    Hello,

    It took over one year before receiving our Notice of Intent to Revoke. I believe it would have taken longer if I did not reach out to my US senator office. The notice will tell you what it is they are looking for.  The burden of proof is on the Petitioner. I submitted my reply but still received revocation. I  have just filed an appeal and so we wait. Just  make sure you provide the evidence.

    I will try and get photocopies of the petitioners(My US wifes) most recent termination documents not sure she will have past marriage certificates but I think if she does then photocopies will do.

    I would assume that if it was submitted for the I-130 a photocopy would be needed for my interview.

    It just seems odd to ask for her marriage certificates from a previous marriage.

     

      

    When I filed for my husband I had to obtained certified divorce decree. My husband only had the hospital death record for his late wife. That is the problem we are facing now.  I'm just saying to possibly save you time and aggravation it's best to request the necessary court documents and have them on hand. We were denied because of this and now having to file an appeal.

    It doesn't go any faster with an attorney. I personally wouldn't unless he runs into problems dealing with getting one issued.
     

    It was revoked based on this issue regarding the death certificate. This was the only reason. I have to file an appeal providing thexcellent death certificate.

    Did he file one after his spouse died, does he have a copy ? They want an original plus a copy.
    If he didn't already have one on file then this will be an uphill ordeal to get one. Anyone can get a fake one there and I guess the embassy 
    said the one he previously turned in is not authentic so my question is didn't they say he could be hit with misrepresentation for that ?
    Misrepresentation can carry a life long ban. Fake papers will get him denied and not usually given another chance.
    Why is it not authentic, where was it obtained ? 
     

    He left Sierra Leone after late wife's death and only was given a hospital copy never received from the courts. He has been living in Senegal and that is all he submitted initially when we first were approved.  Uscis, the embassy or NVC asked for this document before and we were approved.  We were denied the first time due to not enough evidence for bona fide marriage. We have overcome that so now this comes up about the death certificate.  What I need to know is if we must consult an attorney or should my husband travel to Sierra Leone for this document?

    Usually the NOIR will have very specific bullet points listing reasons of their doubt.
    What specific points were mentioned in the NOIR and what items did you send to address the specific points mentioned 
    in the NOIR?
    You can't submit general things like chats if specific things were listed but you have to overcome each specific point mentioned.
    Please upload the NOIR request without any personal information for further advice.
    Was your NOIR response submitted by the deadline of 30 days ?

    Yes I returned my evidence within a week. There is a lot of personal information listed on the NOIR so I prefer not to disclose.  I'm waiting for the hard copy of my revocation letter to arrive by mail. I  will reach back out if assistance is needed. Thanks for your help.

     

     

     

     

     

  6. Key points were there is doubt to the validity of marital relationship. I sent copies of passport stamps, itinerary, boarding passes, atm withdrawals in Senegal for second trip there in November, 2016. Sent multiple copies of western union receipts for 2017. Also sent 2016 tax return, transcript and w-2. Photos of us at different times. Also sent copies of Spouse Acknowledgement form along with copy of retirement (drop) paperwork showing my spouse as beneficiary. This was my second trip and I  stayed three weeks before having to return. I also want to add that due to the processing delays I reached out to my Senator's office for assistance.

    My husband and I are currently awaiting for the NOIR to arrive. According to the CEAC website our case was returned to the NVC on Nov. 1st after spending months in AP at the Islamabad Embassy.  My husband and I hurt and he's is frustrated at the entire process and is ready to just throw in the towel.  Honestly, I'm not surprised this happened (being Pakistan and all) but that doesn't make it hurt less. Being part of VJ helped me mentally prepare that this could happen.  

     

    How long does it typically take for the NOIR to arrive?  (seems like the timings are varied :S) 

    Anyone who experienced receiving a NOIR (I know the USCIS gives the petitioner about 30 days to respond) is it a letter? A packet?  

    I keep hearing that at this point, it's best to consult an immigration lawyer.

     

    Any advice is much appreciated.  

    Hello: It took 13 months and my Senator's office involvement before I received my Noir and I received a letter. Just as someone mentioned when you get the letter it will outline in detail the reason for denial. Just provide the appropriate documentation within the time frame given.
