  1. My husband came to the U.S on K1 visa July 2021, we got married before the 90 days deadline. We filled AOS October 2021 and received RFE on I-864 Affidavit of Support. We submitted our response Nov 2021, and since then no update. My husband wants to travel to his home country to go see his aged mother who is sick, but he has no GC to travel. We didn't apply for AP because we didn't think the GC will delay to this extent. I have tried calling USCIS but the automated system won't let me speak with a live agent. I have also contacted my Congressman office, they have sent a message to USCIS twice still no movement.  We are not sure what else to do to get the GC approved so my husband can go see his sick mother. Does anyone have a trick to get live agent on phone? Also, any suggestions on what we need to do about our case? Thank you in advance for your response.

    Also how did you prove your income?

    What documents did you provide?

    They likely aren't the correct ones or are incomplete documents.

    I sent letter of employment verification, 6 months paystubs, 3 years tax transcripts, and bank statement. My household size I entered 2 for that. Please let me know what I did wrong.

    Sorry I meant the I864 Affidavit of Support not I865. I have attached a copy of the letter below. I don't have the exact form I 864 I filled but I entered 1 for questions 3 and 2 for household size. Like I said my income is $67,000 and it's just me and my husband in our house hold. Please advise me on what I am doing wrong.

  6. We also received the same REF in Feb. 2020 because my initial package did not have a ton of information, just pictures and boarding pass and letter of intent. My response to the REF was:

    1 Resubmit copies of intent to marry

    2. Chat and call logs (picked a few - initial chat, proposal chat and recent phone log)

    3. 6 months Pay stub and last 3 years tax transcripts 

    4. Letters from his sister and brother and my mom acknowledging our relationship/engagement 

    5. Chat from my dad letting him know our plans to get married 

    6. Letter from my church that we will plan to get married at the church

    7. Detailed letter of how we first met and started dating

    8. Pictures of recent visit and engagement and boarding pass

     

    After submitting all that, I realized I did not do enough at beginning. However, we got approved 2 weeks after they received the REF response. Now we are stuck at NVC stage for 2 months now 😔😔, we are praying embassy opens soon🙏.

  7. It's a tough situation you are in and your reactions are understandable. Like others said, move your family to an apartment of your own and then try and get your driving license (crucial). Also, think about going back to school even if it's one class per semester or online, it will pay off later. Hope this helps. Good luck to you.     Congratulations! My timeline is similar to yours. I’m praying we receive our approval today too.

You have to wait 75 to 90 days before you will receive your ead card, If not you can call after hitting 90 days, My aos is showing the same status and the I-485 application depends on your local office. Atlanta is processing May 11th 2014 application as of Oct 31st. also on the I-485 I have heard that the tracking is not reliable to some people as they have already got their greencard and still showing fingerprint fee recieved
