    you should be able to just go in there and explain it to them. it is their fault and I hope you don't have to file a motion to reopen. how did interview go and how long did it take from applying to getting scheduled? did the immigration officer originally at the interview even acknowledged that you were under F2B?

    nope, illegals aren't required to server in the military and furthermore are NOT even authorized to do so. there are exceptions when the army was recruiting some, but in general it is not the case.

    Sent I485 on April 22nd, 2016.
    Interview scheduled for May 15, 2016.
    IO said everything is good except resubmit expired i693 which I did in next two weeks.
    They received new i693 and went in review.
    After 3 weeks of interview, they denied saying that when I submitted my i485, my priority date was not current.

    Now, this decision is based on "Final Action chart". USCIS determines every month which chart to use on their website to file i485.
    For the month of April - 2016, USCIS posted "Date of filing" chart which allows me to submit i485 for the same month. My PD became current in May - 2016.

    So where am I wrong?

    you are NOT wrong, instead, the USCIS officer made a mistake. We're doing the same in F2A - so I've ready a few posts. Now, what you can do is get an INFOPASS and request to talk to a supervisor or a branch manager. BTW, what Field Office was it at?

    And yes, for me it shows the most recent entry, it doesn't matter if I used the AP or not, I was still entering upon my foreign passport.

    oh OK, green card entries are not shown there then. OK, I thought AP entries aren't shown either. What does a 1 year expiration for AP entry mean - strange definition

    Hey guys! Driving back from our interview (October filer). Everything went pretty well. The interview was scheduled for 1:15, we came 30 minutes prior and still had to wait till at least 2 p.m. That was the most annoying part - we've seen people coming after us and being called before us. 

    Nothing special about the interview itself - the IO was pretty strict to the forms, he didn't even ask anything personal (except how we met, but that's an obvious question), also not really in a mood to joke. Just polite and professional, and strictly following the protocol. 

    I was re-entering the USA in March (with an AP), and he asked if I have a new I-94. I didn't have it, so he just wrote down the information from the stamp in my passport. So it might be my tip for those who were traveling, print out the new I-94, not sure how critical it is. 

    After asking biographical questions from the form he asked yes/no 485 questions, then asked if we have something else for him. We handed the tax return for the new period+ insurances for car/health+ my DEERS (husband is military), that's all he needed. He barely looked at the photos (maybe took him 5 seconds lol), then said we're good, and he keeps our case for a review, explained it's a standard procedure. So I went to USCIS website page, and it says "Interview Was Completed And My Case Must Be Reviewed". 

    Keep on waiting I guess. 

    P.S. I found it funny, he didn't ask my husband's ID. No one in the building did. Oh well. 

    I do not think there is a way to get a new I-94 based on the entry using Advance Parole - did you try to get your new I-94?

I recently got word that my EAD/AP Card is in the mail after requesting an expedite so now just waiting for AOS. My husband is a USC and he and I got married in January. Biggest concern now is the scrutiny of our relationship. I sent in soooo much evidence but the kicker is: my husband and I met in October and we were in a Las Vegas chapel by January haha. Happy to be here! :D

    ah speaking of 2 year anniversary, mine is coming up march 2018. let's say i get the conditional residency in august 2017. will i have to wait 2 years from august (so 2019) to apply and remove condition or can i do that within 90 days from second anniversary (december 2017)? 

     

    now that i think about it, it would be kinda dumb to just get the green card in the next couple of months, and then soon after, i gotta pay that ridiculous amount of money all over again to apply and remove condition.

    you got it, it will be for 2 years. what annoys me is that there is a 1 year processing on top of that and you have to pay $700 or something like that which I don't mind but it is taking way too much and I will drink all the beer I have waiting for this game to finish.

    i contacted congressman jamie raskin's office a while back and had one of the assistants there ask their congressional liaison for update on my case. that was like a month ago and i hadn't heard back from them lately. not sure if this is the reason i got my interview notice before you but maybe you can look into contacting them too! it's like super easy. theres only one form you fill out on their website and then send them an email. 

    ideally I would love to get mine from 10/5 to 12/20 - October 5th is the 2 year anniversary and leads to a 10-year green card, and 12/20 is the medicals expiration :)

    My filing date is December 9th last year so it's been almost 7 months... Baltimore isn't even like a big place so I'm just surprised the local office processes everything so slowly haha my friend in LA had her green card application approved within only 4 months!

    Traffic won't be an excuse because you are asking for a benefit, not the other way around, unfortunately. If you have loaded them with the documents and other proof of the bona fide marriage, they will be happy to waive it so the line shortens by at least 1 person. We're awaiting anything from Baltimore, it's been since October and apparently Baltimore is about 6 months longer than Memphis, TN. It should take you roughly 7 months to be done with them.

I felt good when we left but of course still a little nervous. But by the time we got to the car, I checked the USCIS website just for fun and it already said that a new card was being produced! I'm so glad to have one more step behind us!

    Nice, thank you for a feedback. Were there a lot of people at the office? So looks like it took you roughly 10-15 min?

    if you are a US citizen, a passport is recommended but not required. Depending on your wife's citizenship, her passport and a visa, if one is required. On the way back, it will be your US passport and her advance parole along with her passport. She, you may not be permitted, however, they let me help my wife, will be taken inside for fingerprints, a separate interesting and beautiful PAROLED stamp and standard questions as to where did you go, etc.

     

    Nothing hard or extra ordinary, but it will be an interesting experience. A wait could be about 1 hour as well.

    October here - no news, regretting moving from VA to MD :) Sponsor's status does not matter at all so that would not affect the process

    They received our application October 6th, and cashed the check about a week after that. We then received an RFE which was then responded to by November 29th. No updates until June 2 stating the case has been approved and yesterday they updated stating they mailed out the card. We did receive EAD in February as well.

     

    We submitted a service request about a week ago, I'm not sure if it's a coincidence or not that we were approved shortly after. Good luck to those who are still waiting!

    yes, but it does not say that once 90 days are up you won't be allowed. SHORT TRIP - keyword here, a 30-day trip is not a short trip. I would cross via air where everything is properly recorded (all I-94s etc).

    not true, what you are saying is that if someone travels to the USA for 60 days, then goes to MX or Canada for 35 days then one cannot come back here - seriously?

    yes it does especially for more than 7 days. I've done it personally multiple times back in a day on B-1\B-2. Just need to mention that you want to get another stamp, that is it.

    my impression is that AOS with a green card holder as sponsor always takes much longer because there's a wait list or something for that but i might be wrong.

    There is bo difference in the process except to one thing: if your PD isn't yet current and you got an interview, you can't be approved on the spot. Rest is the same

    thank you for the updates - do you reside in MD? so far it looks like it takes them 10 months to process AOS in Baltimore.
