Thanks for all of the comments.  We never filed ROM so the marriage wasn’t recorded in the Philippines.  We have talked on and off for the last 19 months, but not regularly.  I was thinking of taking a vacation and spending it with her in the Philippines or somewhere else that she would be allowed to travel with her passport and sort things out.  And I agree that with the 10 year green card she can leave again and it would be a costly mistake.

We have had major discussions about our past disagreements and we both talked about things that we both could have handled better and On the surface we both seem agreeable.  14 months is more than I would have expected for a spouse visa.  When I tell her this she will not be happy.  She has a friend that claims they had their spouse visa approval in 7 months.  

  3. I am a long time member.  My wife came to the USA in May 2015, got married, filed AOS and then left and went back to the Philippines and her green card was cancelled at USCIS by me.  This happened in September of 2016.  She departed voluntarily 2 days later.

    We never divorced.

    She wanted to come back to me since December of 2016 and realized she made a huge mistake.  

    So here I am 19 months later and find that I still love her and want to bring her back to the USA and work it out.  

    Realistically, what option would be the best?

    If I file IR- 1, how long would it take and would we have a good chance to be approved?  Would we have to meet in person again?

    Or would it be better to divorce and file K1 all over again?

    At this point, I don’t care about the cost, I just want to have an easier way to be reunited with her?  

    All opinions and questions are welcome and encouraged.

As an advocate for victims of domestic violence I would say if the victims decide to act just when something is happening then most of them would be dead.I don't see a victim of a scammer different than a victim of DV because at end they are abused in the same way just in different forms.

    We don't have to wait for something to happen to take action, it's wise to see the red flags and act asap,it's in your hands

  5. Get rid of him and send him home. I regret filing AOS for my wife. It was a waste of $1,070. If he is acting up now, picture how much ####### he can pull when he has a work permit and 2 year green card. If it starts out badly it will just get worse. When I was in your position, my thinking was, she is adjusting, when she works it will get better etc. That was not the case. If there is no "honeymoon" during the honeymoon phase, you have nothing but an expensive lesson like I have.

  6. He is out of luck and you will have to file all over again for him. He didn't have legal status just because you got married. Getting married just satisfies the requirement of the k1 visa. Without the advance parole, which is the travel permit, he isn't allowed to leave the country. If you had filed for AOS and received either the advance parole or the EAD combo card, then he would have been able to go home and come back easily.

  7. Next time, get a working spouse from developed countries like UK. Then you won't have the problems of spouse not being able to pay for immigration process and household bill.

    Lol. Thanks for the tip. After this, no more spouse for me. Besides, plenty of American women here already. I would never look abroad for a partner again. It isn't worth the hassle.

  8. Typical american. Dont generalize it. U havent dated all filipina in the Philippines, heck not even more than 100 filipina to say that.

    If I said typical Filipino/Filipina it would be a war. But you can say typical American and it is ok. And you say don't generalize yet there are so many pinay that all act the same way. If all the pinays don't like the USA or Americans then don't go looking for American men or come to the USA. It is that simple. No one is looking to emigrate to the Phils. If the women weren't beautiful, no one would even travel to your country. And even if they are beautiful, all that attitude is not worth it, no matter how good looking the women are.

  9. seems to me there are a lot of misunderstanding here.. maybe u need to find out the reasons behind her actions? yes, she may be acting like a child, etc etc but why? why is she tampo? maybe u said something that to you sounded OK but to her, it sounded offensive?

    i once dated an american guy and 80% of the time i feel offended with what he says, and yeah, it is because of the culture i would say, so i would always be tampo and worse, would have grudges and lots of unsaid feelings.

    does she communicate in english well??

    sometimes, since english is not my native laguage, when i am upset, i try to communicate my anger through words, sometimes, the words are not very easy to say so it gets frustrating, add to that the anger i have with the current issue we are fighting about... then sometimes he would interrupt me too, and most of the time when i feel he dont understand me, that also adds that to the frustration and anger i feel.. until i would just shut up and not talk bec talking doesnt help anyway..

    i hope u can resolve this with your wife.. there are reasons behind her actions...

    At one point I was interested in the reasons behind her actions. I am not interested any longer. Talking, which leads to compromise, is the way problems are solved as opposed to being quiet. I can't imagine the whole country of the Philippines is walking around all day silent, pissed off at each other and hoping issues are resolved.

    My thoughts exactly. The fact of the matter is that the OP was lazy and didn't maintain her right to live in the USA. If the OP likes Canada so much, she should move there and be a high income earner that pays 60% of her income in taxes versus 35% in the USA although she will get "free" healthcare. The USA doesn't care about your little bit of taxes. They collect billions of $$$$ every minute. Stop passing the responsibility OP and act like an adult
  12. Put on your Nike's and run. How long have you two been in a "relationship?" Do you really want to marry a woman that slips in at the last minute that she has 2 kids? Pretend you are talking to a friend and they tell you this scenario. What would you say? You have to wonder what else she is hiding.
