well, hopefully USCIS will accept AOS dates this month!!!
does anyone have an idea of what I should do if I never received a letter from NVC? I mentioned on I-130 that it will be processed out of country?
-
Not sure how their system works, I guess they received lots of application in those months and so went back to using final action dates. Lets see what they use for July.
otherwise it is just a very bad strategy - they are getting fed up with all these applications in the first 6-8 months and they literally just stop them! Since VB for AOS has not moved and USCIS (99% sure) barely got any AOS applications in the F2A category or even from FB applicants so I am assuming they would accept the AOS dates otherwise my logic is broken and I am an idiot

Correct my reasoning please, but those applications should have no effect to us because they won't be approved before the dates become current... So I am really hoping for the best in this case!!! My wife's I-94 expires on SEP 4, so July and August VB will be our save - if not, she will have to go back and then come back again...

Unfortunately USCIS isn't required to follow the filing dates. You have to look at what table uscis is using to see if you can apply for AOS.
I know - and it it unfortunate.
Any predictions you would have on this? USCIS has been accepting those dates up until May and June, now I have hope for July...
-
Well I guess this uscis visa bulletin is all messed up. Not sure what they are doing. I see stories where people are getting denied even when they followed the correct guidelines and filed according to the priority date but still got denied. Uscis stated their PD was not correct when in fact it was for filing.
I guess it's our chance now. Looks like VB won't be moving much in this year based on what CO said. But I hope that USCIS will allow us to apply for AOS. Now, USCIS won't approve it before the dates are current but they should allow to apply for AOS because it doesn't affect the queue.
-
Go to the local uscis office with the approval documents and also with the medical paperwork - they'll print a new AP document on the spot, no fee is necessary but photos will be required. When showed up there, explain to them that USCIS advised you to come with without an appointment. Good luck!

Yuna628: it kind of sucks... I honestly don't like London and I don't want to go back to Switzerland and there is no other place I want to live. So being stuck here, work my ### off for the plane ticket to be with her 2twice a year when normal couple can just be together whenever they want. I wish I was in this situation...
Harpa Timsah: For a O visa I need to have extra ability in photography and won some international prices, honours or awards which isn't my case again
may sound funny, but I watched a CBP show where Norah from Switzerland was denied entry to the USA to dance in night clubs and had to apply for a tourist visa
)
The only option is either a marriage or an EB visa. I've seen photographers approved for NIW under EB2.

Yea, I saw those. It's the fact that some of them are not trained well, otherwise the form would not be accepted! I think it'll be easy to fix and I hope that we'll be able to submit our I-485s in July, August latest!
Do you have any ideas/predictions?

I'm wondering now if they just divide the wuota each month and see what's going on with the numbers. It's just annoying that they accepted it before, they have been doing it for 7 months and now they just don't accept the dates! DOS made new VB dates but they still honor only the old dates! USCIS!!!
-
well, I hope that they may change it or reverse that is why there is still no link on the page to the June dates yet. I guess we will find out - they better allow AOS dates in July then - otherwise it is not totally wrong and annoying! Any suggestions?
-
I'm totally on your side! I've done all immigration myself including my own NIW petition. You filed everything properly based on the dates, it's just some untrained personnel that doesn't care about others.
I would contact a local congressman and have him/her submit an inquiry.
Things to remember: you indeed cannot be approved for a green card until your date is current in the first (original) table. Interview can be conducted at any poibt while you are pending, they can recommend you for an approval but won't approve, that's simple.
Also, send a certified letter to the office which made a decision on your case with the proof of priority date for the month when you applied.
I can give you my email if I can be of any further help.

My spouse's PD is OCT 13, 2015 she is in the US on a valid B1/B2. New VB for June shows PD as 15 OCT 15 - so we are in. Trying to figure out when USCIS usually publishes their chart? Can someone suggest whether USCIS will accept Filing Dates for month or any other suggestions?
Thanks a lot!
-
that is not correct - the card will be valid if you state in the withdrawal letter that you finally got it delivered. So I wouldn't even worry about it then!
-
Agree. And not only america unfortunately we are hit pretty hard here too.
there is a solution - Donald Trump - you guys need one over there!!!
-
Haha sounds like my man.... "one scandinavian(woman) is more then enough for any man" he says when we joke ...
) absolutely agree! I spent quite some time in Scandinavia (Suomi) and my wife is from Siberia - never understood those fashions to have more than just 1 wife - so stupid to me!
LOL .... poor Lady
what freaks me out is that they try to push these "fashionable" things into the US culture... Imagine going there and telling them that is it not correct - they would kill all of us
))

if you have overstayed your status in the US even by 1 min, you are therefore ineligible for any further non-immigrant benefits (AOS, change of status, etc). You can try to explain it to USCIS, but since IRS and USCIS are not the same agency, I doubt they will take it as an acceptable reason. There is a reason: by USCIS mistake, but it just doesn't look like it would fall under your category. But you never know...
-
so stupid - if you live in the US you should know that there is only ONE spouse that is allowed. If everyone tries to bring multiple wives (husbands etc) then the society in the US will break down. It's a different culture over there with multiple wives that I personally never supported and understood - just stay there, why the US?
-
So your intention was to commit visa fraud?
And what? You never broke a rule or any laws? At least they are trying to stay here legally unlike many others!
-
it's totally up to the Consulate/Embassy that issued the visa. Everything is on the system and there is absolutely nothing to be worried and/or concerned about! Good luck!
-
That's correct

Hi,
Does someone have a suggestion why the AOS part of the visa bulletin has not moved for four months? Neither category..
Any suggestions on the next one to move/jump 4 months?
Thanks guys!
-
I did NIW - no interview is required and your spouse/kids will get green cards automatically.
-
Should be enough, I wouldn't worry at all. Good luck!
