    The forms are the same.... I-130 BUT the visa - green card is different.
    The difference is:
    Married for less than 2 years at the time of getting immigrant visa (CR-1), entering the US with immigrant visa, a conditional green card will be issued. That person would have to remove conditions after 2 years of GC issuance.
    Married for more than 2 years, is awarded IR-1 immigrant visa - status with no conditions.

    No, just new fees for new submissions after Dec 23rd ...... short of cash as our payments "fund" their work ..... we pay for our own hassle and pain .... yuk! 
    Fees quoted on old forms which can be accepted are wrong ..... so you need to check for forms post Dec 23rd:
    Old form - new fee
    New form - new fee

    You are now a lost cause in the "Nebraska wait game"  ....... this process has sucked you in like a black hole .... and the worst part, you if like me will repeat, it plays with your head that badly.

    Hi again. Happy new year! Just an update..
    We got approved last November 21, 2016 and received the I-767 from mail last November 28, 2016. My husband was calling them since December and today NVC just received our case and he was adviced that they can give us the new case and invoice numbers in two weeks from today. My question, is this normal? I've seen others here doesn't take that much time like this. I don't understand.

    Let us see, they dropped a load of petitions on Texas who seem to have been processed in the "5 months" yet appear to have done little based on those on visajourney who actually log-in and complete their timelines.
     
    Where could this be going wrong?:
    An interesting aside is the AOS ( Adjustment Of Status) level which is very high from those who entered the USA on one visa and then "decided" to be an immigrant.... which is supposed to be a big NO NO ...lol Many many people filed believing Hillary would win and have yet to withdraw their application ...... others fear Trump and bet "lose:lose" so get the papers in as a safety measure to prevent other problems. Staffing levels are short, commitments to IT upgrade and training high, on the job disruption reduces productivity and case reviews. Funding is non-existant ( see point above) It is Nebraska, cannot remember anything exciting, fast, ground-breaking to ever come out of the State? So why would you live and work there if you did not have to "clock-in" to USCIS and other "Govt jobs?"

    I 100% agree with you. This is so f****** ridiculous. I also saw on the app that they've been working on end of June cases since the beginning of this month. I haven't seen anyone got approved from July yet. Staying away from our loved one makes life so hard

    Stay strong. This is indeed frustrating. I would suggest contacting your husband's local government again by telephone, not email.
    I know this is difficult. We are all in this together. The sacrifice of separation from our loved ones will one day be rewarded.
    For now, I send hugs and strength to you and your husband.

    hey guys finally the processing just been updated on the official website, Filed office processing dates for Nebraska service center as of October 31 2016
    I-30 processing as of date is June 2, 2016, means , I don't know what is filed office processing date means, but officially they started to touch from june? or by June?

    Took the IR-CR1 processing via  http://www.visajourney.com/timeline/ ..then reversed sorted the columns clicking on the little tab icon at the top of the column, ,,,then into Excel to sort multi column and then cut and paste fail twice into visajourney so had to manually list with bullet points to get it to stick.
    Algeria: coming up as just woken up now

    I love how everybody says that "helping with the baby" is considered work.. I guess I need to start asking for money every time I do something nice about my brother/sister etc..
    Imagine your family comes over and they are not allowed to freaken touch the baby or change its diaper cause its considered work.. that just sounds crazy to me. It's like going over to your sister for dinner and helping with the dishes.. its not work.. work is doing something for profit..
    from what i've seen on lawyer websites etc "volunteering" is allowed on a tourist visa.. I would consider this volunteering and not "work" ..
    helping without profit = volunteering = not work on a tourist visa = legal.

    While everyone is spot on with the "you are an adult" and "no, they cannot deport you", we should talk more about the "eviction" possibility. Do you have friends or other family that you can live with? Do you have a job? Are you in school? Your parents may remove their monetary support from you, but if you can build a support network and find a place to live, you will be ok. Maybe not emotionally right away, that will take time, but you will not have to leave the US.

    Hmm I dont know exactly what was said in court or how her "income" from her mother was presented or why the judge didnt count it. Honestly if it was a small amount under min wage then it really only would take a few bucks off your obligation anyway. The major issue is the fact that they are figuring your percentage based on your previous salary and there is little you can do about that. Like others have stated, you can move to an area where there is a lower cost of living and do the best you can. Keep asking for it to be lowered and eventually it will be if you keep showing your income is truly lower. Its either that or secure additional employment (several part time jobs) to make the payments. However this is a double edged sword because it will keep you current but not help you in making a case that you can not afford to be at that level of support. Its a tough situation.
    For your ROC. You didnt technically do anything wrong by filing a joint application with your spouse. Whats going to happen now based on what you wrote(that you sent in the packet and stated that you are separated and considering divorce) is that well basically they got your packet and your biometrics notice goes out automatically. When someone actually looks at your file- like a real life person- they will see your note and send you an RFE that will be somewhat intimidating and wordy. Its basically going to strongly suggest that you switch to a divorce waiver and demand the divorce decree.
    See as long as you are still married - even if you are separated or have a divorce pending, you can file jointly if your spouse is willing to participate. They can not make you use the divorce waiver option and file alone. Many separated couples use the waiver option to file alone because if you are separated you typically do not have a good relationship and do not want your soon to be ex involved in your immigration proceedings.
    So you are going to get an RFE asking for you to switch to the divorce option. This does not cost you money. But they will want your divorce decree included in the response. I do not know if you are going to have it to send. Like I said, a divorce takes time. There are several hearings. You need a separation agreement. It needs to be reviewed and approved. Sometimes when children are involved there are parenting classes that need to be taken. Sometimes there are mandatory waiting periods. You seem to think you are going to go to this first hearing and walk out with one and you will most likely not. You should look up your counties website for divorce information about the general process for some information.
    When you get the RFE you can post back on here for help on how to respond if you havent been able to obtain any legal assistance, but basically if you dont have the final decree you would let them know that. Almost definitely you are going to get an interview. Four months of marriage after the GC was received before separating does not "look" that good for you. You also do not seem to have that much evidence of the marriage. You need to gather more evidence if you want to be approved. when you go to the interview you will need to have the final decree to be approved. If you dont have it still you can get more time through immigration court, however if you are lacking bonafide proof of marriage then the decree wont matter much because with out that you wont be approved.
    Look up immigration assistance clinics or pro bono immigration attnys. legal aid for immigrants. You need to get legal assistance for both your immigration issue and your divorce issue Im afraid. There is only so much we can do for you here. You really need someone who can review the specific details of your life and financials and piece together a case out of the little bits you do have to give you the best possible shot.
