    Try working with the USCIS Ombudsman, and your elected representative or senator (most offices have staff for immigration related inquiries).  You can also try call USCIS and get through to a Tier 2, I forget the trick to get a real person on, maybe @Crazy Cat will drop by with some help.

    Thank you, writing the ombudsman as we speak. spoke with a their 2 a few weeks back and they weren't much of any help. He told us the denial order was being processed and he said to send a letter to NY asking them to cancel the order and send case to MD as they missed the change of address. we did that and it was obviously missed. 

  2. Hi, so my wife and I moved from NY to MD last summer and when we filed our 751 we were still in NY. When we moved, we did a changed of address that was NEVER picked up by USCIS and by the time my wife finally got her interview letter (back in April), they scheduled it for for 4/8/22 IN NY instead of MD. We were not able to take off of work to go. We called USCIS and they told her not to go and someone will call back to schedule a new appointment and also get her an appointment in MD to get a stamp renewal allowing her to work since that was expiring too. Now, because she didn't show up, by way of the USCIS officers instructions, the visa has been DENIED and we have to spend money to appeal (Form I-290B) when it wasn't our fault. What can we do? The letter states that we have to provide evidence that it is LEGALLY their fault. They also sent us a letter saying the address has finally been changed and yet the sent the denial letter to the NY address AGAIN. This is insane.

     

    • Change of address sent last year July.
    • They never picked it up.
    • USCIS officer told us not to attend and someone will get back to us with a new date
    • The letter they sent is not even dated AND it was sent to the old address even after getting a letter stating the address was updated. 

     

    Please HELP!! 

  3. Just a check in. I filed July 6, 2016. Case was approved by USCIS March 26th, 2017. Case was sent to NVC end of March, early April. Did the fees and IV Package, mailed out June 26th and case has been deemed complete by NVC. Not sure of the specific date but I called yesterday and they confirmed it. Wife and I are now waiting on an interview date 🤗. 

     

    Good Luck to everyone still waiting. It's a long process and has been for me as well but it'll happen 💜

    I wanted to know the same thing when I looked at her timeline as well! lol - giveeeeeeeee us the deets!!!

    Im sorry you are going through this, I completely understand how you feel. 

    I understand that these things take time but I wish these people would understand our feelings in this. 

    I hope you get a response soon and as well as I - they had me do the inquiry form as well.

When did you get your NOA1? July 6th? Usually NOA1 comes a few days - 1 week after USCIS has received your package. Even still, if you were transferred to Texas November 18th, with a PD of sometime in July.... You are way outside normal processing times... (6 months).

     

    I would contact your local congressman and/or senator. Write an official letter to them explaining your case has been sitting in USCIS limbo for way beyond normal processing (via email). Have all of your dates/communications from USCIS well documented for them. Then you should call them the same day. There are other threads on here that speak to this especially - I'm sure you could find examples of language people used if you wanted. From what I've seen, people have had luck getting something moved through once a member of congress was involved. You have every right to be upset, this is way beyond normal processing.

    I sent out her packet on the 5th, it was overnighted. Our PD is the 6th of July. We received our NOA1 on the 14th - just to clarify. 

     

    & I will look into contacting my Senator. 

    When I called on Thursday though, the rep had me fill out an inquiry form of some sort that will be sent to the center and they are said to respond within two weeks. 

    So by 3/9/17 I should have a response hopefully. This is certainly ridiculous. 

  7. Hello All,

     

    has anyone had had an issue with their service center OVERLOOKING their file? I filed for my wife July 5th, and PD is the 6th. Our case was transferred from NSC to TSC on 11/18. Still to this day, haven't heard anything so I decided to call on Thursday. The rep I spoke to told me that the service center as of 12/31/16 is on PD August 2?! So I'm like #######?!!! Has anyone else had this experience?! I'm super frustrated and angry to say the LEAST. 

     

    I cant possibly understand why this has happened. 

    Advice, please.

    I completely agree. You and I have transfer dates a day apart so hopefully we are approved around the same time & im praying it's sometime this month. I was expecting the first part of the process to be 5 months tops. It's going on 6 months now - I'm getting anxious.

     

    Good luck though. As far as what's different who knows. What I do know is it's hard to get your case expedited - pregnancy (which you would hope could make you a priority) isn't even one ...

     

    all we we can do is wait.

  9. Hello ALL!

    I sent out my I-130 for my wife on July 5th and it was received on JULY 6th by the Nebraska office.

    Been waiting to hear back from the USCIS and received a letter in the mail stating my file was

    transferred to Texas on 11/18/16. I received the hard copy of that notice today (yesterday 11/26)

    Based off of other forums and profiles I've read, I'm hoping that we get a final approval by sometime next month.

    I will update my timeline and this forum when I hear anything back.

    I will say I am glad it was transferred because apparently, Nebraska is super backed up - so I hope Texas can get things moving.

    My wife and I are eager to move onto the next step.

  10. Hey Everyone !!!

    Please Help!! So I went to the NY State benefits website and put in my info to see if I was eligible for food stamps NOT KNOWING that I would be sent a card. I filed the I-130 for my wife back in July and currently waiting to hear back. I'm freaking out because I'm not sure if I'm allowed (if I wanted to) to use food stamps (SNAP) to help me out for a bit while things are pending - I am seriously about to call and cancel the card tomorrow morning just in case.

    Whilst i'm at it, I have state medicaid for health insurance, is that okay or bad (if so) as well?

    Please someone respond!! I don't want to risk the process being denied.

  11. This will not cause a denial.

    The medical checks for drug use, TB (chest x Ray to look for shadows on your lungs), certain STDs such as syphillis and they will ask questions pertaining to mental health to check that you are not a danger to yourself or others. They will also check her vaccination records to make sure they are up to date with the requirements.

    I have epilepsy and have had a brain haemorrhage and stroke that have left me with partial paralysis. Not a problem at all in terms of approval/denial. But your wife will need to take paperwork from the specialist (assume she is under a neurologist) documenting the condition. This is recommended for anyone with a chronic or serious medical condition.

    Thanks so much for your reply! That makes perfect sense, we both were getting a bit nervous. Glad to know that a medical note should be all she needs, she's in otherwise "perfect" health. As for you, keep pushing! thanks again!

  12. Okay,

    So I know that there is a full medical that is done before the interview (not there yet - just filed the I-130 on the 5th (yesterday), so just thinking ahead.) My wife just found out that she might have a condition known as False Brain Tumors. When it comes time for the medical to be done, if she is diagnosed, it will come up. What exactly do they look for in terms of doing the medical exam? Can she possibly be denied?

    My assumption is that she should be fine as long as the condition isn't communicable.

    any thoughts?

  14. Just to clarify - I just bought a ticket today mind you:

    I, the US Citizen, will be sending out my wife's I-130 packet at the start of next week. I plan to go visit her in August; will I have a hard time going to visit once we start the process? Is there anything I should take with me? or is it more so my wife that will have to have the proof that she is going back to the UK if she decides to come visit me here in the US?

    I just want to make sure because I do want to fly over and get turned away and vice versa.

    I'm new to visa journey so still getting the hang of it but thank you for responding! And I totally agree. I'd prefer not to get an RFE either.

    So I'll be adding as much as I deem necessary and as proof. I'm hoping this process doesn't take more than a year. It's stressful enough having to wait as it is.

    I'm not Fitleo but I wanted to reply to this. In my packet I included everything you're planning on adding to yours. All of that stuff is a good variety of things that show an ongoing relation where you're integrating with each other's families. For my part, I'm willing to bet that I "overdid it" with the evidence I included, but I'd rather they have more than they need, than me sending not enough and getting a RFE!
