The EAD/AP processing time is 90 days. You can start inquiring with USCIS after day 75, but definitely no reason to freak out until 90 days are over, especially as your STEM EAD are still valid.
Hey VJ,
This forum has been extremely helpful in the past few weeks.
I applied for AOS from F-1 status. I am currently working on OPT STEM EAD. I applied for AOS thru marriage to USC in April, got biometrics done on 11 May, and on 23 May online it said i-485 ready to interview. BUT my i-130, i131 and i-765 still say "My case was received on April 7.." Is it too soon to freak out about my EAD and AP?
Also, any idea how long St.Paul, MN is taking to interview people?
Thank you,
-
That is not a worry in my case, as my case is ready to be scheduled for an interview
If something in the underlying petition warrants an RFE (often mistakes with I-864) that delays the EAD, EAD is only issued if everything else looks OK with I-130, I-485 and the other forms.
Thank you! This definitely makes me feel better:)
Don't worry. I filed back in January. My EAD for OPT will expire in July. I checked renewal, and my new combo card came in April. No RFE at all.
but I485 still stuck at fingerprint fee received as of today... TT_TT

Thank you! You make me feel better:)
Oh, I see! Well, I think USCIS has seen this mix up enough times (you certainly aren't the first person!) that it will not result in an RFE. Hopefully you get your EAD soon.

Thanks! Yes, my OPT EAD expired on June. And that's why I checked renewal as well. But after re-reading the I-765 instructions I feel like I should have checked "new EAD" as for renewal it says "issued under the same category".
I think you'll be fine but I honestly cannot remember what category I checked. You say your OPT job is waiting for you after you get your new card. Is your most recent EAD card expired? If so, I think the USCIS provision below would make the renewal the correct option. (You are still eligible due to your AOS filing) Good luck!
"If you are still eligible for work authorization but your EAD has expired, you should file for a renewal EAD by submitting a Form I-765, Application for Employment Authorization. You cannot file for a renewal EAD more than 120 days before your original EAD expires."

Hi everyone!
I just realized that I made a mistake on I-765 (filing concurrently with I-485/I-130). I had an EAD already on F-1/OPT, so I checked "renewal" rather than "new card" as it seemed weird to me to attach a copy of my EAD and say "new EAD". But now I understand that my new one would be under a different category, so "renewal" is non-applicable.
Other than that, everything else was correct. Category c(9), all the correct dates and office for the previous EAD and its copy attached.
I'm nearing on 60 days since submission of all the documents, we haven't gotten any RFEs, I-485 is ready to be scheduled for an interview.
What should I do? Nothing? Or call USICS? Or re-submit?
Super nervous about this as my OPT job is waiting on me to come back as soon as I get my new EAD.

Just read the instructions really
For I-130 you don't need neither passport not EAD (OPT) nor I-20
The instructions for I-485 say:
3. Copy of passport page with nonimmigrant visa
If you have obtained a nonimmigrant visa(s) from a U.S. Embassy or consulate abroad within the last year, submit a photocopy(ies) of the page(s) of your passport containing the visa(s).
And don't ask for I-20
The instructions for I-765 say
-
A copy of Form I-94, Arrival-Departure Record (front and back), if available. If you are filing Form I-765 under the ©(9) category, Form I-94 is not required.
-
A copy of your last EAD (front and back). If no prior EAD has been issued, you must submit a copy of a government-issued identity document, such as a passport showing your picture, name, and date of birth; a birth certificate with photo ID; a visa issued by a foreign consulate; or a national ID document with photo and/or fingerprint.

I sent a copy of my I-20 and didn't get an RFE. Will bring the original to the interview in case they want to look at it. Same with the Passport - I only sent the last (i.e. active) visa page copy.
-
We didn't send any and didn't get an RFE. Will bring them to the interview though. We sent friends' affidavits and commingling stuff (lease, bills, bank statement), seems like it was enough.
Pls help
Also the wedding pictures etc . We send ,how did u put the pictures together to send ...in plastic bag or something ?? -
Thank you so much! By other steps I meant like an id or passport and ssn. Does that come with the card or do I have to go anywhere specific to apply?
You get those separately. Apply for SSN at the Social Security Administration (not sure if you need EAD for that, I applied way back when I was on F-1, so maybe not) and for the ID or drivers license - at the DMV (after you get the EAD).
EAD doesn't have anything to do with domestic travel and doesn't really have any other use other than confirming your eligibility to work, as other folks mentioned above. You can travel within the US on your passport and then on your ID when you get it.
And you'll need SSN asap, as you'll need it for employment.
Congrats and wait patiently for your interview - it could be few more months.

Your case is going pretty fast. I'm also adjusting from F-1 and since they receive my file, my case haven't had any update
Don't want to jinx it. Either way, if you haven't gotten and RFIE or RFE yet - I don't think you have anything to worry about. And after "ready to be scheduled for interview" it can be months and months of waiting for an actual interview, as it depends on the backlog at the local office. And NYC definitely got that. So I don't expect an actual interview to happen until December, if we get lucky.

Hi! I'm adjusting from F-1. Our friends just wrote some facts about our relationship in chronological order: when they found out we were a couple, how they interacted with us, how we celebrated the wedding etc, that they believe our marriage is bona fide, we're a happy couple etc etc.

As of today, case ready to be scheduled for interview! Yay!
-
Biometrics done today, now will be eagerly waiting for my new EAD. Have a little hope that it would get processed a little quicker since I'd already had an EAD on my F-1/OPT. We'll see what happens!
-
Phew! Received my biometrics letter today! Appointment 5/31, I will probably do it on the assigned date.
-
Finally received our hard copy notices, however no biometrics yet! Hope to get that one by the end of the week.
-
I'm starting to get nervous! We got electronic NOA on May 7 (checks cashed on May 6 and receipt date on the USCIS website is April 29), but we still haven't received hard copy receipts or biometrics! I see that some people with similar filing dates here are getting biometrics for May 24-27..
What if our letters get lost by USPS or whatever and I'll miss my biometrics or something like that?
-
Hello All, we are April filers. Waiting for biometrics.
Packet reached - 4/28.
NOA1 hard copies received - 5/9.
We're just one day behind you guys, although we haven't gotten our hard copies yet - waiting.
-
Our case numbers finally check out on the uscis website and I was pleased to see that the receipt date for I-130 and I-765 is April 29 - same day our package was delivered to Chicago. For I-485 it says biometrics fee received on May 5, so hope to get my biometrics appointment soon!

I read in some other topic that now I-693 is required. Although I had the same concern when I was filing.
But after I did some research on civil surgeons, I was able to get my I-693 in literally 3 days with no hassle. Came in for the appt on Saturday, got the missing vaccine shots and the tuberculosis test. Came back on Tuesday, got my test read and got the papers right away. I don't know what the cituation like doctors wise in Indy, but I'm sure you can get it done quickly.
-
We had separate G1145s filled out for I130 and I485 but I guess they would just contact him (USC) on all of the petitions as he got texts for I-130, I-485 and I-765
-
Yay, got the text and email notifications today, although they only came to my husband, none for me (we filed I-130, I-485, I-765, both check were cashed). Is that normal?
-
Congrats!
The fact that they cashed your checks means a lot. So relax and try to distract yourself, your noas will come soon
I'm super jumpy, because my current EAD expires on June 1 and every day counts in terms of when I get the renewed one :/
But yes, at least as checks are cashed that means they started processing somewhat...

Package received in Chicago on Apr 29.
Both checks cashed today at 6 am, no notifications yet, although we filled out the electronic notification form... Waiting...

I had the same question! It's a 6-day difference for me and it's a big difference when the job is already waiting:)
