Yeah this dude played the system in so many ways. I honestly wish these kind of people would be deported and banned for a lifetime or two.

You sneaked through the border, stayed illegally, don't have proper documentation, have a crimanal history, filed for VAWA (falsely or not, who knows), AND you want a green card? Haha.

Goce - nobody wants to be negative here, it's more about making sure you are on a safe side of your journey. Also, as this is a very active public forum, you should expect diverse opinions and levels of expertise when it comes to immigration issues. I am sorry that the answers to your questions did not sound very good. However, in your situation, you cannot count solely on what's being said here. Your current immigration situation is definitely serious and quite atypical, no doubt about it; as it looks like you have been placed in removal proceedings, the validity of any documents you may have that allow you to travel ouside US is questionable. Therefore, you must check if the validity of an I-551 stamp for example still stands up for you. Talk to your lawyer again, schedule an infopass, talk to an admission officer at the airport, call USCIS...you do have multiple options to find out exactly where you stand in regards to travelling outside US.
Mike B., instead of wasting your time responding to "deadly wrong" messages, you should bring your own individual input related to this topic. The OP answered a question, so please direct your replies to him, not to me. You can't help it?You may press the "ignore" button. It's that simple.

Juliava I am not saying you encouraged him to travel. I just said your information was wrong ,because he cannot travel with an extension letter anymore, even if the extension letter is still valid.

You may be asking in the wrong forum -- this is for removing conditions on permanent residency after 2 years. Sounds as though you entered on a CR-1/IR-1 visa?
Regardless, you can always call USCIS and ask what's going on. You should have received an I-551 stamp in your passport, which serves as a temporary Green Card in the interim.

Either you can deliver your baby in Turkey with your fiance there, or you will need to come to the US and deliver without him. Unless there is some very high risk element to your pregnancy (I do not think this is the case since you indicate you are flying to the US for the birth) then you may be able to expedite. In the majority, pregnancy is NOT a reason to expedite.

First off let me say sorry to those who I am about to offend in what I'm going to say here. Your first mistake Scott was marrying someone from the Philippines who clearly doesn't care about helping out the husband in working for their future. Your wife is only with you to help "HER FAMILY OUT" and not to help her new family "YOU AND HER". Sure she'll do everything to make it look like she really their to be with you (cook, clean, bend over back wards to do little things you like), but in the end she is only with you to help her family. I am sure if you end up broke she would leave your #### and find someone else that could continue to support only "HER FAMILY". I can see sending 1 or maybe be 2 (would have to be damn important) pay checks a month. But her entire salary for two years is outrageous and stupid on both yours and hers part.

When you think about it.... a lot of people send money to their parents, brothers, etc, etc... BUT how many couples send exactly (or almost) their particular salary every month back home? That would be a HUGE red flag for me... even if the husband made $10,000 a month and that more than paid for the bills. If I make $8,000 a month and my wife makes $2,000 it is pretty stupid to send 2k back home every month since it just screams of having a bf or husband back in the home country. Everyone that isn't in the typical situation has to think, "How is this going to look to a stranger?" Because anything unusual can be interpreted as something that it isn't... such as fraud.

I guess you can make a difference between not having any income to support the household and having income and chose not to support the household. I still don't think this was THE reason for the denial.
Either the OP hasn't submitted enough other evidence of his bonafide marriage or there were other red flags during a possible interview, IF there was an interview.
Like other said, OP, can you give a list of all the documents you submitted and what exactly does the denial letter say?
Lawyer up before you start the appeal but start gathering EVERY bit of evidence you can find to submit with the appeal. Also, start talking to people (family, friends) and ask them to write affidavits.
That's a messed up situation you are in, I hope your wife can calm down soon so you guys can plan and go the next steps. The journey isn't over yet!!

You would HOPE they would send an RFE before a denial but I guess if there is nothing in there that they feel remotely shows a bonafide relationship and they feel that the marriage is fraudulent they probably aren't required to.
The OP needs to give more information in regards to what he sent and what the denial letter said. Until then no one can really give any sound advice apart from seeking legal representation and appealing the decision.
Hate to be devil's advocate and do not by any means mean to be rude... But has the OP seen ANY red flags throughout the entire relationship that may point in the direction of the marriage being fraudulent?

I appreciate the fact you gave me the last word but I was not here to debate with you either. I was here actually to make you aware of your none helping statement about language in an immigration situation. Again your "frank feedback" could have helped if you gave suggestions to the OP regarding his situation. You have to take the stress the OP is in, you have to recognize as well that he came from a country where English is a third language: So that could affect his English in that particular situation but I'm confident that he wouldn't make same mistakes in a more relaxed environment.
Please leave unnecessary remarks out of the problem, comment if you have something to add that will benefit him in his particular situation.
    Good day.

His english is perfectly fine, he expressed his feelings, he delivered his point and clearly asked for help. If you don't understand what he wrote you might need to learn more vocabulary that he used. I think he needs a lawyer to help him on his case rather than helping him deliver a point to immigration.

it doesn't matter how many kids I'll have. USCIS will still think we are fake. just like they informed us that my wife and I posed in our pictures for Immigration purposes. I will make sure I have enough kids to start a soccer team at least if I don't get my Citizenship I'll take them and participate in the world cup, I have better odds wining the world cup then getting my Citizenship. hehe!!jk

garo82 reacted to Brother Hesekiel in When options if N400 based on marriage is denied?
The applicant does not have to prove (anymore) that the marriage is bona fide. Thus very little documents are actually requested. All that he has to prove is that they are still married and cohabiting. If they do, there's no reason a N-400 application would be denied on that base.
