Wife's N-400 was approved without an I-751. How is that possible?
-
Hello VJ. Finding this strange. After waiting for 52 months to have I751 interview/approval wife filed for naturalization on 7/26. Just got notice of the interview for N-400 on 8/22 which the interview date is in late September. However there still has been no response on the I751. The Case status site still has it as ready to be scheduled for interview and the Online site has the case listed but doesn't give any information as to where the case is in the process, not ready to be scheduled for an interview or anything. I don't know what all this means. I'm glad that after 52 months there will finally be some sort of movement yet I know you can't naturalize until conditions are removed. I've seen and heard of many 'combo interviews' on VJ yet don't know if that will be our situation as nothing as of yet within the systems shows they have touched the I751. Any info and advice is greatly and gladly welcomed

We have similar time lines, in june it will have been 48 months for us. Our local field office is also minneapolis and i have read somewhere they are literally one of, if not thee slowest office. It is so annoying!! I just emailed the wisconsin immigration congressman and once i sent them back a signed privacy thing, they are going to inquire about my husbands application.
Hate to see someone in the same boat but hopefully things will get moving soon.

Hi all. An update on our case status. We just received an email for an inquiry we didn't. Here is what it stated.
U.S. Department of Homeland SecurityUSCIS250 Marquette Avenue, Suite 710Minneapolis,MN 55401U.S. Citizenship and Immigration ServicesWednesday, February 28, 2023On 02/02/2023, you or the designated representative shown below, contacted us about your case. Some of the key information given to us at that time was the following:Caller indicated they are:-- Applicant or PetitionerAttorney Name:-- Information not availableCase type:-- I751Filing date:-- 03/21/2017Receipt #:-- MSCxxxxxxxxxxxxxReferral ID:OVPxxxxxxxxxxMSCBeneficiary (if you filed for someone else):-- Information not availableYour USCIS Account Number (A-number):-- xxxxxxxxxType of service requested:-- OtherThe status of this service request is:Thank you for contacting USCIS concerning the above-referenced application. Below is a summary of what we have found and how the issue has been resolved or additional actions required.Your application is currently being processed. Please know that the wait times you are experiencing for this application type are normal for our office at the moment. At this time, no further action is required from you. Unfortunately, we cannot provide any completion date at this time. We apologize for the delay. Please be advised that posted processing times are goals based on Field Office averages. These goals are subject to change and can vary from office to office. We apologize for any inconvenience caused by delays in processing. This is really annoying. First off we didn't file the 751 on 3/21/17. That was the day the 130 was approved. Point of Entry was May, 2017 and we filed 751 as required in April 19 so there is something not right with that. That would be close to 6 years for waiting to remove conditions. I swear these people are full of all kinds of that bullskit. One thing that is different is that this particular response is that it came from the local field office in Minneapolis and not from the office at the NBC. Don't know what that implies but I hope in means the file has finally been transfered to our local office. We shall see... -
Hi All. Thanks for all the support. I'm sorry to not respond as I had surgery and was in pain. As for why we haven't filed for citizenship is because my spouse still isn't fluent in English and couldn't pass the test. And suing would cost us financial resources that are better used elsewhere at this time in our lives/relationship. Thus we are in the peverveal rock and a hard place. The one thing that is giving us hope is that the case status on the USCIS site has updated to the OVC inquiry has been assigned to an officer as of today. This means the file/case is being 'touched'. We'll see what happens from here.

Just a quick update. We got a general inquiry message that starts with OVP and ends in MSC. We didn't call or make an inquiry since the last on on 1/24 and all our other inquiries began with SRC. I don't know what this inquiry entails yet I hope it means the case has been touched and we will know something soon. But the inquiry message still says it hasn't been assigned for processing. The waiting game continues...

Hi all. Here is the message USCIS sent us after 45 months of waiting, call after call and inquiry after inquiry....
On 01/24/2023, you or the designated representative shown below, contacted us about your case. Some of the key information given to us at that time was the following:Caller indicated they are:-- Applicant or PetitionerAttorney Name:-- Information not availableCase type:-- I751Filing date:-- 04/25/2019Receipt #:-- ×××××××××××××××Referral ID:×××××××××××××MSCBeneficiary (if you filed for someone else):-- Information not availableType of service requested:-- Outside Normal Processing TimesThe status of this service request is:Recently you contacted us regarding the status of your pending Form I-751, Removal of Lawful Permanent Resident Conditions. USCIS systems indicate that we are actively reviewing your application, and nothing is outstanding at this time.USCIS officials will determine whether an interview is necessary. If we schedule you for an interview, you will be required to appear in person at a USCIS office. We will send you a notice with the date, time, and location of the interview. If USCIS officials determine that the requirement for an interview may be waived, your application will be adjudicated by a USCIS Field Office in the order in which it was received. Additional information can be found on the USCIS web site at https://www.uscis.gov/green-card/green-card-processes-and-procedures/adjustment-of-status.How the hell is nothing outstanding. 45 months is way outside of processing time, especially for our field office which is Lincoln, NE. Why our case is stuck at MSC is beyond comprehension. -

Have you tried your elected representative, or the CIS Ombudsman?
Tried Representative. Said processing time was within range

Did you apply for N-400 to help pushing I-751?
Did you consider suing USCIS?
No N-400 yet as spouse isn't completely comfortable with English. As for suing...Don't want to put the resources into doing that. Just call after call and inquiry after inquiry.

48 months does nothing to help our situation. Spouses card initially expired May 5, 2019 and even with the 18, then 24, then 36, and now 48 month extensions her LPR will expire May 5, 2023 which is a little over 3 months from now. 100% pure garbage if nothing happens durring that time.

Some members here can be so harsh with their direct takes on other's predicament. OP, I'm not sure what your question ultimately is or the point of your post, but do your best to help her if she were to ask for your help but until then being respectful of each other's wishes and space in times like these is paramount. Sounds like you may be hurting. Its understandable so be a good friend to yourself. As far as her immigration path moving forward goes, well its now different path for her. She's on her own and thats just how it works.
Yes I understand. Yet this is nothing about how I'm feeling. This is a forum about the visa process. I just hope people understand that and don't jump to conclusions. Durring this whole process I was charged with doing everything as was requested of me. The situation seemed unique so I thought I'd try to get information. That is all.

Hello all. I posted last week about my situation that my wife wants divorce with her I 751still pending. As it would happen I signed the divorce paper and the next day I check her case status and it updated to ready for an interview as of 9/16.
I have no idea how she will proceed. Our application was filed as joint couple in a committed marriage. Yet she requested divorce and although I tried to reconcile, I just broke down and agreed. But I have no idea what she can do if all USCIS knows is that we are still married as of the time of the interview notice. If she tries for a divorce waiver now with her interview coming soon I don't know how that will work. And I'm not going to be vindictive or anything like that. I'm always there for her. I just don't know how she will proceed.

Many have faced this issue
if she has no interest in reconciliation , divorce and move on
Let her do her own ROC
pray she has a job and works 40 quarters or becomes a citizen so u are off the hook for the I 864
you are not under any obligations to aid in the ROC
Frankly if u did nothing to add her to any accounts and make her a real partner, i can not blame her for leaving
marriage is a joint commitment
Hello. Yes we have accounts together. We had a life together. She just chose to leave everything. Her divorce documents says she wants nothing from me. It's all her decision what is happening

Hello VJ community. I have a situation with my marriage. Been married to LPR wife since 2016. She arrived on 2 year visa in May 2017. We applied for I-751 in April 2019 and have been waiting since then. Our marriage was fine through the entire process. Long story short we had a disagreement in June that boiled over in July when she decided to leave me.
Since then I've tried to reach out to her to reconcile but she wants nothing to do with me. Yet she is still awaiting interview/approval for the I-751. I read up on the process of what you have to do when divorcing while waiting for approval on removing conditions and am well wrote on the divorce waiver process. But she has no proof of our relationship together. I have everything of documentation other than pictures. I've been trying to communicate with her that if she goes through with the divorce then she will have to send USCIS evidence that our marriage was and is bona-fide and in good faith. And that when she is interviewed she must show proof of these things as they will ask why she divorced me. And I've never hit her nor cheated on her. Nothing of these sorts. I have no financial problems or anything like that. Just 1 disagreement led to this. But she won't listen to me. She has a probono lawyer that she has entrusted her application with.
If there is anybody in the community that might have a similar situation can you tell me how it played out for you.

Hello All. My wife and I are April 2019 filers. Our case has been ready to schedule an interview since September 2, 2019 but has been stuck at the NBC since. We've called numerous times and still have not got any feedback on when our interview will be scheduled. Just called again this morning and after being placed on a brief hold we were told that USCIS is currently working on Feb. 2019 cases and that the best she could tell us is that we'd have to wait another 11-26 months. Not from the time we filed in April, 2019, which is already 24 months. An extra 11-26 months from this date, April, 5, 2021...I know that there is a lot going on in the world and I live by the saying 'It ain't all waiting on you'. But this is ridiculous. Recently contacted our congresswoman. Hopefully that will make a difference. To everyone else in the same boat, and I know there a many, hang in there. It will come to pass.

We called last week and our application is still at the NBC 15 months into the process. The USCIS site doesn't give accurate processing times. The CSR told us 13-27 months and couldn't tell when our app would be sent to the local office for the interview. This is out of control

We posted April 29th and had bios done by May 17th and haven't heard anything since. We expected a slowdown during the pandemic yet it has been 15 1/2 months so we need some kind of info. No request for RFE so we're fine there. Just want to know anything of where we are in the process.

My office is St. Paul, MN. I can't get a clear way to tell how long it will take looking online

Hi all. My wife and I filed I-751 in late April, had fingerprints done and received letter informing us that we are ready for an interview on July 1st. It's now mid October and I'm wondering if anyone knows how much longer the process will take or how long it has taken for them? Thanks to all
