  1. Yeh its great we´re all staying in this thread so we can share our NVC experience as we´re all processing the same type of visa. So I finally got a hold of my lawyer on Friday, it seems that he kept the original birth certificate from the I-130 application as well as the marriage certificate. So what he requested in order to proceed are the following documents.

    My priority date with USCIS was March 27th, I was approved on July 31st.

    NVC registered my approval on August 21st, my attorney received an email from NVCAttorney@state.gov with a PDF letter attached, IV and AOS invoices which were avialable for payment immediately. I paid both and they were in process for a day, showed as PAID the next day. So now Im waiting for my attorney to send the AOS package which he will do today after I send him the PDF version of taxes and all. I will mail him remaining docs for IV application tomorrow.

    AOS:

    2013 Taxes - My spouse has been working here in Spain where we both live so he only requested last years filing.

    Letter from employer stating the gross annual income.

    Pay stubs for the last year.

    IV:

    • 2 Passport pictures
    • Copy of passport (photo page only)
    • Police clearance certificate from Spain
    • Birth certificate, long version with name of parents- Make sure these are translated and carry the Apostille in order to be valid in the US. Well Spain and Uruguay are both part of the Hague Apostille program so thats what I had to do.
    • Marriage certificate

    This is all the info I have for now, will keep everyone posted.

  2. Yes, I rather stick around here as we all progress through NVC. The other thread as you said is very confusing and everyone is negative and upset lol. My trust is in God and his perfect timing. He is in control, I have struggled recently as my attorney stresses me out sometimes. After our approval, we received the IV and AOS fees which I was able to pay and both cleared within 24 hs. He took two weeks to get back to me with the list of docs I need for the IV and AOS packages. So I gathered info from here and started getting those ready. I guess its hard for me to trust someone else 100%, it irritates me when they dont feel a sense of urgency for those of us who count each and every day. I decided to not stress anymore and just let him do his work. I wont question anything else, its not easy. Pray that everyone is in the states for the Holidays. Nothing is impossible to God.

  3. Awesome thanks for ur help. I have requested the Uruguayan police certificate which takes like 15 days to be issued. I had not requested it before because it does expire and I didnt want to risk having to ask for another one. Ive been reading a lot about interviews and I think they only ask a few simple questions and most of the times wont ask for pictures and such. Like when we got married here in Barcelona, it was only for my wife to stay here and we werent worried about the celebration as she doesnt have any family here. When I applied for the I-130 we sent pics of us and our trips but no wedding pictures and all that. We still got approved. We dont have the disney story and I dont think theyre expecting that. Were still humans with regular lives and when I go to the interview I will express the same. Weve had an average life and had our struggles and been through a lot so we cant show them something that isnt true. My point is that I wouldnt overthink the interview part. Sometimes too much information can harm you. Find a balance as to how much stuff u will bring with you. Most likely they will not ask for any of that. Were almost thereee :)

  4. Yes the G28 my bad. If you submitted that one then NVC will send an email to your attorney with your Case number and both invoices.I had to pay one at a time as it wont allow to pay them together but each only takes 2 min its really easy. U need a US bank account. After those two clear. He will than send the AOS package and the IV DS260 application online. Once those two are accepted ur file will be sent to ur nearest Embassy or Consulate for interview. Not much else to it. Hope this helps.

    Congrats to everyone that got approved the past few days, I kee everyone in my prayers and as always I am sure will be all done with this soon!

    I have a few questions about the nvc, sorry I have to post it here but the nvc thread is to fast haha I can keep up with the topic.

    So we have a lawyer and since the beggining of the process she collected everything, aos, police certificate, everything, she will be of course in charge of filling out the forms, what u guys will do she said she will cal and all to get the nvc numb3r or priority whatever should I call to?

    David87 how's the nvc/lawyer working out for u, give me some advice por favor!!

    And last remember guys we are all in this, I am really thankful I found out this website, I dnt really talk about this situation to any one cause nobody will understand how stressful it is but we are halfway there.

    When we started this process people told me it will be up to a year to get approved, now the nvc backlog, i dont believe anthing because I have faith.

    Well I was approved on July 31st and my attorney in Boston received an email from NVC Attorney Email address with my case number and AOS and IV invoices on August 20th, so 3 weeks later. I went online and paid for both of them using a US bank account number, next day it was showing as PAID, I am now waiting for his instructions on the paperwork that I will need for my IV application, mine will habe to be a paper application DS 230 due to my case status beginning with MDD. who knows. But he is still assuring me that we will have an interview date in the next three months. If you have an attorney you do have an advantage as you skip the choice of agent part, If at the time of filing your I130 your attorney filled out the choice of agent form that is it, NVC will contact him directly as they did with mine through an email, he forwarded me the PDF which was the letter saying my visa petition had been registered and case number bla bla bla and at the end the two invoices.

    This is my progress so far, I am a Spanish citizen but im also Uruguayan so I know they´ll probably ask for criminal check from Uruguay as well and Ive already asked a family member to get that and another birth certificate for me as it takes a little bit. I dont see why they ask for the same documents over and over again, but anyways Im happy with the progress so far and am patiently waiting on the Lord.

  6. Yes that message pops up if you either check the case to often or if it's too soon. Don't be surprised if yoy can only pay the AOS fee though. Typically you can't pay the IV until after the DS-261 is accepted. An approval I have been waiting on since June 11th.

    But please keep me informed if you were able to pay both. Curious if that is a perk to having a lawyer.

    I was just able to pay both, first the AOS and then the IV, they´re now in process, it says there it usually takes 2-3 business days for them to debit the money.

  7. Hello everyone, so I have an update on my case. I received the IV and AOS fee invoices from the NVC...well they were actually electronically sent to my attorney and he forwarded to me. He instructed me to pay online but when I tried to login with my NVC case number and invoice ID I got the following error.

    This case is in the process of termination. Fee payments and online forms can no longer be accepted. If you believe you have received this message in error, or to resume processing of the case, please contact the NVC immediately.
    I did some research and it seems that what causes this is that its too recent. I will give it a couple of days and try again.
    So excited, I was expecting a huge delay with NVC as per recent posts on here but God is so good and his timing is so perfect. I was approved by CSC on July 31st, so its been 20 days since my NVC case number. Things are moving forward and I am so excited.

  8. Hi. We're a same sex couple and currently live in Barcelona. We got married on May 2013, sent I130 on March and received NOA1 with a PD March 27th. On July 30th we were approved and now waiting for the NVC Process. Our case was processed by CSC. We had a small delay as on July 2nd we received a RFE asking for passport pictures again even though we had already sent them. So I wouldve been approved almost a month earlier.

    Sometimes these are just phantom case status updates. I had received an address change one when I had nevee requested it. So I called my attorney and indeed it was a system glitch and nothing to worry about. You can give them a call and ask for a 2nd level Agent who will let you know whats going on. I called bc of the address change to find out and the agent advised they had sent out a Request For Evidence and That I would receive that shortly. I suggest u ring them just in case. But it could also be a system glitch.

I spoke to my lawyer today and he said that the petitioner does not have to be present at the interview because that part of the process is solely to determine the beneficiary´s admissibility to the US. I am a bit confused because I kept reading all over the place that you had to take all your evidence and supporting documentation for your interview as well to prove your marriage. Now he says that its not the case, that the interview at the embassy will be all about me and my admissibility...hmmm...well I´ll cross that bridge when I get there. lol

  11. Guys, question.....my spouse and I currently live in Barcelona. We were thinking about the possibility of him leaving in a couple of months to start arranging things like finding a job, renting a place and stuff like that. Do both of us have to attend the interview when that time comes? I just read online that it is highly recommended to support the bona fide of the relationship and to answer any questions that may arise during the interview as well. Im confused now and will ring my attorney tomorrow to ask him but what do you guys think??? Should he come back for the interview or is it enough to show up by myself?

    Heyy, you wont believe it I´ve been so stressed. So my attorney in Boston received the hardcopy of the RFE on Friday 11th (USCIS sent on July 2nd) which was a request for the passport photos. So I got a hold of the pictures and shipped through Fedex that same day. It has been a week and they still havent delivered those and I paid almost 80 euros. Apparently it got suck in Miami in Customs or something, cmon just two passport pictures........so this entire week is lost. I am praying my attorney will receive them this weekend or Monday they latest, he will then overnight it to CSC and we´ll be back on track. But I swear, the simplest things seem to be a torture when you´re going through this process......I´m trying not to lose it and praying it will all be settled soon. I am sure once CSC receives it they will be ready to make a decision so hoping for an approval by the end of next week. We have to stay positive. Whats your PD again?
