    So the usual pending security check BS (see my timeline - I got this for ages too with no explanation given).
    Which country is he originally from?
     
    Filing the N-400 should speed it up and force adjudication of the I-751... you could also try filing with the ombudsman, although they aren't exactly quick either.

    No, it is not necessary to update USCIS with additional current proof of the bonafides of the relationship. The whole point of what Im trying to explain is yes, things can change. You should notify USCIS if the main material fact (a pending divorce or separation {legal or just physical}) occurs. Getting a new bank account or having a child doesnt change that particular fact. Does that make sense? When you submit a joint ROC you are signing that you are a real couple that is together. When you separate or file for divorce you are no longer a couple that is together. Together in this sense means having a relationship not just physically residing in the same location. Thats what you sign acknowledging and if it changes you should notify them.
     
    And technically the "old facts" as you referred to them dont change so to speak. If you had a joint account and its now closed you still HAD it at the point of submission. So thats not a misrep. Signing that you are together and then not being together is a fact they want to know about when adjudicating. 
     
    The thread linked was just one example of how someone had an issue by not notifying them of the separation. There are other examples of this happening. Some are on VJ some are not. Technically you can be approved with a joint filing and be separated. There are examples of this as well on VJ and other sites. Being separated is not a reason they can deny you. It even states so in the memo. But they have to have ALL the facts to make a decision.
     
    So the trouble can come usually when the person naturalizes or seeks another type of benefit. The Officer when reviewing the current case will look at the past ROC and see it was approved during a divorce or separation and if its not noted that that was known about in the ROC documents they can reopen the ROC and revoke the approval. Its rare but it has happened. They can also deny the new application for naturalization or family visa being sought based on you "misrepping" on ROC. Hopefully one day USCIS will make a policy stating you must notify them as some people (and attnys) feel that until they do they have no obligation to tell USCIS about whats going on. In my opinion this is dangerous. The whole point of VJ is to provide guidance and advice on how to make the process as smooth as possible. So the general advice on VJ is to save yourself potential heartache in the future and advise them of any pending divorce or separation that occurs after a joint ROC is filed in a timely fashion.

    There's no such requirement to inform USCIS when you start a divorce, finish a divorce, leave your marital home, etc. This information does need to be honestly relayed to them when applying for a benefit and upon request (such as when you file the ROC petition, asked in an interview, etc.).
    There's no requirement to live together in order to remove conditions. Living together is something they look at as evidence in determining if the marriage was entered into in good faith, but many individuals have successfully gone through the process otherwise (especially those with spouses who are working abroad, in the military, etc.). It's very good evidence, but not a requirement.
     
    As for how wise it is to continue ROC while not living together anymore, that's a very different issue.  I personally wouldn't do it...good relations can break down at any time and I wouldn't put my future in the hands of somebody who I was no longer with (even if we are still on good terms). And if you aren't upfront about your current situation and it sounds like you are misleading the IO, you're going to have a bad time...

    Interviewing together while no longer living together is permitted and has been done by many others. You just need to be honest at all times, and should tell them about the situation so proper expectations are set. Remember that ROC is to determine if the marriage was entered into in good faith and not solely for immigration benefits, not that the couple is still in a loving relationship.

    so i wanted to share with you guys how everything went at the consultorios de visa here in DR :
    first of all the traffic is crazy in santo domingo around 8/9 am! so plan your travel with that in mind
    at arriving there you are scanned by security and asked to turn off your phone and place it in a locker if you have any then you are given a little bag where you will place little bottoms which represents the test you have already done.
    you also have to sign your 3 2x2 photos in the back with your first name and last name...and this is where the fun Begins .....
    there is a huge section where you make a line* to pay for your test and it was CROWDED !!!! the staff professionally instruct you where to be and what to do at that point so listen to them carefully so you don't get confuse with all thats going on there !!
    after like 3 hours or so you get to the cashier where you pay for your medical and you are asked if you are going to be doing the vaccines too, they inform you how much all is and they asked some question while they check your passport, the pics and the letter from the embassy, after that you go to the back of the place where there is another section where the consultorios are...
    you can go to door 1 directly where they will perform the xrays then to door 2 to do the blood sample, after that you need to wait to be called to do the physical check and while everything is in order be on the lookout of the people who were before you on the line, if you see they are been called pay attention because you are next and if you are not call you can approach a staff guy/woman in a desk in that area and tell him what test you just did so he can put you back in the loop, im saying this because there is a lot going on ! children playing or crying, people walking up and down and its kind of confusing a bit
    after the physical test you are called to do the vaccines if you are taking them and then you can go but there are other test for children but i dont know anything after the vaccination test
    i hope this help someone who are going to do this to have a idea what happens in there, the staff is very professional and informative so ask if you have questions and btw eat something and wear something light since its kind of hot !
    also they put a sticker on the back of the passport indicating the day where you should pick up the results so you can take them UNOPENED to your interview
