  1. Hello guys, as you may remember I said I was going to call the NVC at 12 weeks time. So we just did. We were on hold for about 30 minutes and a lady answered the call. She was actually very straight forward, and nice. We requested the case number and Identification Number, and we got it. But the most discouraging and infuriating thing is to have found out that it was assigned on February 11!!!! and they emailed it to our lawyer a month ago today! And When we wrote to our lawyer on the same exact date on Feb 11, for an update on our case, he finally replied to our email, after we were waiting for 8 weeks for his replied. He said with a very generic email that our case has not been assigned number yet, etc. I can not believe this. Here I am almost going crazy wondering about when our case would move forward, and to find out today that it has been on hold because of the lack of care of this lawyer.

    What should we do guys? I am really worried we might need a waiver at the interview, but we have received mixed opinions from various lawyers that we may not. Should we proceed in our own? I want to write an email to our lawyer and tell him how incompetent he is. The lady on the phone said to go ahead and pay the fees. Should we?

    I've been with my lawyer since the beginning of the case, and he's caused nothing but headaches. I've mentioned before on here that if we had done it by ourselves we would've saved 4 months approx. Dont feel like you cant call the NVC just because you have an attorney, I call all the time and dont expect anything from him anymore.Give the NVC a call and add your email as well, thats what I did and I receive the notifications as well. Make sure you double check the forms before he sends them off, mine screwed those up as well. In fact I will be suing him as soon as I get there, I have written proof that he has mishandled our case more than once so I want all our money back. Imagine when we paid the fees, he had me believe he had filled out the visa application form when in reality he hadnt. He let 2 entire months go by until one day I decided to ask where he had gotten all the information for the application, thats when he said, no you have to do that one yourself I believe I had mentioned this in an email ( which he hadnt). He's never available to take our calls, his secretary is the most rude young lady I've ever had to deal with. He was quick to take our money and make everything sound so easy and smooth, I really do regret hiring a lawyer, we are 4 months behind just because of him. Ditch the lawyer, when the time for the interview comes, if you are found ineligible for a visa, you can worry about a waiver then. I dont know thats my personal opinion, we might need a waiver too and if I do, I know im not going to my lawyer, thats for sure, hes been the most incompetent and I cant wait to arrive in the states to get our money back and to write a review about his services.

    Quick question. Do you all know whether its mandatory for the US Spouse to live and work there? My husband is struggling overthere alone. Im the head of the house and he's considering coming back to wait it out here with me. Were still at thr NVC stage. We have a stable co-sponsor in the US as well. My question is. Can both of us be abroad at the time the visa is issued?

    Only 9 more business days until my second 60 day period is up with the NVC. They have made me wait almost the 2 months now to review the corrected form. Someone did ask a while back who had an attorney. I had one and received a RFE from USCIS due to missing passport pic, which was sent and lost by USCIS according to my attorney of course.

    The stupidest checklist from NVC, a 1 missing where you state total number of applicants you are sponsoring in the AOS form. I know my day is coming, patiently waiting, but yeah, I wouldn't recommend using an attorney. It was definitely a waste of my money. Had I done it myself, I could have perfectly avoided the RFE and the checklist, which in total would have saved me 3-4 months.

    I am hoping for an interview in April and will be traveling in May, God first.

  4. Hey I'm married nearly 3 years does this mean I could go for the 10 year residency too? I've never heard of this, can someone explain it or send me a link PLEASE.. I've been waiting a year nex month for my noa 2 and nothing ?????

    Yes, I can confirm this. Even my lawyer has confirmed it and its all over the web, its pretty straight forward and there are no extra steps. At POE, if you have been married for 2 years or more, you will be admitted as an immediate relative automatically, with a 10yr green card. If you have been married less than 2 years, a conditional one that expires 2 years after your date of entry.

    There is nothing you need to do about this, it is automatic and thats how the law works. For instance, as of right now I still have been married for less than two years, however my visa will most likely be issued in March or April. My Visa will be a conditional spouse visa. HOWEVER, if I travel to the US after my 2nd anniversary in May, REGARDLESS of my type of visa, If I cross POE even 1 day after my 2yr anniversary, I will automatically be admitted as an Immediate Relative and will receive the 10 yr green card.

    Hope this clarifies.

  5. Sorry about that. i got one as well fur the stupidest things. My attorney left out the total annual income -_-. They received my corrected form on Jan 15th. Really am hoping I dont have to wait another 60 days. Its my b-day today, would be nice for a miracle to happen and get a CC.

    I sent my documents back the same day the gave me the checklist. Taking them a while to scan them into the system. But I'll be patient. Its just a little hard. I've been waiting but I have to wait longer now....but everything happens for a reason.

    I know, I started this whole process in November 2013 and it seems like its never gonna end. Filed I-130 in January and didnt get a priority date with USCIS until March for some reason....than got an RFE with them because they lost one of the passport pictures. Registration of approval at NVC went kinda quick, then the checklist after 60 days of waiting, I was planning to spend the holidays next to my husband in the US but it was not possible. But as you very well said, everything happens for a reason. I'm simply waiting for a CC complete now in the next month. I pray that it wont take the entire 2 months, and then if it does not much I can do about it. Just want to be over this whole thing. Cant wait, we're close to the end, the longest period of time is over with, now just a few more months and we're done.

  7. Wow, cant believe how quiet this thread has been the last month lol. I guess none of us have any updates. I still am waiting for NVC to scan my checklist response which was sent a week ago and then the 60 day waiting starts all over again. At this point since in May I will have been married for 2 years, we have decided that even if I get the visa by March or April, it only makes sense to travel after our 2nd anniversary so I can get my 10 year residence and dont have to deal with USCIS anytime soon.

    Oh and Happy New Year everyone! lol

  9. Hey guys, no Christmas in the US for me this year. Just called NVC and finally got an update, they are ready to send me a checklist as there are corrections to be made on the AOS. I have to say I kind of expected the AOS to be a problem, my husband was the sponsor and he works here in Spain, he submitted those earnings as per our attorney´s advise. I never agreed with that, we had a stable sponsor in the US but our attorney said my husband alone was fine. So just wanted to share, I am really bummed but thank God because his time and will is perfect not mine. At this time I have decided to wait until May regardless of when I get my visa, because on May 7th itll be 2 years since our marriage and I rather arrive after that date and have no conditions on my residence.

    Oh well, good luck everyone! God is good, he is in control.

    She paused when I asked and she said "hold on, let me look at your case" (which NEVER happens) and then she was about to say something but then stopped. She continued "Your petition will be processed shortly" I asked if today and she said "Possibly but we do stay within the 60 days"

    I'm nauseous now. Daaammmmmmm!!!!!!!! If I get a checklist I'm going to die. My anxiety is through the roof. Faen!!!

  11. Just got off the phone with NVC, 35 min wait btw.

    My 60 days are up December 9th. Even though last week it seemed like they were working on it, they now say it hasnt even been reviewed and that they expect AT LEAST 60 days to go by before reviewing the case. So I mentioned that I was told they were sticking to the 60 days, she said unfortunately due to high volume it is at least 60 days, thats the earliest you can expect for us to start reviewing it...

  12. New Month, New Week. I know what everyone who´s waiting for a CC or interview date is going through, we all are. I just wanted to take a minute to encourage everyone, continue to pray and trust in God. He has already determined a perfect time, so if it is not what you initially planned, be grateful and appreciative as he has determined a better time for you. He knows everything, I have been so bummed because I had planned for a year to be in Boston by mid December...I mean it still can happen and I believe it will. But I went out for a walk the other day and just started thanking God. I am grateful for my family, and for being healthy and thats the most important. God is in control of everything else, so dont get discouraged if the dates dont match your plans. I know a lot of you have family and kids waiting for you and separation must be awful but again, be grateful and thank God because his will is perfect, not ours. He has a perfect time.

    Yes, your sounds exactly like mine. Very unusual, and the agent did say the same thing, let me look at it and then paused and said give it another week so I am sure there was something he read on there but could not disclose.

    I know this is off topic but I was reading about name changes once you arrive and have your green card and I am shocked that I will have to pay $400 and fill out a really long application just for that purpose. It makes no sense. I am sure a lot lot of people change their names when they get married and this is our case, I would like to change my last name to my husband's when I arrive but this whole new application with USCIS subject to approval makes me a bit nervous. I've been through enough waiting and paperwork for this year so this was a bit of a bummer. Plus the questions are basically the ones from the I-130 makes me feel like I'm applying all over again.

    Thoughts?

    You know how when ppl that have a work auth, if they lose it or it is stolen they have to apply for a brand new one? In any other country you would just request a copy and yes pay for it, but not re apply

  15. Hi march team! Hope all is going well, im on the k3 path..our interview is scheduled so we are waiting for the big day!! Be patient! Once nvc forwards your case to the consulate everything moves quickly! We had interviews available in the next 2 weeks! Hang in there team!

    When did NVC initially received your case? and when did you send in your docs? Just to compared with my dates and see if I can get an estimate of when my interview will be scheduled.

    NVC is taking close to the 60 days + or - a few. It would be best to plan the 60 days. My case is still there since may, coming up on 6 months at the NVC, because of a "computer glitch" in August. And it is looking like there is a possibility they lost one of my docs. Still waiting to hear back from them.

    Wow, 6 months at the NVC? Cant you get your senator to send in a letter to support your case? I´ve already requested one from MA Senator, even though 60 days have not passed, I want to make sure I do whatever is in my hands to do in order to speed things up. I call almost every single day, and what bothers me is that 3 out of 5 agents give me a different answer so they really dont know what they´re talking about. I know they just look up the case in the system and read whatever results they get there, I dont blame them but they received my AOS on Sep 26th and IV on Oct 9th, the girl I spoke to yesterday said....¨the AOS is completed by mid November and the IV will be completed by mid December¨.....from my understanding all docs are reviewed before a case is completed but I asked her twice and she said yes, it will be completed by mid Nov. I asked again, by completed you mean the 60 days will be up and there should be an update? she replied, no, it will be completed by mid November...so idk what she was talking about. I guess theres nothing we can do about it but just wait, we depend on them. It bothers me that they take things so lightly, they know how important this is to all of us its not like you´re calling DirecTV to follow up on your installation because its delayed. People´s lives are changed by this process, plans, everything. I dont have kids or anything but I see other people on here that families are separated and wont be able to spend the Holidays together and all. They should be more committed and take extra care with documents, how do they randomly lose documents? or give you the excuse of a system glitch? I´ve worked in the service field for the last 6 years, system glitch is always bs, u say that when you have no idea what´s going on and u cant bother to escalate or do proper research. Most of the times these procedures come from management, to tell people theres a system glitch. Who holds these guys accountable? American citizens pay taxes, those taxes pay these state employees their salaries therefore they do have a responsibility when they´re working for you, thats basically what they´re doing...They´re working for u, processing ur visa application for your family. They´re not giving you anything for free, it is your right, you are paying them, yet they dont give a #######. It just pisses me off, this entire process....

  17. Has anyone received an update from NVC? They received my docs on Sep 26th and still say no updates, they havent even reviewed them. Hoping it doesnt actually take 60 days, I was hoping for a month tops but oh well, gotta keep on waiting, I was certain long waits were over after USCIS but guess not. I really wanna be there before the holidays but at this point its like i dont even care anymore, when its time its time. Hoping for no checklists, case complete and interview date soon.

  18. Hi Everyone!!

    It´s been forever since I´ve posted any updates. September was awful as there was a huge misunderstanding between my attorney and I and we wasted almost 3 weeks before submitting the DS260 and shipping docs to NVC. However, we are back on track. DS260 is submitted and AOS Package and Civil Docs sent. I was so confused because when you pay the fees and print the receipts it says you must submit paper version of visa application DS230 unless your case number starts with a few listed on there, mabe 3 or 4. I was under the impression my attorney has been taking care of this and I kept chasing him as he didnt ask for any of my info he didnt know to fill out the application, like last 10 yrs of employment, everywhere I´ve lived since age 16 and all of that. I dont know......apparently all applications are submitted only through form DS260, so the application had been sitting there since the end of August when I paid the fees when it could have been submitted long ago. I dont think it caused any delays though because the docs were sent on time and those have still not been reviewed. My attorney is usually really good estimating the processing times as he nailed it for USCIS CSC, 4 months. At the beginning he said it only takes 2-4 weeks for NVC to review docs but he did mention that they´re behind and are taking longer than expected. Of course when you call all they say is wait 60 days, I actually spoke to this girl the other day she was really nice and she said it could be completed in a few weeks, keep checking.

    With all that said, all I am waiting for now is an interview date, and praying to God that I get no checklists or delays of any sort. My husband recenlty moved back to Boston to prep up , find a job, rent a place and a car. We´ve both been living abroad for the last three years. Now I´m a bit worried because he is my sponsor, my attorney said it didnt matter if he earned the money abroad he still filed US taxes and he submitted those and said it was perfect, we also sent last 12 paystubs and a letter from employer confirming his annual income. However, since he already quit that job and left I´m concerned because Im not sure if at the interview they will ask me why he left or how come he´s sponsoring me and no longer works there...idk...I asked my attorney and he said that the AOS is not so much to prove that he will financially support you, they only want to see that your sponsor is the type of person who wouldnt allow you to go and ask for welfare, they want to make sure the sponsor actively works and pays taxes and thats all they are looking for according to my attorney.

    Now the wait, since I´m in Barcelona, I will have to go to the Madrid embassy for my interview. Spain is in the VWP for visitors so not a lot of visa processing goes on there, I am hoping for a inteview date soon as they shouldnt be that busy. We are also considering my husband flying back to Barcelona to come with me to the interview, just in case.
