  1. Mods, if you can please merge this onto my other post (New Card Being Produced" - Filed I-751 October 2018) please do.

     

    I filed my I-751 jointly with my ex husband on Oct. 2018. Got an update on 3/14/19 that my new card is being produced, day after that I got an update my case was approved and yesterday got an update that they mailed my card. 3/18/19 the approval letter came in the mail with the date of the approval as 3/14/18. Now my ex and I filed for divorce on 3/8/19. And yesterday I got the final decree in my mailbox and it was filed in the clerk's office on 3/13/19 (divorce effective date). Now this seem to complicate my situation because I was planning on switching to a divorce waiver after I get the final decree. My estimate was we will get it 4 weeks after we filed but it only took a week. Also I did not anticipate getting approved from my I-751 within 5 months. I need some advise on what to do. Should I file for another I-751 with divorce waiver? Should I write a letter to uscis stating what had happened? Should I just wait til I file for N400 and explain things when I get to that stage? Any advise is welcome. TIA.

    I entered the US on a K1 on 12/06/2018. We got married on 12/15/2018 - which is 9 days after I entered.

    I filed for AOS - NOA date is 03/05/2019. Received an RFIE on 03/14/2019, which arrived in the mail today and states the following:

     

    The petitioner on form I-129F and the K-1 applicant did not marry within 90 days of the K-1's arrival into the United States; therefore, Form I-129F cannot be used as a basis for adjustment of status. You must submit evidence that a valid immigrant visa petition has been filed on your behalf. Any petition filed on your behalf after this I-485 application was received by USCIS will not make you eligible for adjustment of status with this Form I-485. If you do not have a valid petition filed on your behalf either before or at the time this Form I-485  was filed, you may withdraw this Form I-485 by sending a letter stating that you wish to withdraw this Form I-485.

     

    We did include a certified copy of our marriage certificate and we did fill out page 7 of Form I-485 (information about your current marriage). The marriage certificate is also listed in my cover letter content list for the AOS package. 

     

    I am a little confused about what to do now since the RFIE is not asking me to submit our marriage certificate. 

    My best guess is to send back the following:

     

    1. copy of all pages of the RFIE - do they need to be signed by me?
    2. Another certified copy of our marriage certificate
    3. Include a letter that states again when I entered, when we got married, how many days after entering the US this is, that I am including my marriage certificate again. 

     

    If somebody else has received an RFIE like this or anything else that could help me in making sure I reply the right way, I would appreciate your help!

    Would definitely include a copy of your I-94 highlight the date you entered and as well as the date on your marriage certificate. Who ever handled your case must have had a long day to get confused with the dates.

    It did help but not as a major factor. Proving financial co-mingling and joint residency are the major ones. Our joint account was where our direct deposits are and what we also used to pay the bills, groceries, etc.

    751 cases typically take longer then 6 months but it is not unheard of for it to get approved this quickly. Usually its thought to be someone taking cases out of order for training purposes or to mess with the processing times so they get better numbers. It doesnt really matter why your case was done so quickly though.

     

    Also as long as you are not officially divorced- meaning final decree issued then it is perfectly fine for them to approve your joint 751 even if divorce papers were filed. Again you can not be approved on a joint 751 if you were legally divorced at the time of approval. You are fine. Congrats on the approval so quickly it seems!

    So I just got my approval notice today in the mail and the date of my approval was 3/14/19 and also today I just got my divorce decree and the date it was filed at the clerk’s office was 3/13/19. Now this seem to complicate things. What are your thoughts? My card has been mailed today. 

  6. Hi everyone. So the mail I got from uscis was 3 approval notice. I don’t know why they sent me 3 copies but they did. And my card is on it’s way. It has been a great and fast journey removing my conditions. I hope the same to everyone. And kudos to visajourney and as well as the great people who helped me. I’ll be back on 2021 for my naturalization. If you guys have questions I have my notifications on and will still be checking immigration updates from this forum. Goodluck to the others and hope for fast approvals as well. Ciao!

    -Joint Tax Transcripts for the past 3 years (2016, 2017, 2018)

    -My husband health insurance where I’m included. (We also included every claims when I used his insurance)

    -His retirement where I am a beneficiary. 

    -Joint Bank Account monthly statements for when we opened it 2016 to March 2018. 

    -Our lease but my name was not in it so I have both our driver’s lisence included to show residency. 

    -Monthly bills which is named to him and named to mine. We don’t have joint bills. I highlighted both our address to show same residency. 

    -We have children born out of wedlock so I included their birth certificate highligting my husband’s name as the father. 

    -About 10 family photos. 

    -Statement from a common friend we have who is also our neighbor. 

    -Statement from his aunt when we rented her room when I first got here. 

     

    That’s about it. I have detailed everything in the cover letter. Hope it helps.

    If you had any doubt about your approval, that should be gone. I pretty sure that is the approval letter. The Green Card comes in a different envelope with tracking number.

    I'm trying. Lol. I have been so used to uscis taking forever in processing papers that I had doubts that my case will be this fast. Will surely do. Soon as I open that mail I'll update.

    Yes it can be. It’s nice to see that they’re working on the cases this fast. I’m really hoping that more on our group will get approvals soon.

    I think so too. And this time it’s on the other (myaccount.uscis.dhs.gov) site not just on the case status site. So I’m really starting to believe this is for real but still a little bit in doubt for I haven’t seen anyone got approved in just 5 months. I haven’t even received any biometrics letter yet. Lol

  12. Update. Yesterday on the case status site I got an update my new card is being produced. Just right now while getting ready for work, on the myaccount site I got an update that my card is being produced and followed by your case is approved. I’m freaking out. It’s frustrating that I won’t be able to verify if this is really legit until it comes in the mail. Crossing my fingers.

    They received it on Oct. 19, 2018. I’m really hoping that it’s true and not some system glitch or some training that they had been doing in the system. I’ll surely update soon as there’s something.

  15. I got an email this morning about my case update saying the a "New Card was being Produced". The last action that was done was processing my eRequest (biometrics inquiry) on March 6, 2019. No action that my case was approved. Questions are as follows:

     

    1. Is this possible considering that I filed Oct. 2018? Or a glitch or an error? They received it Oct. 19 to be exact. 
    2. My husband and I just filed for divorce last Friday, Mar. 8, 2019. I was going to wait for the final decree before I switch to a divorce waiver (we filed my I-751 jointly). Do you think this will affect me when I apply for citizenship assuming that I really got approved this fast.

     

    What are your thoughts? TIA

    Crossing my fingers. My case was 146 days til this new update that my card is being produced. I just really hope that this is not a glitch and that USCIS is not playing with my emotions.

    Yes. My case is in Nebraska Service Center. i had no biometrics notice too. My extension letter was like 64 days late. The last action on my case before it was "New Card Being Produced" was on March 6 where they processed my eRequest.
