    I see no reason for them to have quotas for denials. Denials normally happen because the CO considers the applicant as inadmissible or the CO has doubts that the relationship/marriage is real. The NOID letter will be specific, and you will have the opportunity to address and rebut each point the CO makes. Your wife should be able to pinpoint exactly where the problem lies based on the CO questions. Good luck. I hope you get the letter from USCIS soon. Once USCIS reaffirms the case, the consulate cannot deny again for the same reasons.

    Path of least resistance is probably just to get another medical exam.

    You got lucky. There are plenty of real cases here on VJ which resulted a a denial based on "too married for a K-1" determination by the Consulate. It happens. There is a reason we are advising against anything which looks like a marriage ceremony....and the OP even called it that.

    What paperwork did your wife receive from the Consulate Officer? Can you post a redacted copy?

    If denied, the case will be sent back to USCIS. In a few months, you should get a Notice of Intent to Deny from USCIS. You will be given a chance to rebut the denial. If successful, USCIS will then send it back to the consulate.

    Another vote to IMMEDIATELY contact NVC to delay the interview until after the ban ends. . Otherwise, it will be a very cumbersome process.

    In these situations, the applicant normally knows why the visa was actually denied. I think something else was said or discovered during the interview. That "reason" of traveling together doesn't sound legit to me.

    You accurately list the dates of her travel. There is no requirement for her to have an arrival stamp after a trip outside the US. This is not an issue.

    That is done at USCIS. You won't know until you look at the Green Card itself.

    Use the receipt number for the payment of the Green Card (immigrant fee ) paid to USCIS after the visa was issued.

    Agree. Even if they were sequential, individual field offices have influence over processing speed of N-400s....unlike I-130s and I-129Fs.

    For whatever reason, she now has a court date in 3 weeks. I would not try to fight this alone. I would immediately find an attorney who can build a good case. Hopefully, the judge will allow her to stay.

    Because Marriage does NOT grant ANY legal status or authorization to stay in the US. When the I-485 was denied, she immediately became deportable since it was beyond the authorized 90 days. If she then immediately refiled a PROPER I-485, she should be granted authorized stay until the new I-485 is adjudicated. However, now that she has a court date, she better get an attorney TODAY! Seems to me her only defense will be that she refiled the I-485. This is not DIY. This is pretty serious.

    They are....but sometimes a Green Card holder will have to get biometrics done after they arrive in the US due to unclear fingerprints. What DOESN'T happen is a Green Card holder getting called back in for an interview after arriving. Who would even conduct an interview??

    I just watched an interview where the acting director of ICE said they are going after anyone who has overstayed.

    Are you say that people who entered via immigrant visas were required to report for another interview after entering the US? Or did they have to just provide biometrics?
