  1. Join the VAWA thread part 7.You still can file VAWA living abroad if you can prove that you fled from abuse.

    We had in the VAWA thread part 1/7 several cases like yours and many of them are back in the USA with GC. One of the girls that I helped with her VAWA case she left behind two children for 2 years, then she joined the U.S Army, works as a nurse and her children are here now, another one left 4 children behind for a few months and now she has a great job and all kids are here as well,both filed VAWA abroad.

    You're the only one in on this thread that seems to not be judgemental of OP's situation. May the Lord continue to bless you for all the good that you do.

  2. Hi everyone. Just want to be sure. This looks long and complicated but I don't think it really is.

    Scenario:

    Petitioner/Sponsor does not make enough to sponsor a family of 5.

    She is petitioning for her K-1 fiance and the stepdaughter. The other 2 dependents are her parents for whom she petitioned residency for and is still legally bound until they become citizens. So in all, it's a family of 5.

    Petitioner/Sponsor lives in the same household with her parents and wants to use them as household members. Her parents are married and file jointly. Their total income as a couple is $50,000

    Combined income of Petitioner/Sponsor and her both parents as household members comes to about $83,000... well over the needed amount to sponsor household of 5.

    (Petitioner/Sponsor annual income is $33,000)

    (Father's income is $37,000)

    (Mother's income is $13,000)

    --Total combined income is $83,000--

    On i-864, part 6, Petitioner/Sponsor puts her total annual income of $33,000

    Part 6, item 3, Petitioner/Sponsor puts that she wants to use the 'following household members' income, and puts her: 1) Father's name and his individual income of $37,000 2) Mother's name and her individual income of $13,000.

    In item 15, she puts the current annual household income (all 3 people combined) amount of $83,000

    Then...

    Father fills out i-864a

    Mother fills out i-864a

    Is there anything that is missing or incorrect with the above information? Should this suffice in order to support the Fiance and the stepdaugther?

    Everything looks great as for as financial support from both the petitioner & co-sponsors. You only need to use the correct form.

    Affidavit of support for K-1 requires form

    I-134 NOT I-864.

    I-134--->100% poverty guidelines

    I-864--->125% poverty guidelines

    But are you sure about 100% ??

    Sorry, but this is confusing the heck outta me, some say, when i looked up other forums, that you gottu have 125% and some say it depends on the consulate?!!!

    also, can we extend the interview on a later date? or is it not allowed?

    I-134 for K1 visas is required to meet 100% of the poverty guidelines.

    125% of the poverty guidelines is only required when form 1-864 is needed i.e AOS.

If my fiancé is making 9.50 an hour now and is 2 thousand dollars above 100 percent poverty line and is getting a raise in 3 more months to 10.50 which would put us at 100 dollars more than 125 percent poverty line, will the consular check the 125 percent for the k1 visa or will they go off of the 100 percent above poverty line?

    I am pretty sure tht my interview would be held before his raise (November 30 is when he is going to get his raise btw), so what can I do to make my interview smoother?

    Dear, you only need to meet 100% for the K1 to be approved

    But, you'll need to meet 125% for the Adjustment of Status.

    I'm sure she can. The better question is can your fiance be insured without a local driver's license.

    Here in Texas, the answer is no. Insurance companies need a TX DL before they can be added to the insurance policy.

    Actually, I live in Texas too and my insurance company GEICO says that my fiance can drive my car as long as he is a listed driver on my policy with his international driver's license. Once state license is obtain just call them back to update our policy with the new info. I will be adding my fiancé this weekend.

    So basically it's at the Insurance discretion.It wouldn't hurt to call and ask.

  6. Hello everyone,

    I've been lurking here during mine and my fiance's own visa journey. We followed the instructions posted here on how to apply for the I-129f. My fiance is the petitioner and today she received a request for more proof of meeting. We had sent in everything we could think of. I tried calling immigration but they said they can't tell us what to submit. The problem is I threw away the boarding passes when I visited twice last year. But I do have the receipt via email, would that be accepted? Since I'm Canadian my passport isn't stamped just scanned so I can't show stamps. I've been there three times in the last year.

    It also mentioned a statement of meeting. My fiance did one but should I do one as well?

    Any hep would be great.

    Your RFE is identical to mine.

    I'm the USC petitioner. I just added more detailed info to my previous statement of how we met letter, and copies of my passport exit/entry stamps(also previously submitted), and printed hotel receipts.

  7. Pictures of you two together are the best proof. Did you send many?

    I just recently had an approved RFE for this very request of evidence.

    Pictures aren't the best proof of proving one has met within the last two years. They are secondary proof per USCIS. They need dated passport entry/exit stamps, boarding passes, credit/debit card transaction receipts or statement, Lodging receipts, sworn statement from a family member are a few to choose from.

  8. I went for my interview today (0645 schedule):

    The consular officer was a middle aged American male. Here's our conversation:

    Him: Good morning! How are you today?

    Me: I'm great, sir! Thank you. And you?

    Him: Good. So let's begin. You visited him in America and met his family?

    Me: Yes. We stayed at his parents' for Christmas. I met his immediate family and relatives. *Showed a photo and named everyone in it*

    Him: *looks at the photos* Moving on. He's in the Army. What's his MOS and where is he stationed?

    Me: He's a (states MOS) and does (tells the CO about his job). He's stationed at (names base), but at the moment he's deployed. I can't say where exactly as it will violate OPSEC, Sir, but he's in (names the country).

    CO: How would you feel about moving to different states and staying overseas to be with him?

    Me: Oh I don't mind. Home is wherever he is.

    CO: Everything looks good in your file. Looks like you'll be a military spouse soon. Congratulations!

    Y'all, we PASSED THE INTERVIEW!

    Can't wait to tell my fiancé! ?

    It does not. My fiance scanned and emailed me both the G-325A & Letter of intent.

    My RFE was for proof of havinf met wihtin last two years prior even though it was included in the intial packet(assuming they lost or over looked it).

  10. Got my RFE letter this morning

    I am very disappointed that my lawyer did not do what it is asking for, this is what I need to do:

    1. US Citizenship- ( proof I am a US citizen; my lawyer never asked for my US Passport nor birth certificate)

    2. Beneficiary's Intent to marry- ( never requested for this letter from my fiancee'; I was with her throughout the whole filing months Feb-2016 thru July 2016)

    3. Requirement that Petitioner and Beneficiary have met in person- ( never asked for my visa entry stamps from passport, boarding passes; he only asked for photos and a letter of how we met)

    4. G-325A Biographic Information- ( incomplete form and not checked before it was sent to USCIS)

    Had I not been doing my chemotherapy, I could have successfully done this myself. Sadly, I am further delayed.

    I checked and called and emailed him before I left my fiancee' that everything was in order and he informed me it was.

    This is really a sad day.

    You need a refund as it appears that Lawyer is incompetent in following instructions, it's water under the bridge now. The RFE is simple:

    Just send them the following:

    *USC Birth Certificate OR ALL pages of passport pages including the bio page.

    *Passport entry/exit stamped pages and or boarding passes including stamps within the last two years prior to filing petition.

    * Beneficiary's letter of intent to marry. Have your fiance type or handwrite and sign. Your fiancé can then scan and email it to you.

    *Complete another identical G-325A be sure fill in entirely and write N/A where applicable. If it's for your fiancé just have her complete, sign , scan and email back to you.

    RFE'S aren't taking very long to approve. On average it's about 4-14 days. Mine took 8.

    May filer here. I consider myself lucky having been approved. You guys should consider yourself SUPER lucky as there are still may early, mid & late filer who's petition hasn't been touched. Your approvals are right around the corner as USCIS is approaching the end of their fiscal year in September.

  12. you wont get you r A-number until NOA2 so just print his full name on the back of the passport photo with pencil or felt tip pen. make copies of the forms and just to be safe i would send both back. its crazy that they are requesting 2 photos because they only require 1 of you and 1 of him, but I'm no expert. the USCIS has their reasons, i guess. for the address, is it not listed on the notice?

    In addition, There should've been a pre addressed white envelope with the request.

    I'll check my file for the address. I know it's in Laguna Niguel, California.

    I just recently got my RFE approved.
