  1. This is not so much of a question, rather just me venting on my situation.

    Its been almost exactly 4 months since I sent in my AOS packet (6 months since POE), and close to two months since doing biometrics and nothing is processed yet. I swear I'm losing my mind without a job or something meaningful to occupy my time.

    Called USCIS around the 3 month mark and they told me that processing will take an additional 30 days because I did biotmetics late (even though I've seen people get accepted as quickly as the day after biometrics). I gave it the additional 30 days and called back today (as none of my cases show up as valid in the case status online this is my only way to check on it). I was told that my biometrics was received but somehow still processing and that she would submit a request and I should hear back in 2 weeks. Yay right? Nope. She said that I will receive notice of an estimate in 2 weeks. So it's still fully possible that I get a notice that says 'give it an additional 30 days'.

    I know other people have had worse horror stories, but I feel like they're dropping the ball with my case. I'm an independent person, not a kept woman. To have to keep asking my wife for grocery money, or some cash to buy new shoes because my winter boots are worn out is driving me crazy. I tried spacing out my savings so that I could contribute for as long as possible but its been months of leaving my wife with the burden of rent, groceries, utilities (I helped before because it was a small bill but my personal funds are now basically zero so they're on her from now on). I wont even be able to buy her a Christmas gift with my own money this year and It's making me feel so useless.

    It's also hurting with evidence. We intended to add me to her insurance but the deadline just passed and we in the end made the decision it's not worth the additional bill (her insurance is insanely expensive). So that's one big chunk of evidence we'll be missing if we get the AOS interview soon. UGH!

    Sorry to rant...I don't have many people to talk to about this. I try not to stress my wife out because shes miserable as it is with her crappy job (which I promised her that she could take a break from once I get my EAD...oops <_<) that she can't leave because she's supporting two people now, as well as family issues.

    Maybe it's just because I'm stir-crazy but it feels like USCIS is just trying to destroy new relationships with all this, honestly, it's so hard to enjoy the newlywed phase when everything starts with the question 'can we afford it'. Every time we argue about money the light at the end of the tunnel is that i'll get my EAD and our finances should double....but that light seems to just keep getting further away....*sigh*

    Contact your local congressman - I promise you will get something done ASAP if you go through them.

  2. Do not lie - if you're caught you will get a lifetime ban. Why risk it? You've made it so far so why jeopardize it over a lie? I'd tell the truth and possibly wait a year to come over. They WILL test your urine as now (especially in European countries) because there is so much exposure to drugs right now with everything going on - they are being very very strict about drugs right now. NEVER lie to the USCIS. They will find you out. They also monitor these sites ( I know of someone whom used to work for them.)

    I understand that approximately after 10-15 days from the interview, the applicant's passport with immigrant visa will be returned via courier.

    I wonder if along with your passport, everything else you need to travel to the US will also be delivered (i.e. envelope to show to US custom and any additional document).

    I would like to terminate my rent agreement (I have 2 months notice) and want to make sure that nothing else will be delivered to my mail address and that everything I need will be with the courier.

  4. Provide a new I-864 from her with the corrections needed to make her household size correct at only 2, herself and the immigrant being sponsored.

    A complete copy of the most recent tax return with all forms, schedules, W-2s and/or 1099s, or an IRS transcript are always required.

    Include the newly updated I-864 and the complete tax return they are asking for, and include a statement that she is correcting her I-864 because she mistakenly counted her household size, and that she has no dependents or spouse.

    You mentioned household sponsor, so I need to ask out of confusion, did she fill out her own separate I-864 as the joint sponsor, or an I-864A as a qualifying household member to combine her income with your husband's on his I-864?

    Thank you so much - she filled out her own aos for me desperate from my husbands as a cosponsor. I just must've mistaken one of the questions and put 3 instead of 2 because I assumed it meant I had to include my husband. Idk. Ok I shall order new tax forms and resubmit this. Should I take it to a infopass appointment or just send the new thing off? Thank you!!!!

  5. Does your mother in law claim your brother in law on her taxes? If not, she does exceed the $20,025 line for 2.

    A primary house is not often accepted as an asset, but if it were to even be considered it would be on the value of the house minus any mortgages, etc. A licensed real estate agent can give you an appraisal that is acceptable. I'd shy away from this option if possible.

    I think you should ignore anything rapid visa is telling you since it seems to be confusing. I hope you didn't pay them any money.

    No she doesn't claim him on her taxes - she owns the house fully outright therefore no mortgage or anything which is why I assumed I could use it as an asset however upon realization that I can use her earnings to cover the both of us that should be fine right? I think I initially put a family of 3 instead of 2 as I thought we had to include my husband as he was also technically a sponsor. We paid those robbers for the K1 I would never ever use them again. Thank you for all of your help and advice. My mother in law cut her hours down so now earns $22,000 a year. My brother in law also earns above 20,000 a year. Therefore everyone is responsible for themselves. I'm not sure how to get a house appraisal or how long that will take. If she only needs to sponsor me then her income alone should be sufficient?

    Also, in regards to a cosponsor or a household sponsor I was told through rapidvisa that I could use a household sponsor.

    If no spouse and no other dependents, then she only needs to make enough for a household size of 2, herself and the immigrant.

  8. Does she have a spouse, another dependent, or there is more than one immigrant? Why does she have a household count of 3?

    The instructions tell you what you can use for assets, and what to provide. You would need a professional appraisal to use property, and you cannot use a car if you only own one. >

    You may include the net value of your home as an asset. The net value of the home is the appraised value of the home,

    minus the sum of any and all loans secured by a mortgage, trust deed, or other lien on the home. If you wish to include

    the net value of your home, then you must include documentation demonstrating that you own it, a recent appraisal by a

    licensed appraiser, and evidence of the amount of any and all loans secured by a mortgage, trust deed, or other lien on the

    home. You may not include the net value of an automobile unless you show that you have more than one automobile, and

    at least one automobile is not included as an asset.

    Because she is a cosponsor is she not legible for a household of 3 or no? And no spouse nor dependent.... therefore if she is a cosponsor would it just be me she needed to clear the amount for?

  9. It is self-employment income and can be used, BUT, he would most likely need to file taxes on it before they would accept it. They will go by line 22, Total Income, of the most recent 1040 for proof of self-employment income. He could try sending proof of the business and income, along with last 12 months of bank statements to show deposits each month, but no guarantee they would accept it.

    What does the RFE state they need from your joint sponsor? Maybe if you just respond correctly to the RFE, then you will get approval.

    So for the RFE they required the tax returns for my mother in law (which we did send) I guess they lost them, along with proof of assets because she is partially retired. She owns a house which online is avereaged at around $160000-$189000 and she gave us a certified letter to show she does own the house but it has no numerical value on it? How would I prove the worth of the house. Her car is only set to be worth around $6000 so I guess we may as well just use the house. Her earnings were around 22,000 so just under 4,000 short of the income for a 3 person household. I don't know how I'd prove this.

    so we got an RFE for all of this info for our cosponsor which is really dragging us behind. However, my husband makes 12,000 a year with his new job and has 13,000 in assets. He also makes 10,000 a year from eBay as he has an online store - this would theoretically push us well over the $21,000 required for AOS... but I just want to know is eBay income sufficient income? Would they accept that as income alongside any regular job (he's going to have to claim it on his taxes this year as this is the first year he's made so much due to loosing his last job). Trying to make an info pass appointment in New York seems almost useless I've been trying daily to no avail yet.

    Someone please help so we can push through this RFE as fast as possible.

  11. Aghhhh!!! I done my fingerprints today - then I got 3 messages in a row from USCIS saying my case had been updated only to log on (with problems as their site kept kicking me out and locking my account) just to see we have an RFE... no idea what it's for :-( damn!!! As if this process isn't stressful enough...

    Does anyone know will my EAD still be within the normal timeline even though I'll have an RFE - also I have a job offer can I continue on with my expedite as I was told by uscis to wait until after my fingerprints were done.

  12. This may sound harsh but it's not your kid. It's also just blackmailing. She knew what she was doing all along and now she's using you even further. Do not feel legally obligated to this woman or her child. You didn't bring this child into the world therefore the child is not your responsibility. Spend that time and money doing something that'll make you happy. If you do this for her where will she draw the line? Vacations? Her healthcare? Cars? Finish it while you can.

    Currently I am living in MO and I got a letter for biometrics taken at local uscis office but unfortunately I have to postphond my biometrics date

    How long does it take to reschedule again ? Does it affect my EAD card issuance process? I mean it takes longer duration to prepare EAD card. Please share your experience.

    You'll be put back into the system so could be anywhere between 5-20 days before your next appointment depending on how busy your office is. Also , yes as they cannot approve your petitions without the biometrics. So I'd get them done asap.

  14. I hope you get you're AOS pulled today. If not this woman is going to rinse you forever more, she will start on the VAWA accusations and will make your life hell. Trust me it's much better to be alone and look after your daughter than to put not only you but also your child through the behaviors of this woman. Spend the money you spend taking her away to educate and make a better life for your daughter. At the end of the day you believed you fell for someone with a deep emotional connection and she turned out to be a faker - sometimes it happens (even to the best of us) so just keep your head up high support your daughter and get this nasty and malicious woman out of your life - she seems very cunning and sly so watch everything you do and note it all down to cover your own back. Good luck and keep us all posted when you pull that AOS... then get her on a flight home asap.

  15. Dear Friends,

    I'm so happy and excited to be leaving for Thailand in the morning...to bring my Noom home to America so we can begin our lives together. All the waiting and anxiety is finally over. It is so hard to believe! We'll enjoy 10 days relaxing (plus celebrating my birthday) before we fly back to America TOGETHER on October 3.

    The thought of no more sad good byes, tears, and long separations makes us both so very very happy. What a relief :)

  16. Op - I'm 21 and I pay for all of my own meals, my own insurance, my own car payments, and phone bill. Before I moved here I saved every penny from my old job which was reasonably well paid. I would never expect to move here and become a financial burden on someone else. Yes my husband helps me out by paying for meals sometimes or taking us out to the cinema or shopping or whatever, and I am very lucky in the sense he would help me out no problem. But I think you are expecting something miraculous to happen such as overnight your husband becomes a human ATM. It's all about helping one another but you have a job, and an obligation to pay for what you use - nobody else. I'm sorry if this comes across rude or abrupt but I feel like you're just expecting way too much from him. Either leave him if you're fed up with it, or sit down and have a conversation with him and sort something out that way.

  17. It very much can lead to deportation and getting annoyed for someone telling you this shows you have no intellect or ability to process what you plan to do is just wrong. Being marked to a USC does not make any difference they will deport her if she's committed immigration fraud. Also, depending where she is coming from they will align her name up with marital records and if she gets caught it will be bad for both her and you.

  18. We got married back in July. My wife tried to go to the Social Security Office in August to change her name on her Social Security Card and the person there basically told her that she had to wait util all of the Adjustment of Status stuff went through, which I'm nearly positive is not the case. Has anyone else experienced this? Or did she just get someone that has no idea what they are talking about? I don't want to send her back there again and be told the same thing again.

    On a side note, she did not have a driver's license in Mexico. What is the process for her to obtain one here? We live in Florida. Does she have to go to a driving school and take a class like we did in high school? I haven't had a lot of time to research it. Was hoping someone here knew what had to happen. Do we have to wait for any of the AOS stuff to come back, or could she do it now?

    I can only speak for New York as that's where I am. However for the SSN card you can definitely get that changed so long as you have all of your visa info and marriage certificate. With the driving - yes she'll need to do her permit test and possibly some other classes (basically what you done when you started learning how to drive in high school) some DMV's won't allow you to get a permit until she receives her GC - I got a temporary visitors DL which expires in a year upon issuance of my GC it'll be further extended.

    Hope this helps. As I said this is relevant for New York so your state may differ. Good luck !
