  1. Hello VJ Family

     

    I was ask for RFE, I already sent them, and I already have my N-400 ready to send it as soon as I see a change on my status,  But I have a question, they sent me a RFE letter, should the system have to have it when I check my case?? everytime  I check my case there's no movement just the generic  answer " On May 4, 2016, we received your Form CRI-89, Petition to Remove Conditions......" and on my case  history section, nothing......

     

    Anyone in the same situation???

    Given that it's your mother in law, why don't you just draw up a basic contract and date it to when you moved in, then scan and send to her- she can sign, scan and send it back, then you sign it, and "Voila!" rental leasing agreement.

     

    Or, (and this is probably just as effective) have her write, sign and send you a letter that says she owns the apartment you rent, and that she charges you $X.XX/per month in rent. Then on your banking information, you can highlight the money coming out to pay the rent to your mother-in-law.

     

    This is a really easy piece of evidence to get!

    I need help/Question

     

    I was ask sent a RFE, Well we have everything and ready to send, although, there's something my mind, on the letter I received from USCIS, they point some examples of what to send in one of the bullet points, they wrote. Rental Leasing Agreement sign by me & my wife, We live in a apartment that is own my mother in Law, we pay directly to the bank, my mother in law lives abroad (she even gave me an affidavit letter for our marriage) but we don't have a contract agreement for this apartment, should I explain that in my cover letter??

    Esorio, I've been watching your case for some time. Don't let the RFE put you down. From what I've seen here soon after you submit what they asked for you get approved, provided you send good evidence.  Make sure you explain the reasons why you guys don't have a CC together (bad credit). also make sure to send anything and everything with both of your names on it. Even receipts for appliances, furniture, etc.. I know they've asked for loan or CC, but trust me, send everything you have on you two. That helps make your evidence more solid. Me and my wife always buy stuff like furniture and appliances at walmart, home depot and best buy and they have our account there with both of our names on it on their computer. If you have joint health or life insurance for this fiscal year 2017 send it too.. also consider utilities..Is the car(s) under both of you? If not, maybe she's listed on your insurance as an additional driver? ask her parents to sign affidavits, and/or friends. 2-3 is usually what pple send. If who's signing is a USC include a copy of the 1st page of their us passaport. If you have costco membership, joint gym account (or maybe under you, appointing her as a 2nd), put it in the bag as well. What about power of attorneys? That's a very handy thing to have btw. Or a will?

    Thank you so much for the encouragement, I am actually working now on printing our bank statement (how many months back should we go? I was thinking to print all 2016 Bank statements, Now we have our cars under the same policy, our names are there, health insurance under our names, lease/ agreement under our names

     

    I will gather all this info this week and send it, hopefully by the end of the week, now let's keep in mind that on March 20, I already qualify to submit my N-400

    Eosorio, for my experience, it doesn't really matter if you sent the documents already. If the USCIS asks you for some documents, send them to them as quickly and as organized as possible. If they ask again, send it again. It sucks I know but the only other option for you (us) is to get denied your petition..

    Definetly, LUAL, I agreed with you, I am working now, putting together the docs, I even ask a friend of mine wish is the Army to send me an affidavit notorized letter, but We don't have mortgage, kids, credit cards (due to our low credit score, I have one CC on my name) together, they did not ask for pics, so what alse can we send?

    I am May 4, I had called USCIS, I had received e-mails from USCIS with generic answer, and yesterday a received a RFE letter from, asking for a bunch of docs for my Good faith marriage, must of the paper they're asking we do have sent, with exception of loans together and credit card statement.

     

     

    Is there any person here that has received a RFE, also here??

    Get a lawyer if you want, but it really won't do any good - there's nothing a lawyer can do to speed up the process - he/she will be glad to take your money, though.

    Remember that you are never out of status while your case is in progress. The only time you are out of status would be if you were DENIED. If an employer checks with VerifyMe, they will see that your husband is still a conditional permanent resident, with his ROC petition pending.

    So here's what you do: (and you don't need a lawyer)

    • When you go in for your infopass, tell them your extension letter is expiring in August and you need an I-551 stamp in your passport.
    • That stamp acts as another 1 year extension, and is proof of your legal status either for another year, or until your ROC has been processed, whichever happens first
    • I know this is frustrating, but don't panicAnd don't waste your money on a lawyer you don't need. There's a delay. A lawyer can't fix it or help you jump the queue in any way.

  9. Hello VJ Family,

     

    I called USCIS Today again (3rd Time last 2 months), and they pass the call to an officer, and a machine schedule a call back from the officer, almost 3 hours later I got a call from the USCIS, I spoke with a lady, and told her that I file my I-751 May 4th, did my biometrics on June, and since then my case has not move, and I tell her, that my understanding is that the CSC was working on May 14-15 and I was from May 4/2016, she proceed to tell me that in fact I was 10 days outside the normal process, and that I will be receiving an E-mail with a status of my case, let's keep in mind that I already received one email back in JAN with a generic response.

     

    Well let's see what this next email will says...!!!!

    Funny thing that 3 days ago I got a generic response to my service request. I don't think there is any logic on their approvals.

    Hang in there, it should be soon. 

     

    I hope so, I submit a inquire two weeks ago, and received a call last Tuesday Feb 21st, and the officer told me that my file was already adjudicated to a officer already that was a matter of days that I can see a change on my case, I am praying to see a change on my case this week...... When are you going to submit your N-400??

    Interview took place on 02/08, in Denver-CO, my case was a divorce waiver and I was a little concerned as I had no new/updated evidence since I had submitted my package back in May.

     

    The Agent was very professional and straight forward and mentioned a couple times that the interview was necessary only because my divorce had happened so soon after my original interview/conditional permanent resident card (divorce was filled 3 months after) and they needed to make sure everything aligned with the history/timeline.

     

    I left the interview feeling positive even though the agent told me that he wouldn't be able to make a decision before the end of that week and that by 2/11/17 I should have an update on my case status online.

     

    Came 2/15/17 and my case status was still showing the original message "On May 26, 2016, we received your Form CRI-89, Petition to Remove Conditions of Permanent Resident Status Received, Receipt Number..." so I gave them a call. After speaking to an agent, they sent me to an automated message to schedule a call back from an immigration officer, which didn't happen until the next day.

    On 2/16/17 I received a call form the immigration officer and they confirmed that my case had been approved and that I should soon receive an update on my case status online regarding the new card production.

     

    Finally, on 2/24/17 (9:05pm MT), my case status was updated to "New Card Is Being Produced. On February 24, 2017, we ordered your new card for Receipt Number [...], and will mail it to the address you gave us.".

     

    Seemed like a scary soap-opera for a few weeks but finally got to the happy-ending.

     

    Good luck to all of you still waiting on your approval and I'm sure it'll all work out well.

  12. New development

     

    Friday, i received a call from a official (I called before and had ask to speak with a supervisor or an official), He ask me a couple of questions, and then proceed to ask me what do I need to know about my case, I explain to him that I file on May 4, and did my biometrics and no movements since then, He told me that CSC was behind I explain my concern about May 15-tru-20 filers already approved, and He told me that my file already was adjudicated to an officer, and it was a matter of days until i get a change of status..

     

    Let's keep praying ,,,, I feel this will be the week!!!!!!!

    You can start naturalization process prior 90 days before 3 years anniversary since you become resident. So if you become resident for example August 2014 you can apply for naturalization May 2017. Because even you haven't gotten your 10 years green card, you have 1 year extension letter, so technically you are going to be resident for 3 years and that's what matters (of course if you're still married to your spouse). If not, you gotta wait 2 more years. Hope this answer your question.

  14. I have a question...

     

    I called today, looking for to speak with a supervisor (and like always they're BUSY), I submit a call back and they're suppose to call back between 3 and 5 days, but I ask the lady with whom I spoke to, about the naturalization process and when can I apply she says "you can start you're naturalization process when you had completed 2 years with your Conditional Card, and one year with your permanent 10 yrs Card" a total of three years...... So it means that once I get approved with my 10 yrs GC, do I have to wait another year to complete the three years...?? or do we get approved retroactive meaning that the date on the 10 yrs card where it says "resident Since" will be since the day after our 2yr expired???

     

    Can someone help me with this??

    When i check the log, it seems that if they want interview or REF, we should be getting that months ago. Could just be slow right now.

    We have the same dates, My receipt date is the 4 at CSC. I already did the inquire and the response is generic, ----- My question is even we still have been approved, can we do the I-400???
