  1. thanks saylin…though does it have to be the first time itself. Like say you crossed the border first time and then a few months later you got to sell your condo and then wanted to come take your stuff? sorry i know this isn't the thread to ask such questions…but like most other people i am just waiting to hear back… :clock: … and rather than fret about what i cannot control i am concentrating on positive far ahead thinking.. :idea:

    You can bring your furniture and electronics duty-free, no problem :yes:

    Also probably off topic for this thread, but this wait and all the disappointment have really really gotten me down (as most of you understand all too well) With the receipt of the 60 day email I have been forced to cancel our US wedding celebration (invites were already out) And although you guys are awesome and this site is super helpful; I have been super obsessed! And checking VJ every 10 minutes at work doesn't make the NVC move any faster haha.

    So I talked to my job and they are going to let me take a mixture of leave/ work remotely from Peru!!! I am going in September and staying until hopefully after our interview! I am so so happy, and the wait seems so much more bearable now, because at least I will be with my husband. Just wanted to share some rare good news

  3. Congratulations. I am so happy for you.

    I have a question for you though -- are you taking more than your clothes etc……are you allowed to take furniture, electronics, etc when you cross the border as an immigrant, without any extra taxes or duties imposed on you?

    I am asking this because eventually when i do move to the US, I want to take some really nice things i bought here (mostly furniture and some really cool electronics). is that duty free or so we have to pay duty on it? Would you happen to know or be aware of it?

    I was probably so excited that I made so many written mistakes when I posted (promise I didn't start drinking yet) :rofl: I was denied at the same POE as you, I hope I don't get the same officer and I hope he doesn't recognize me :angry: .....Thanks again, I paid the extortion fee :thumbs:

  4. Yes Aug 06 will be considered your scan date. I am doing EP and sent in my documents AOS and IV on July 10 (2 separate emails). I got an email from them only on the AOS documents saying they have received them and when I got the email about the 60 days to review paperwork it said that my scan date was July 10. So my assumption (as i have never called NVC) that the day you send the email is considered your "official" scan date. If you feel the need, you can call them up.

    I called today and they said that they got my 261 on July 27th and that they got an e-mail from me on August 6th. That e-mail will be my AOS docs using EP. My question is: will I get an e-mail when they actually open the e-mail and add it to my file? What date do I use for documents scanned when I am using EP?

  5. First off---- CONGRATULATIONS….on making it through USCIS :goofy::dancing: . Enjoy…before you have to start of the queue in the NVC stage

    Here are some suggestions

    1) READ saylin's wiki page and memorize it from top to bottom. Do exactly the way she tells you on that page --- why? because you will not get a CHECKLIST (99%). This way all your documents will be ready and set to go when you come to each step. Trust me you don't unnecessarily want a checklist and shave off extra 60 days. :idea:

    2) i don't know if you have a lawyer, though it doesn't matter much more--- once your AOS fees is paid you can send BOTH packets (AOS and IV) at the same time. Before you had to wait to get the clearance for the IV packet. it saves another 40 days.

    3) they have increased from 30 business days (which means 45 days in total) to 60 calendar days. SO yes they have tagged 15 days extra…but if you are vigilant, read saylin's wikipage on how to send everything and are on your toes and understand what you need to do, the probability of making it through NVC becomes 100 fold better.

    I got my approval from USCIS and got to know that NVC processing time has increased from 30 to 60 days

    I am just wondering what does it actually mean?

    Is it mean that total time till case is completed has increased but i will get all notices for documents at same expected time?

    OR

    it means that i should expect to get my case number or form DS-261 and fee notice after 60days?? and than 30 days more for whole process?

    please help

    feeling frustrated now :-(

  6. Look at the stamp on your passport when you entered into USA. That date will tell you by which time you needed to come back to Canada. If you have gone past that date, then yes you have overstayed. It depends on the number of months/years that you have overstayed.

    I would definitely recommend getting an attorney. I cannot give you statistics or perfect answers on this, but i do know from personal friends with two couples where they over stayed their visa (one from japan and one from brazil) that did that. They both hired good immigration attorney's and got their AOS (adjustment of status) in the USA itself and were issued green cards. Infact for them it was a shorter process (5 months in total) because you can do both steps I-130 and 485. The last one was (from japan) was as recent as january of 2014. Ofcourse circumstances and issues are different in each case, SO I would definitely RECOMMEND getting an attorney and fixing it as soon as possible.

    My case is a little difficult and I need some answers to a few questions.. Im a Canadian citizen and I married a US citizen in canada, after that I just went through the boarder on the canadian/american treaty or visitor visa, I didint need to apply for anything, they just let you through. I have been living with my husband here in the US since, its been about a year now, and I have already gone through the I-130 process, which was approved and sent to NVS to give me a visa before I can apply for adjustment of status. I applied for i-130 2 months after entering the US. Since i thought my case is in process i didint apply for any other kind of visa.

    I am waiting to start the process of a visa now. Will I be able to enter the US again if I travel with the visa? Does me staying here until now count as over staying? Am I on the right track with immigration?

    Got the text! VISA APPROVED!!! I know his dad was watching over him this morning. Thank you dwheels, Saylin, k.dlg, jsumner, BOS_LHR, Kaylara, LifeOnHold, ArthurAndMarcela, LoveMyTico, aleksandra, all my September filers, everyone else I'm forgetting - LORD I feel like I just won an Oscar! Cue the exit music!

  8. Give it a day…i got it too and it freaked me out..but if you read SAylin's wiki page you will realize they are actually working on it..and in 24 hours you should be able to pay it.

    I received AOS Processing Fee Bill Invoice this morning through an email. When I am logging on to the fee payment portal on CEAC website, it still says "this case is in the process of termination".

    Has anyone else experienced this before after receiving AOS Fee Invoice? I thought only IV Bill wasn't availble right away to pay online and one had to wait 2 or 3 days before paying it, is it the same case with AOS fee?

  9. I have seen a couple ppl doing it as getting lucky. And honestly speaking I think if the operators and supervisors are both saying it's ok to do it so if should be ok. Although it wouldn't shave off ur 60 days waiting time becasue ds260 will be available after ur IV invoice changes to paid and ds260 will be reviewed in the same 60 or 30 biz days after submission. But one benefit of doing this is that in case u get a checklist on IV u can just correct it right away and not waste additional 60 days. Rest is ur choice Ofcourse. Ppl here say it's too much risk to take considering IV package includes original documents so it's ur choice what u find safer to do.

  11. Yes you guys were earlier than us and it was a BIG MESS what they did with you all.

    I am sorry you cannot visit your husband. BUt i am sure it will all be over sooner rather than later and we all will be with our respective spouses. Fingers crossed.

    Congratulations for a quick run through USCIS most of us where stuck there for a year or more and now here. :cry: And my husband is in Egypt, God I wish I could visit him every other weekend but would have to win the lotto to just visit him once. :( I'll have to give myself a hug. :(smileys-embrace-hug-431475.gif

  12. Don't be disheartened…i just say (a few pages back) that June 23 case got approved and got a Case Complete --- I think you should be through in a week or two at the latest. Fingers crossed. And have a very happy anniversary!!!!!

    I am so sick and tired at this point..feels like if is just me or what!!! It's our 1st anniversary tomorrow..& I was hoping that I'll hear the good news this week and here I just received the email from NVC about the wait time being 60 days now..#######....so sick of NVC...I'm at work and now my mind is all messed up..I'm so so sad today :(

  13. Sorry to hear that….we waited 6 months to the day (180 days) before our I -130 got approved. We also went through NSC .. and saw people after us got approved before us and vice a versa. Its like a cruel lottery system.

    Having a lawyer at NVC helped for us, as we didn't have to file DS261 and went straight ahead with the two packets required in the same time and they are under review currently. So it shaved off the 30 days. Though, this was last month, NVC keeps coming up with new creative ideas to delay every step. I would like to think they are being responsible and going their jobs effectively. Ofcourse due to the backlog created by 2011 and 2012 in I-130s is now creating a bottleneck at NVC phase.

    Ofcourse if we get a checklist this means we have 30-60 business days more before we can even think of a case complete.

    In the meantime, (I don't know your financial situation), but I go there every other weekend. Its hard but it definitely provides some relief to be able to spend time with your spouse.

    My husband has been waiting in Canada for over 6 months, NOA1 received 1/28/2014. I phoned the USCIS yesterday and asked the Immigration Officer if they could give me any information, nothing after a 95 min. wait. The USCIS told us (6 times) in April that he could cross the border (Peace Arch) with his household and our dog and file a I-129f when he arrived. Nope, it was incorrect information and turned away at the border. I am ready to throw up my hands and give up. It took us 17 years to get married after DOMA was struck down, this process feels like another 17 years.

    Our file is an NSC (people have been approved that filed after us) with no extenuating circumstances.

    Would an attorney help this process or should I just keep waiting?

  14. Positive prayers and wishes coming your way. I am sorry you are going through this. lets think positive and you guys will get done.

    He is nasty. I told him curtly that he is rude and not listening.

    Anyway, we talked to another agent. She gave her name - Reece. She was nice and told that there are two emails of June 10th and two emails of June 11th in their system but none have been reviewed. I told her that it is way over 30 business days. She agreed but told that she can't do anything. She also told that supervisor can't do anything eiether. In the past supervisors were no help as well in resolving the issue of list emails by NVC.

    She suggest to call again on Friday and hopefully these files are reviewed by then.

    We need some positive vibes and prayers from fellow VJers.

LOL we all have our own thing i guess ---- i generally tend to drink….every time i make it through one more hoop of NVC….i think i had more alcohol since i started this process (nov 2013 --- to --- who knows when!!) :whistle: . i am actually going through a lot of local breweries currently… :blink:

    Thanks! I'm so excited that I have the worst headache ever and feel like puking. The exact same thing happened when we got our NOA2, when our case finally arrived at NVC, when we paid our fees, and when we got case complete. It's apparently my thing :dancing:

    First the N/A under AOS and IV will never change, it will stay as N/A, but for most of people once case complete, the AOS FEE does change from "PAID" to "N/A', so if you see yours change to N/A, that means it's complete.

    I called last night to check updates, they said mine should be almost done, should get response by 8/15. that's 30 business days from july 3 which was the last email they rec'd.

    my last few responses were within 30 bus days, so hopefully this time too.

    I have a friend in Nigeria and she asked me to please call NVC for her to see if she got interview date. Her PD is June2012 (some one with Oct2012 got interview today). She has a 3 year old the dad has never meet poor dear.

    I am holding now. :clock: .............I have tears oh the memories I miss this hold. We know your time is valuable. hehe. They look forward to speaking me MEEEEEEEEEEEEEEEEEEEEEEEEEEE (Okay I might be losing it.) :goofy:

  18. Oh where is the fun in that for NVC :devil: ….how can they let people just have a smooth, logical, step-by-step method :goofy: ….it would be all ….so easy then. none of us would actually ever get to meet here and we would actually live a comparatively more stress-free lives.

    If you think about it, there's plenty of time to work on the AOS form between I-130 approval and case number. People I guess wait until the fee is ready to have a full on panic, I guess. :-D

    I just called NVC and found out that they approved my AOS package yesterday! :dance:

    Well, I didn't receive a false checklist so it looks like some people receive false checklists while others don't. :no:

    I'm now waiting for them to review my IV package and DS-260. :clock: I'll just have to wait until Sept 5th (my 30th business day). :bonk:

    I hope I don't get a checklist on my IV package. I reviewed it so many times! Fingers crossed! :thumbs:
