Hi everyone.
I recently arrived into the US on a K1 visa and married my fiancé. We are in the process of applying for adjustment of status.
I asked my lawyer about applying for my SSN and they made a discovery that K1 visa holders are one class of visa holders that are automatically entitled to work without EAD authorization or DHS authorization, according to the social security website itself. Please see following links: https://secure.ssa.gov/apps10/poms.nsf/lnx/0110211420#g
https://secure.ssa.gov/apps10/poms.nsf/lnx/0110211530
This means my social security card should not have “ valid for work only with DHS authorization” written on it.
Every time I’ve googled this, every other source seems to say that DHS and EAD authorization is required prior to work. Even visa journey itself links ( https://www.visajourney.com/content/ssn/ )to one of these above website and states this, even though the website itself states the opposite. Has anyone else encountered this?
My lawyer believes that I am entitled to work as soon as I get my SSN. And based off the information given on the SS website I would be inclined to agree!
No, K1 Visa can not work. The list provided by you is accurate, however, your lawyer misinterpreted it. Before working a K1 visa holder has to satisfy at least 3 requirements; get marry to the US citizen who petition within 90 days, apply for SS number (I did it for my wife before getting married) change his/her name if applicable with SS, file for adjustment (combo) including I-765, Application for Employment Authorization. Just check this before applying for any job.

Piggybacking, look it up. Have your US citizen add you on several credit cards once you get your SS number. Open a checking account with Capital One. Within six month, apply for a Capital One Platinum Credit Card. Thats how I did it with my wife. Her score is better than mine now. My personal experience.

Thanks everybody, very informative. I will pass the info to my friend.

This question is for a friend.
My friend and his spouse need to travel to outside of the USA before the interview for adjustment of status (K1). The non-citizen is from an ESTA country. If they missed the interview while outside USA without rescheduling, Can the non-citizen used her parole card to enter the USA after not showing up for the interview? Can the non-citizen use or rely on her ESTA to enter the country? Thanks for your response.

Why does uscis approves but embassy denies.? Does this even makes sense ?
USCIS mainly approves the USA citizen (verify that the person is indeed an USA citizen) and the relationship. The embassy checks the relationship, medical exam and criminal record among other things.

Witnesses are not people attending the civil ceremony, rather, are two individuals that can attest/testify that you got married. When they say "two witnesses" they are talking about the legal requirement for that locality.

I have proof i took screenshot of her talking to guys online and I have proof that she have pictures taken with other guys hugging and kissing. Would that be enough proof of fraud?
No. That's proof of infidelity. Some examples of proof of fraud; sms, emails, chats "once I get that GC...I'm bouncing", "I just have to be with him until I get thee green card"

I think you can't or would have a hard time using ESTA, again.

Hi guys,
I would like your advice about the next step after the k1 visa is approved. Should I wait two weeks until applying for a SSN, before getting marriage licenses? And is it fine to spend the honey moon in another state and do I only need my passport for traveling inside the usa?
Get SS Number BEFORE getting marry, getting it after getting married is harder and difficult. To travel within the USA you need an ID, in your case your passport. If you travel to Puerto Rico, there are randoms check at the airport when traveling to the mainland asking about your citizenship and legal status in the USA.

Can he get a CENOMAR. A Certificate of No Marriage Record (CENOMAR) is simply what its name implies. It is a certification issued by the PSA stating that a person has not contracted any marriage. Also called a certificate of No Record of Marriage or Certificate of Singleness.

One of the requirements for naturalization is good moral character (GMC). An applicant for naturalization must show that he or she has been, and continues to be, a person of good moral character. In general, the applicant must show GMC during the five-year period immediately preceding his or her application for naturalization and up to the time of the Oath of Allegiance. Conduct prior to the five-year period may also impact whether the applicant meets the requirement. [1]

Don"t flight on connecting flight, sometimes border patrol agents stand at the door of planes landing domestically. Direct flight is better.

Thanks. I looked up on DCF and it looks very promising. Are you sure anyone who meets the residency requirements can file it and it is not only for exceptional circumstances/emergencies?
Do direct consular.

Social Security Administration does authorized anybody to work. For employment you need to complete form I 9/ E-Verify. They will let the employer know that you aint authorized to work

Contrary to other people,s advise, PLAN your wedding. However don't pay for any venue nor book any honeymoon. Compile a list of guests, pick 3 venues and talk to them, on a last minute booking you can save a lot of money. That's my personal experience.

HERE ARE THE TOP REASONS WHY CITIZENSHIP MAY BE DENIED
- Selective Service. Males between ages 18 and 26 are required to register for Selective Service. ...
- Fraud before green card. Very often, Immigration takes a look back at a naturalization applicant's whole history. ...
- Crimes. ...
- Lying. ...
- Taxes. ...
- Child support. ...
- English.
- Unwilling to take full oath without providing a strong religious reason with letters of support
- Not reporting adverse information immediately prior to your oath ceremony (between your approval and ceremony)
- Traveling to certain countries prior to the ceremony
- Other factors, finding conflicting information, (my cousin has legally 3 kids, kid #3 was determined not to be biological his, he told the agent that he has 2 kids, DENIED)
- Agent waking up on the wrong side of his bed
PICK ONE AND PEOPLE WILL GUIDE YOU IN TE RIGHT DIRECTION. I know a guy that went for the interview in Boston and the agent told him if I were you I will just walk out and don't go inside for the interview... the guy just walked out.

im residing legally as a tourist
You are NOT a resident in Canada, therefore you can not apply/be interview in Canada. The US citizen can certainly start the paperwork listing your home address in Israel.

Hi all,
I got a question if I can relocate and live in the US under my b1/b2 visa rules up to 180 days and then fly back to my home country for an interview?
I understand that theoretically I can do so but in this case, it will be better to interview somewhere in the US or at least Canada. Is it possible? Because it's around 1k USD to fly back home and then return to the US.
Also same question about medical the US or Canada?
Also can I clarify a list of vaccines required for K-1 medical exam!? Maybe somebody already know...
Country of application: Ukraine
Application date: 20OCT17
NOA1 date: 24OCT17In Russian language: "live" can also mean "to stay at a hotel, to stay for one night at your friend's house" If you can get a police report from Canada and show a resident card, then you can apply in Canada
-
Interviews are ONLY done at your country HA Ukraine or a country on which you legally reside "as a resident" not "living" in the Russian sense.

Did you divorce him because he was gay? You have to gather evidence that YOU did not enter into marriage with the intention of getting immigration benefits. Did the marriage ended because he was gay. Gather evidence that shows your marriage was bonafide.
Removal of Condition
in Removing Conditions on Residency General Discussion
Posted
My application to remove condition on my wife green card was rejected because I sent the wrong fee(missing biometric). I just received the packet back. Do I have to print everything out again and send the correct fee, or Can I send the same packet again with the $680?
