  1. A spouse cannot be a dependent on a tax return.

    If you marry December 30th or Dec 31st then you can file Married Jointly or Singly. You will have to file a paper return. If your spouse files a return write "NRA" in the spaces that ask for an SSN. You would only be able to claim your spouse as a dependent if the had zero foreign income. Truly zero. No interest or anything. A standard qualification for a dependent is more than 50% support for the entire year. You do not qualify on those grounds alone.

    Short answer... Forget the dependent question. Get married in 2016 and file as normal couple married jointly or singly or don't get married in 2016 and file single.

  2. Someone correct me if I am wrong.

    1) Get your marriage annulled.

    2) Wait until the previous marriage divorce is final and the 30 waiting period is over.

    3) Get married again

    4) Refile application.

    Person Note: Sorry to be judgmental on this but not waiting 20 days when it was known there was a 30 day wait period was a bad decision. Please make sure to follow "all" the rules in the future and stop trying to short cut the system.

    I do my best to add to people's waistlines. Next up is learning a couple of more Japanese Recipes. 1) Japanese Beef Curry and 2) Soy Milk Vegetarian Ramen Soup.

    Others: The Biometric Letter came within a couple of weeks of the NOA1. Have patience. You're going to need it. EAD cards are 3 months and I doubt anyone is going to get an expedite approved. We all are having financial hardships with this process. Everyone should have realized this when they started this journey. Green Cards.... anyone's guess to how long and no use sweating over it. No one is out of status while the applications are active. Just concentrate on enjoying your lives together and gathering relationship evidence. My wife has been here two months and I think we have enough evidence already so that there would be no doubts. The two important items are EAD and Advanced Parole so that our significant others are stuck home with too much time on theirs hands worrying about things that are out of their control.

  4. Sorry to hear this. This is something where couple compromise is needed. However, I am surprised that this was not brought up before you are married. Was his expectation always this way? did you get the dogs while you were a fiance or since the marriage? I made sure my wife was OK with the inside 3 cats, dog and guinea pig before we got married. The dog passed away before she immigrated. I am going to guess he does not want the hair, smell, letting in and out for bathrrom and possible messes. Maybe he did not grow up with dogs. Unfortunately, I don't see a good answer for this. Even if you found someone to adopt your dogs in the U.S., they are not going to want you dropping by often to see them. It's unreasonable. Good Luck. I don't envy you.

  5. In general, pre-existing conditions are not excludable but, each state has additional rules and regulations for insurance carriers. I'd like to see an insurance carrier exclude a pre-existing "pregnancy" from coverage. Under Obama-care health insurance is required or you pay a tax penalty. I think the OP and BF need to do a little more research before starting to say things like "it's going to cost $30K."

  6. She should have copies of all her documents and should not have handed any originals at any point. Have her request new ones you need for her aos submission.

    I agree. Why did she give originals? The instructions clearly say copies unless originals are asked for. She will not be getting anything back from the yellow packet. She needs to get new originals.

  7. On a good note, we got the I-485 NOA1 in the mail yesterday so that makes 3/3 hard copied received. We took them over to the local community college and enrolled my wife.... wow, I almost said fiance since I'm so used to posting that, in school so she can take classes. I got some good news from them on residency requirements. Right now she does not qualify for resident college fees but if I file taxes for 2016 and show them proof of the state return then her status could be changed to resident and she gets much lower class fees.
