  1. What I have heard and read that this may turn out to be a combo meeting and USC spouse should attend for the I-751 interview portion if it happens. I am in the same boat and plan to attend as well asI am the USC spouse. I do have a K2 who is the I-751a applicant and I am not sure I need to take her. We dont want her to miss school, so may not take her along as we have a toddler that would be tagging along if they need to confirm any bonafide marriage criteria. 

  2. nothing yet. We were late by 2 days on the Fingerprint due to being out of the country. They did take my wife and K2 for the finger print though. Since then nothing. Nebraska is the service center. Thought this was an open and shut case given that we have 2 children together and our finances are co-mingled as well the K2's last name was changed to my family name so we are all one big happy family. November 7th will my wifes 3rd year as GC. Thinking of applying for Citizenship then. Any drawbacks if I do it now?

  3. on my 3rd try, I made success. The 1st time I was there at 12:00 PM and they said that the office is closed for a meeting. Last week we went at 10:45 and they said the day was almost over and for me to come at 6:30 am. The office though was courteous. Went in at 6:30 today, however the receptionist didn't want to give me a number, basically said to sit. When the friendly officer came in, I went up to her and reminded her that I am back, she said get a number and if the receptionist should give me hard time to mention her name, which I did. This time I got a number and was called in 20 mins later to a another courteous african american lady. She stamped my daughters passport with no issues and also didn't ask for any proof nor asked for my wife who is the petitioner. All good now and we can travel as a family next week. All in all what a truly broken system we have for legitimate immigrants. Glad it's over for now.

  4. it'####### or miss with the tier 2. The first Tier 2 I had a few months ago was helpful and wanted to set an appt, however since I had 4 months before my travel, I said I will wait for the letter. The last tier 2 was a typical DMV sort of guy that didn't give 2 hoots abt my wife's daughter's case. We are going on a 3 week vacation in 26 days to my wife and K2 daughter's country of birth. Will take a chance and do a walk in tomorrow with the wife and 2 toddlers as the daughter is in school. Life is like an Ocean in the end it's beautiful when the rough weather wanes.

  5. I am finding it very difficult to make an appointment at our local Fairfax, VA USCIS office online. Tier 2 said I could do a walk-in and say I am travelling within 30 days and they will see me. Has anyone had any luck with walk-ins at the Fairfax, VA location? Which day is better? This is for a stamp on the passport for our K2 minor daughter where we didn't get the I-751 receipt notice. 

  6. since my last post, I didn't receive the notification for our minor. I called many times and each time they opened a case and the reply was we have looked at your case and re mailed you the receipt, but I never received it after waiting for their standard 14 business days. I asked them about the address and they confirmed it is the correct address. I have a receipt number but not the I-797 form for my daughter. They asked me to go online to make an info pass appt but there aren't any appointments available. I was told to do a walk in, which looks like I may have to. We are traveling in 30 days.

  7. I called this afternoon and was put thru to a tier 2, who said that he will have an inquiry opened and we should get a letter in regards to the K2. If we don't get it by the end of this month, then wanted me to call back so I could make an apt at the local office for a stamp on my daughter's passport. All in all the tier 2 agent as well as the initial agent were very professional and wasn't dismissive as the previous loser I got 1 month ago.

The receipt number is LINXXXXXXX, so I am assuming that's Nebraska Service Center that's handling the adjustment of status. Is anyone in the same situation as my Wife's application or should I call and speak to a Tier 2. We are travelling out of the country in April and was wondering if the airlines will give us a hard time, when trying to come back. Any feedback would be appreciated.

  10. The interview went well. The IO asked a lot of a questions, basically our home address, DOB of the kids and mine and also asked me the same thing and then asked a series of questions to see if she was a communist or a murderer. Standard "no" was the answer. Thought it was pretty obvious that we live together as we have a child together and expecting our second. The IO was actually pretty pleasant and friendly and she went out of her way to make my wife feel comfortable. I think the questions being asked, is her following it by the book. At the end she said you're approved but we need a new medical as it had expired. She knew that it deflated my enthusiasm as we need to travel out of the country to see my family during Thanksgiving, however she said if we get it to her by Friday we should have the plastic in two weeks or so. Eventhough this has being one frustrating episode, given that my baby threw up twice while driving there and when we were parking the wife threw up too, I would say that the Fairfax facility is managed well and the Officers are pretty decent folks. Except for one, all of them greeted their customers with respect. Glad it's almost over and now we can live our life to the fullest.

  11. Got a letter for an interview for this week at 7:30 am. We have a 17 month old and expecting our second. Would have being great if we had a received an interview waiver as we will need to leave the house at 5:30 am to get to the interview. With wife's morning sickness and carting a baby is going to be a challenge. Atleast glad to get this out of the way and move on with our lives.

  12. Has anyone experienced where the AOS application was transferred to Philadelphia and not Fairfax. When my congressman checked with USCIS they said that the file is in Philadelphia and is pending to be scheduled for an interview. We applied early October of 2015. Received EAD and AP in a timely manner, however the AOS has taken longer than normal. My wife and I have a daughter together who is a USC. Should I request the interview to be done here in Fairfax or drive the day earlier to Philadelphia for the interview, when it's scheduled? There is also a K2 whose application is along with this, so that would also mean she misses two days of school and driving with infant is so inconvenient. Thanks for the responses.

  13. You may need to fill out an I-90 form and pay the fee ($450). I am going thru something similar, however in my case my wife is completely changing her name as her Chinese name is only one alphabet rather than her nickname, which is longer. I went to a local court office to have her name legally changed and will wait patiently for two weeks till I get the order in hand to complete the AOS.

  14. My Fiance and her lawyer were able to convince her ex to notarize a letter saying that their daughter could move to the US. He wanted money but my Fiance said no, it is up to him if he wants his daughter to study in the US and have a good life or study in a village, my fiance was calling his bluff. I gave him $50 though for his time. We were willing to give him much much more :dancing: . One condition he had though was he wanted to see his daughter which he has had no contact for 5 years and I really felt bad for the daughter as the man was a total stranger to her. Her two uncles accompanied the mother so there was family support for the 10 minutes of meeting her ex.

  15. in my Fiance's final divorce papers, the following are the comments by the Judge:

    "According to the examination of possibility of the parties who has ability to take custody of the child, the appeal court finds that the petitioner (mother) has more ability; moreover, the said child was who has lived with the mother since she was born; therefore, the custody of her shall be granted to the petitioner, the mother, to bring her up, which would be better than granting her to the father."

    The father hasn't made any contact with the child for the last 5 years nor has he supported monetarily. He only wanted the property which, my Fiance gave him 100%. My Fiance moved to a women's shelter due to the physical abuse and they helped her with her divorce, which he is still bitter about. His excuse for the physical abuse was that this is normal in Cambodia. The judge at the court house laughed at him and told him he wasn't a man. Which has made him even more bitter. For us to get a consent letter would be almost impossible, for one he is already married and has a child and would not care. I don't mind offering him money for his trouble of signing, but my fiance thinks he will want to make life difficult for her.

    Any ideas if the above wording on the custody will make the USC okay with the K2 application? My Fiance and I have a 2 month old baby together and this separation we have right now is difficult for the two of us. Facetime helps a lot but holding my daughter in my arms is priceless.

    I know the whole interview process is in the hands and minds of the CO. The way he/she interprets the divorce document is the way it will go. I might be able to argue the points, however I am no lawyer and that also might get the CO upset.

  16. My Fiance and 9 year old daughter have their interview in two months in Cambodia. I intend to attend the interview process as we have a 2 month old baby and to give credence to our relationship. Since the K2 visa issuance is quite common, I want to know the process. Basically, will my Fiance be asked to get a letter or have the other spouse come in and notarized that he allows his daughter to move to the US. The issue here is that my fiance nor her daughter have any contact with him for the last 5 years. When my Fiance got her divorce he told the judge he wants 100% of the property and that my Fiance can have the child. He didn't want to split the property nor pay child support. Even thought the divorce papers say in an ambiguous language about the divorce and custody, I am not sure if the consulate will consider that things are a little different in Cambodia. My Fiance's daughter and I are very close. I feel it for her as she is the innocent party here. She has being calling me daddy for the last 1 1/2 years. Now that she has a little sister whom she adores, she is even closer to me as I want her to feel that we are a family of 4.

    I know for a fact, once her ex knows about the impending movement to the US, he will play dirty and try to stall the whole procedure by refusing to do anything. I may have to pay him, which I am willing to do if only I know what I am coming against at the interview.

    Can someone please tell me their experience at the consulate interview, where a K2 was involved. I know it's different for every country.

  17. The embassy confirmed that we can bring the baby for the interview. Good luck to all potential spouses. This Visa journey has being long with very little sympathy from USCIS. Everything happens for the best though. All I want is my family in the US so we are dysfunctional as we currently are. Kudos though to the IVPhonomPenh personnel. They have always replied emails promptly and very courteous.

  18. Hello all,

    My Fiance and I had a child in March of this year in Cambodia. The child will get the US passport in June as I will report her as born to a US parent. My Fiance now has her interview for early August. I plan to fly back to Cambodia for the interview as well. The question is can we take our baby to the interview? She is being breast fed.
