  1. Hello!

I’m wondering if anyone has had a similar situation.

I (U.S. Citizen) am sponsoring my parents for their Adjustment of Status.  We applied in August 202, and their local field office is in Fort Myers, Florida.

Earlier this year, they received the RFE for the i944, we responded to it with screenshots indicating that it was no longer required per the USCIS website. This was sent and received Nebraska Service Center.

Recently, I received notification that both their I-130s had been approved, and we just got an RFIE for the i693, Medical Evaluation.  The return address is for the Memphis Field office in Tennessee.  I can only think of two possible scenarios:

    1. Even though their local field office is in Fort Myers, their case has been assigned to the Memphis office due to backlog in Fort Myers. (Memphis is pretty far though, so I’m sure a closer office could have been assigned)

    2. Because it is AOS for my parents, the i693 is being requested via mail because they may be eligible for an approval without an interview.

Have any of you had a similar situation?

  2. Hello everyone!

I'm hoping that someone has had any similar experiences that can provide some advise.

I submitted AOS for both my parents in July.  I prepared each of their cases individually, sealed each of them in a separate USPS envelope, and placed both envelopes in one USPS priority mail box.  I followed these instructions based on advise seen here and other adjustment of status-related websites.  These sites indicate that you can mail multiple applications in the same container as long as they're clearly separated (either by rubber bands, envelopes, etc).

The package was received by USCIS on July 16.  On August 5, my dad received a package from USCIS with his forms, along with a rejection notice (the payment through the credit card didn't go through).  It is clear that we have to resubmit my dad's paperwork.  However, I have received no update on my mom's documents.  To this day, there has been no bank withdrawal for my mom's package, and no rejection notice.  I spoke to USCIS and was informed that it was just a waiting game to see if my mom's package will be accepted or rejected.

I'm honestly a bit confused as to why one package was rejected so quickly and the other has seen no update. Is it normal for two packages to be sent in the same container to take different lengths of time to be accepted/rejected?

In your opinion, should I go ahead and send my father's package immediatelly while we wait for my mothers? I"m honestly just worried that maybe my mom's package was completely lost and we're waiting in vain.

    Hi...

I'm so sorry for what's going on with you right now. I was in the same situation with my sister package. I paid with Credit Card transactions G-1145 but after a while- about a month- the money wasn't cashed still and I was kind of confused because of the long period. I decided to call them and they said they are returning my package and money because of incorrect filing fees. I try to explain them that I'm sure the money is right ($1760) and they even confirmed that. But I told them after that I paid with my cousin's credit card. And it was the real issue. According to them, they ain't longer accept third party. So, is either the applicant or petitioner Credit Card Informations that they accept. I was like DAAAAMMMMNNNN I didn't know that. The guy told me only my sister or her husband has to do it. I should have paid with money order but I read somewhere that uscis don't longer accept Money Order. I misunderstood because the officer on the phone told me they still accept M.O. Open a bank account for your parents and put their informations if you still want to use the form G-1145 or else Money Order is the best.

    Good luck

Thanks for your reply! The payment card was in my name (petitioner), and I called the bank ahead of time to notify them of the charges. I actually made copies of everything I sent them and the payment amounts/card information is all correct.

im ready to reapply, but noticed that the documents they returned aren’t complete (they only returned the i485 and i944) but didn’t return any passport photos and i765, i864, etc.

so I’m debating whether I should wait a week or two to see if they will return anything else

  4. Hello everyone!

I submitted the AOS package(s) for both my parents on July 16th.  I utilized the credit card authorization forms (a separate authorization form is required for I-130 and I-485 per the instructions).

Yesterday, my dad called me because he just got a large package in the mail with a rejection letter from USCIS.  The letter clearly states that it is in reference to form I-485, and that the package has been rejected due to an improperly filled out credit card authorization form, or because the card was declined. I'm a bit confused because I verified the forms multiple times and even called my debit card company to let them know of the upcoming charges.  It's water under the bridge now I guess!

I do have a question for those of you who may have had this issue before.  I submtitted: I-130, I-485, I-864, I-944, and I-765 together.  My dad sent me a photo of the letter, which states that "you will be notified separately about any other case you may have filed".  I asked my dad to check to verify that all forms were returned, but all the prongs were taken out of my files, meaning they were all jumbled up and he wasn't able to tell me what was returned.  In your experience, are ALL files in the package returned? Or would this package only include the I-485?  I'm hoping they usually return everything, since it would make it easier to file again.  In addition, it would make no sense to NOT return I-765, as it would get rejected without an underlying petition.  In addition, no money has been taken from my account for the other form submitted (I-130). Have any of you had any familiar experiences?

My parents live about 8 hours away, so I won't be able to drive there for at least a week, but I'm just trying to figure out whether the package was FULLY returned, or if I need to wait a few weeks to see if any other portions of hte package are left to be returned.

  5. Hi there!  I met my husband while we were both doing an internship! At the time, we were working in Florida, and our families were pretty far away (Mexico and Pennsylvania).  We decided to get married in a very private ceremony (just us and two friends), with the intention of having a larger ceremony/reception within a few years when we could actually afford it.  As such, our families were not present.

I can 100% tell you that your situation will not be an issue at your interview! Our interview was fairly straightforward, and our officer simply asked how we met.  Besides, that, we just went over the biographical information on the applications.

Unfortunately, lack of family acceptance is a fairly common situation in gay relationships, and you won't be penalized for the opinions of others :) Best of luck to you!

  6. Hi everyone!

I'm working on filling out AOS paperwork for my parents.  My question is in regards to form I-765, Work Authorization.

Part 2 has a section titled "Information About Your Last Arrival In the United States.  The section asks for:

    - Passport Number of your most recently issued passport

    -Travel Document Number

    -Country of issuance

-Expiration Date for Passport or Travel Document

My parents had a B/2 Visa and did not use a passport when entering the country.  However, they applied for and received passports a few months later.

Should I not include the passport number in this section, since it is specifically in reference to their arrival into the united states?

Therefore, I should add the travel document number, and the expiration date for said document.

Is this correct? I think I'm overthinking this part a bit.

  7. Hey Everyone! I was just Approved! Below is my timeline:

    08/05/2019: APPLIED

    08/30/2019: ATTENDED BIOMETRICS

    03/03/2020: ATTENDED INTERVIEW

    03/19/2020: APPROVED

Note: I passed all tests during the interview.  Officer mentioned that he was missing my A-File and would have to look request/look over it prior to submitting an approval.  He mentioned the process would take between 2-4 weeks.  I received an approval a little more than two weeks after my interview.

  8. Hi everyone!

    I had my interview today.

it went as expected, swearing under oath, civics test, reading/writing and confirming yes/no answers.
The office ether gave me the approval letter. However, as he was submitting everything  on the computer, he noticed something.

He called a fellow officer into the room, who then confirmed that “the i485 is digitized, and the T-file is there, but where is the A-File?” Apparently, the A-file is Still at the NRC (I might have the initials wrong).

the officer then sent me back to the waiting room while he talked to his supervisor. He then come out and informed me that he couldn’t officially approve now, as he had to wait for the A-file to de delivered, take a look at it and then make a decision. He said it would take about 2 weeks to 30 days and that I should expect a letter for the oath ceremony.

Before I left, he asked “before you were petitioned by your husband, did you have any prior petitions?” To which I answered no, because I didn’t have any prior petitions.

Then I left. Does anybody have any similar experiences?

For reference: I wad a student visa recipient, eventually got married and applied for adjustment of status. Three years after initial AOS was approved,  I applied for naturalization.

  9. Hi everyone! I just had my naturalization interview.

The interview took about twenty minutes.

It consisted of taking the oath, followed by six questions. I then took the reading/writing test.

at the end, we went over all my yes/no answers at the end of the application.

my interviewer then handed me my approval letter.

However, while he was submitting everything, he told me that all files are now digitized and, after asking another interviewer, they established that one of my files “A-File” is still at NRC and that they would be unable to approve until they request that file.

    has this happened to anyone?

Hi, exact the same situation here, I am "patiently" waiting for the mail to be delivered and find out what's in it.....

    Best,

    Eli

Mine was also a biometrics notice, scheduled for 6/13/2019

i have to say, it’s very disheartening to receive a biometrics notice after getting that mass waiver in February. I just don’t see the point of sending that initially.

  13. Hi everyone!

My USPS informed delivery shows I’ll be getting correspondence from USCIS today.

My last status update shows up as “Fingerprint Review Complete” (From the Mass letter sent in a February regarding fingerprint waivers.

I won’t be home until late tonight so I’m trying to figure out what it could be.

The letter comes from the California Service Center.

what could this be? It’s my inderstanding that physical cards are not shipped from CSC.  My gut feeling says this is an RFE or Biometrics appointment. But could it possibly be an approval notice? Or are those sent from another address as wel?

We got a letter too :) At least it's moving forward 😉

I saw the same update on 2/28/2019. However, instead of saying “at our California Service Center location”, mine just says “at our location”. I wonder if this means might get transferred elsewhere.

I also just checked the mail and received my physical letter for the biometrics reuse. It arrived faster than I expected!

  15. Hello everyone! I saw that everyone’s been getting letters indicating that prior biometrics will be used. I haven’t received the letter, but checked the status of my application online, and it states that yesterday (2/28/2019), Fingerprint Review Was Completed. Does this mean that they will use my biometrics on file as well?

If a VAWA petitioner remarries while the I-360 is still pending, the I-360 will get denied.

If she remarried, her new husband can file I-130 for her if he is a US citizen or LPR but she will be looked at closely. She will start back at 0 in terms of her timeline. This will be a very lengthy process.

Thanks so much for your reply and feedback!

  17. Hello Everyone! I myself have gone through the AOS Process and am currently in the lengthy process of removing conditions.  My application was sent to CSC, so it'll definitely take a while.  My question today is actually in regards to a coworker.  She's rather confused since her lawyer gave her incorrect information, and is now looking for any advice on how to proceed.

She got married many years ago, and ended up divorcing and submitting an adjustment of status petition under the VAWA provision, since she had ended an abusive relationship.  Her status has been pending for quite some time.  A few months, ago, she had to leave her job for a total of three months because the lawyer whom was assisting her with the entire process failed to submit the renewal EAD documents on time.  When the documents arrived at USCIS, they rejected them because they were "lacking payment".  This resulted in her having to resubmit the EAD renewal application and being out of work for three months while waiting for the "Application Received" letter.  She received the letter and is still waiting for her EAD document to arrived.

My friend met a guy who works in our same building. They eventually began to date and live together.  He proposed to her, and after speaking to her lawyer, she was advised to not marry until her petition was adjudicated.  A few weeks later, when checking in with the lawyer's office regarding her EAD document, the topic of the engagement showed up, and she was advised by  another individual in the office that she could definitely get married without it affecting her VAWA petition.  Based on what I've read, that is incorrect information.  She has been married since September and isn't quite sure what to do.

Will her VAWA petition automatically get denied?  If so, is she able to apply for AOS through the I-130 and I-485?  In the event that she is able to go this route, what kind of additional information should she submit along with her application package?  My AOS was pretty straightforward, so I'm sure she'll need to submit other documents related to her petition?

Thanks in advance for your suggestions and advice, and I hope you all have a wonderful day!
