  1. I agree that love isn't something we can control. But I also have to remind you of the dozens of emotions that are mistaken for love every single day. 

    That said, without me poking too much at your personal life. Yes, you would have to leave and try again, unless your current petitioner wants to risk fraud by making an illegal arrangement. I can't see if this has been mentioned, but your second time around is going to be especially difficult to prove under these circumstances. So be prepared for a lot of scrutiny and a more delayed process than before. Judging by the patience level and attention span demonstrated here, it may be quite overtaxing. 

    I do hope you and your current husband figure out what went wrong. The process of k1 itself is quite the test for relationships. Its a shame that you made it this far and late such a short time. Bounce off that rebound you got going on and salvage what you already worked so hard for. That's the best advice anyone should give you.

  2. do not apply for another nonimmigrant visa while the K1 is processing. he can visit you with an ESTA since australia is a visa waiver country. however they may question him more at ports of entry since a K1 is pending. 

    you can apply immediately after you are engaged. the only real requirement is having seen each other within the last 2 years.

    you're trying to do what most of us wish we could do, which is have our partner with us while doing the K1. I'm sorry to say, it's just not possible. If you have a reason, you can apply to expedite the visa, but they're very picky and most get refused.

    Make sure he is home for the process, that's the most honest advise anyone can give you. Be patient, cause this is gonna suck. Come here when it gets too much and you'll find hundreds that can relate to you and cheer you on.

  3. Haven't commissioned a lawyer for my petition. however, i agree, this site is quite great to keep your patience going. Much better than the official immigration site that give you defaults and drives you crazy!! I've been very grateful for this site and all its users

    You spoke my mind exactly!! USCIS received our case on May 30th. Based on people who have filed as recently as last year I was expecting to hear back within 3-4 months tops. We filed K-1 because we thought it would be the fastest way to be together, and we would still have have time to plan a wedding. Had I known how long we would be waiting, we would have done spouse visa for all the reasons you mentioned. Oh well, the wait continues.

    may 30th here as well. Still no NOA2. Don't get discouraged. I believe this should be our month, seeing as april folks have seem to get a lot of responses in september

It was given out as a probability with my opinion attached. forget the example i gave. the point simply was I worry about a law possibly changing under the heated immigration reform craze that has swarmed our media and political spectrum recently, notably within presidential candidate debates. By all means that was just me further explaining the haste. Again, thanks for all the input.

  6. I was using it as an example of the last time we had laws reformed and how drastically they failed. The coming election is currently defined by the candidates ideas on immigration reform (if you follow debates and watch the candidates). therefore immigration laws seem to be under the radar for change upon the election next year and that concerns me, cause it might be better, but it also may become much worse.

  7. So i just remembered the thought process i went thru when i decided to not use the waiver

    1) Syria is unsafe, can you fly to Lebanon? ummm yea i guess

    2) can she drive to Lebanon? NO ITS NOT SAFE..........well then if we approve the petition you know there isn't an open embassy is Syria and she will have to go to Lebanon. So mentioning the she cannot leave Syria might get you rejected because of that; she wouldn't be able to interview anywhere

    3) ok its actually reasonable for her to go to Lebanon.. Then you have 'no' problem meeting.

    That actually was a very well thawed thought process that has successfully turned everything I was thinking on it's head. Touche sir!

  8. Thank you all for the feedback. After many conversations including this thread, I have decided to set up a meeting in Lebanon. Technically we have met face to face in my sister's wedding, however no interaction took place back then haha. I'm also concerned about the fact that the entire election coming up seems to have become defined by immigration laws and the idea of reforming it. Last few reforms in any case I've seen, the latest being obamacare have all turned out to make things worse. So I'm trying to beat that clock considering most people are saying it's taking at least 10 months to God knows how long for the whole process.

  9. She's in Damascus. She could enter Lebanon. Actually that's about the only country nowadays that Syrians can enter legally without major difficulties. It seems quite redundant to have that exception within the instructions and yet never apply it, ESPECIALLY to someone who actually has Syrian heritage and did reside there for a significant period. @SuperSaiyanVisa (Kickass screen name btw haha), are you part Syrian as well?

      a. Intend to marry within 90 days of your fiancé's admission to United States and you are both free to marry; b. Have met in person within 2 years before filing this petition, unless you establish that either:

      (1) The requirement to meet your fiancé(e) in person would violate strict and long-established customs of your or your fiancé(e)'s foreign culture or social practice; or

      (2) The requirement to meet your fiancé(e) in person would result in extreme hardship to you.


    that's on the instruction page for the i129f form. there is obviously exceptions. I just needed to know if this fit the bill, which seemed like an obvious yes. But a definite no is not the right answer. That much I can see.
