    A word of advice. It's not enough to have a "good immigration attorney". It's critical to have a good immigration attorney who also specializes in your kind of situation. I learned this the hard way. You might want to ask around on this forum as well as Immigrate2US to find a lawyer with experience in this kind of thing. When you interview the lawyers ask if they have had cases like this. And do a lot of research before you talk to them and after you talk to them so you have an idea how good they are.
    And gather what ever evidence you can in the meantime. If the ex-wife is a bit crazy maybe she will run her mouth at the wrong place and time. Good luck

    FEBRUARY 3, 2015 The Department of Health and Human Services (HHS) has updated the poverty guidelines effective January 22, 2015. Among other things, the poverty guidelines are used in determining minimum income requirements for Form I-864, Affidavit of Support, and Form I-912, Fee Waiver Request.
    The latest guidelines were published in the Federal Register athttp://www.gpo.gov/fdsys/pkg/FR-2015-01-22/pdf/2015-01120.pdf.

    if she is turned away it would at least be considered a removal, correct? -unless she is allowed to withdraw her request to enter. This is what happened to us and he was removed (visa stamped "cancelled" all over it) . After a removal there's a 5 year bar to re-enter the US, and your case can become very complicated. (now she is an immigration problem) So please use a LOT of caution before deciding she should visit. Would you be better off meeting in another country for her visit?
    Always tell the truth, and always assume that they know what you don't want them to know (but won't know the things you think they should know already) I agree with the other posters that she has to have enough evidence "to overcome the presumption of immigrant intent". She should bring as much as possible with her to show that she plans to return to her country.
