I received the notice from nvc that our reaffirmed petition was forwarded to Senegal. Hopefully soon we'll receive word.

The story: in October 2016, he did a K1 for his fiance in the Philippines. He later withdrew that petition. Last November, 2017, he did another K1 for his new fiance but forgot to disclose about his previous petition in 2016. And today, he received an rfe with "notice of intent to revoke" NOIR.
I searched and read this:
A Notice of Intent to Revoke (NOIR) is a communication sent by the United States Citizenship and Immigration Services to a petitioner about a previously approved petition, telling him or her that the USCIS intends to revoke the petition, along with the reasons for revocation, and giving the petitioner a fixed amount of time to respond.[1] NOIRs may be issued for immigrant visa petitions (such as Form I-130 and Form I-140)[1] and for non-immigrant visa petitions (such as Form I-129 and Form I-129F).[2]
Response protocolEdit
The NOIR is sent to, and the response must be sent by, the petitioner (or an attorney representing the petitioner, if the petitioner is using an attorney) rather than the beneficiary. A copy may be sent to the beneficiary for information.
If the petitioner responds within the specified time, then the petitioner's response is considered when making a final decision on whether to revoke the petition. Otherwise, the petition is revoked once the specified time is over. An extension may be granted at the discretion of USCIS if the petitioner needs additional time to obtain documentation from abroad or for other meritorious reasons; however, the petitioner must respond in a timely manner to the NOIR by the stated deadline, and provide a reason for requesting the extra time.[1]I've only heard of NOID, Notice of intent to deny only. Are these two the same? What are his options? Has anyone ever heard of this before?

No they are not the same. NOIR is sent to the petitioner providing an explanation of why the petition is being revoked and it gives the petitioner either 15 to 30 days (calendar days including weekends/holidays) from the date of the notice to respond. If you do not overcome the issues then the petition is revoked. I'm not sure if you can appeal k1. I was able to appeal my I130.

I called NVC today and found that my case was forwarded to the embassy yesterday.

Greetings:
After the first interview my husband received 221g from embassy stating that our case was being returned to USCIS. Fortunately I was able to return to Dakar and spent one month there. When I returned home I waited for six months for case to return back. It actually took over a year and getting my Senator's office involved before a response from Uscis- NOIR. We responded but unfortunately was denied. I then filed an appeal providing detailed documentation and won the appeal (Hallelujah). Uscis returned case to NVC, now just waiting to hear from embassy. Dakar is one of the hardest embassies. Just provide as much detailed information showing bona fide relationship and it helps of you can visit often.

On March 12, 2018 was when case was sent to Department of States. We called NVC later in April 2018 and they said our case is now at the consulate. When (weeks?) should we expect to be called to the embassy. Any idea folks.
My second time around. I'm waiting also. My first time it took about two weeks for interview to be set once our case was at the embassy. Don't know how long this time.

They will call you and tell you what you need to do next. My case they told to submit more evidence. They will give you the appointment by phone. Most likely your visa application will be approved because it came with a recommendation from uscis to approved.

I received an email that case was reopened and approved. Then one week later email received that case was forwarded to Dept. Of State. I called NVC and was told that case was received on May 3rd. As of this date no other notices have been received.

@JackandRed the consulate overseas should of emailed you the website and from there you can create the login for new person and pick your interview date. In the same letter they should give you the time to pick and all you have to do is go and pick an available date you want. Our next available date was four months out, you the quicker you do it the better. I’ve attached what they sent me
Thanks for your response. I have the one P4 interview letter for 6/16/16. I did not receive the attachment you mentioned.

for my case they didn’t ask for a second interview but asked to submit more evidence. Now waiting for a decision (AP).
My case was received by NVC (the second time) on May 3rd. It has been two weeks now. I Hope to hear back by the end of May.

Uscis send it back to NVC then after NVC finish doing what they need to do on their part, they send it back to the US consulate overseas. Once consulate receive the emailed me and sent package 4 and all the things my husband needed to bring to the interview. He has to do a new medical and police clearance, also your spouse or you would have to login and pick a new interview date. Once it reaches the consulate for the second time around they will contact the beneficiary to let your spouse know it’s been reaffirmed and will provide the necessary steps on things to do next. Hi all:
Our case was reaffirmed and sent back to NVC for a second time. The case was logged in on May 3rd. Since all docs and fees been paid how long do you think it would take for interview?

Yes that is correct. I provided my final divorce decree and certified translation of my current marriage certificate in Senegal. I have had no problems here in U.S.

A couple can marry outside the US and it is recognized.

That's correct. My husband and I married in Dakar Senegal and it is recognized here in the USA.

Congratulations! Yes, I think that would be a great idea to include the 2017 tax transcript. Your spouse should also send w-2 forms for both years.

Second Interview

Not yet. However I called NVC and they said that once the case reaches the embassy the second time they do not schedule these interviews. I was able to email the embassy and received a generic response that they have a reduction in their workforce and they will notify the beneficiary asap. I'm hoping soon because my file left NVC on May 16th.
