  1. so how she will contacte Senator/Congressman and if i want to call the consula to ask about why they found me ineligible that a good or bad idea

and she called the consula yester day and they told her to call again wensday if she want talke about interview and she sent a email to them saying to them why they found me ineligible and why they ask me about religion

She looks up her local State Senators/Congressman and calls them. Calling the Consulate could help but she should talk to the Chief Consular. Again they can ask anything questions they want. What they mark on paper is a different story.

Perhaps you should read this :221G

  2. They can ask anything they want, including religion. They can not deny you because of religion or age. They know that typically Moroccans do not marry outside of their culture and usually marry younger or around their own age. It's your job to convince them that you married for love and not a visa.

Your wife can contact her Senator/Congressman. It might help. She can also try contacting the Chief Consular by email or calling. It might help to get letters from family and friends to say they affirm your relationship with your wife. You want to keep the case at the consulate now.

  3. so how i will do that and they did not tell me why they found me ineligible so pleas help me and why they will returne my applicant to usa

It seems they are not convinced of your answers or how you answered. They don't really know if you gave true answers BUT some how the officer detected bad vibes. Do you actually know how much fraud comes from Casablanca? The officers are very well trained. They want to see what you do now. Perhaps it will take a little longer now but if it's true love you'll stick it out.

  4. I'm not too sure of the earnings requirements but if you were to do DCF most likely you would need a sponsor. The main thing is meeting him in person first. Marrying however on the first visit could be a red flag. Do you have any other possible red flags(age, religion, culture...)? Another possible red flag is that you just divorced and found love on the internet. You will find more with the same situation in this forum MENA.

  5. This is most common with MENA Consulates. The best thing to do right now is contact your Congressman/Senators. Try contacting the Chief Consular at the Consulate. If they actually do send back the case to USCIS there are a few options...they could let it expire, they can review it and send you a NOID or actually deny the case(which they would need substantial evidence to deny). The CO was not convinced which is why he was refused a visa. You could go back to Egypt and marry there. What ever road you choose be ready to bombard them. If possible get affidavits from family/friends attesting to your relationship. Good luck.

  6. Not being negative but here's my 2 cents....get to know your SO really good before even applying. I see that you're meeting in India but is it possible to meet in his home country and meet family? Perhaps make a 2nd trip before even filing? Can you marry rather then file for a fiance visa? If you do file after the 1st trip that could raise a red flag. Also is there a large age gap between you and him? I've been down this road myself.

  7. Thank you for all the advice I got on my previous posts regarding the "abnormal" RFE we recieved on our case. I have obtained all of the information they requested and am also resubmitting much of what I previously sent. The one thing I am still unclear of is this. I know "normally" they do not ask for all of this information, but, that hasn't answered my question of do I send the information from my most recent trip in February, which was approximately 2 months after I had filed the intial application? I want to know if I should gather my airline receipts, credit card statement, bank statements etc. and attach these along with everything else even though the trip was taken after the initial filing. Please advise, thank you!

I would say yes, it certainly can't hurt.

  8. Does your fiance have children? If so he might be looking out for their sake. My father remarried and he had a pre-nup which is what my step mother wanted as well since she has kids of her own and looking out for their best as well.

  9. How did you know the reason of your first denial? We are in the same position. Last month She received a letter from USCIS saying that our petition has expired and we can apply new one.

Sorry irnmtn for using your post!

We never knew the "actual reasons" but we had "red flags" that most likely made the CO return our case. We addressed the possible issues with the 2nd petition. With the 2nd time around the CO could not deny us on the same issues as the 1st petition. Our "red flags" were most likely our age difference and religion.

  10. HELP!

I just received a notice from the USCIS today that my 129F case was sent back to them from the State Department, and they were asked to review it. Does anyone have any clue what this might mean? My fiance went through the Consulate interview in Mumbai back in December 2009 and was issued a 221(g). They told my fiance we were trying to be fraudlent in trying for a visa for him, when we weren't. I wrote a few letters, involved two Congressmen's offices, and no luck. I had pretty much given up on it. Then....this.

    Is there still hope?

That's normal procedure when a 221g is given. USCIS could review it and request more evidence from you, re-approve it or deny it, close it or just let it expire. It happened to us the first time around and USCIS never reviewed it, we ended up filing a 2nd k1 and getting approved. You can refile a k1, get married and file a cr1 or just wait it out and see if they review your first case.

  11. How can I arrange a private meeting??? Whenever I call I get the runaround and am told I can only ask questions via email and when I do that I get very vauge answers :0/

They will never give a "private meeting". Your case already returned and USCIS let it expire? You'll have to address the possible issues with your next petition. It might be worth investing in a lawyer that understands these type of cases.
