
    Conditional Resident. Each conditional resident and conditional resident dependent included in the principal petitioner’s Form I-751 is required to submit a biometric services fee with this petition, in addition to the required filing fee. (See the What Is the Filing Fee section of these Instructions.)
    U.S. Citizen or Lawful Permanent Resident Spouse. If you are the U.S. citizen or lawful permanent resident spouse, you do not need to include a biometric services fee at the time this petition is submitted. If USCIS later notifies you that you must submit your biometrics, you will receive a biometric services appointment notice with instructions on how to submit the additional fee.
     
    When it states 'lawful permanent resident spouse', it means the lawful permanent resident spouse of the conditional resident. e.g. the person through which you obtained a conditional residency. So if I (the conditional resident) were married to a U.S. citizen OR a lawful permanent resident then THEY do not have to submit a biometric fee. Does this make sense?
     
    So to clarify YES the conditional resident absolutely MUST include the biometric fee.

    Hi guys,
    Once again, thanks for the support - I really do appreciate it. Some days are better than others, but I've recently filled ut all the paperwork to volunteer at the local animal rescue league (I had to leave my cat back in the UK with my parents so I'm requesting to work with the kitties to fill the cat shaped void in my life right now) So thank you to Catvela for the suggestion. I've been taking our dogs for more walks too, just to get out of the house
    I've also started looking at edX online courses as a way to fill my time and also be making use of my brain. I'm wanting to return to university in the future to pursue a career in psychology, so figured that this will get my head back around the subject before looking into that.
    Some days are better than others, I'll have a really positive and productive day, then I'll have a day when it seems to take superhuman effort to just be able to get out of bed. - I've been talking to my partner a lot more about how I'm feeling too and he's been great, we go out a lot more, even if its just to drive around for a while (and play Pokemon Go, haha) to get me out of the house.
    ZoeUK1989 - My in-laws have got us a PS4 for Christmas so I'm pretty darn excited to get going with that in the new year haha

    I feel some of the commenters are being unsupportive and mean. Without knowing any background information about you, I can tell you this hasn't been easy for me either. I'm home all day and as much as my husband loves me, I'm a needy person and sometimes it's hard with him at work. We also only have 1 vehicle so during his 10hr shifts I'm not able to go out and make friends or explore. It's so worth it, this progress, but I understand entirely how you are feeling.

    I agree what you said. It gets to the point where you find yourself repeating day in day out. Even if I had my EAD and couldn't find a job, I'd feel the same.
    Off topic to this message: I'm sorry to see that there are people here -in other threats like these- rudely telling people to 'get over it because you chose for it' or 'Well, you should have chosen CR1 if you feel that way." That's a shame because we're all different and we all choose what we think is the best for us. Of course the CR1 visa has great options when it comes to when you enter the United States like immediately having your greencard (Or wait for it to come in the mail eventually), the authorization to work or leave the country etc etc but like I said, I couldn't handle being married to him and spending the first year of our marriage together (and this is not a bash or attack to those who did! Whatever floats your boat) so that's why we chose for K1 -> AOS. It's a little difficult at times because after all, we're all in a different country, trying to adjust, trying to get through a culture shock or feeling alone but I'm more than happy to be with him and yeah it does suck not to work, but that's -like I said before- something we all knew when we started this. Just sometimes, it hits you and a forum/community like this is great to talk to each other about it because you know you're not the only one having a slump that day or that week. That's perfectly okay and you don't sound ungrateful! Being in a foreign country with your friends and family being back home - no matter if you're K-1 or CR/IR1, that can hit you. I'd wish more members showed some compassion in that. This forum is great and we should pursue being able to talk to each other about things we faces instead of getting bashed down for choosing the way we chose.

    Thanks for the support guys, I'm really not meaning to sound ungrateful, I realise it was my decision to agree to go down this route, and like Sundaysue I would do it all over again because finally getting to fall asleep next to my husband every night is worth all of the waiting, paperwork, expense and hassle.
    I play a lot of video games, but again it gets to the point when you find yourself repeating the same routine over and over you start to lose motivation. Think i probably need to get a bit more active and get out of the house. - I'll be sure to check out some of your suggestions for ideas of things to do, thanks

    I have the same situation. Used to work 50 hours per week. Now not allowed too. Not just that, i feel so alone. I have no friends here and no one to talk too. Anyone feeling the same?

    When my fiance filed my petition, our pictures didnt have "time stamps" so we just wrote the date and location of where we took the pictures on the back of each one and it was fine

    Yes make sure you take all of those and just present what is asked of you at the window when you go to the embassy. I went over prepared but I'm glad i was rather than forgetting anything

    I second Matt&Sophie, however apparently Knightsbridge is notorious for a) trying to avoid giving you vaccinations and b) forgetting to mark them "Complete" if you do get them. So my recommendation is to try and get those vaccinations from your GP BEFORE your medical appointment.

    Just to keep anyone looking informed, we called this doctor the other day as I'd seen their details on here, however my husband had a very lengthy conversation with the receptionist who stated that he was no longer willing to do the transcription without doing a full medical 'due to legal reasons' and that she was not willing to ask the doctor if he would call us back to discuss directly.

    I'm going to call around everyone tomorrow and see if i can convince anyone to just do a vaccine transcript rather than a second medical- will let you know if I get anywhere with it.
