    If you're the beneficiary...go ahead and pay for the increased fess...nothing will change. As a USC, I don't want to pay more fees. As long as we don't have a miscreant government making unilateral decisions that affect the lives of USCs filing for immigrant spouses...we should have fine!

    Let's not give "false" hope that by not providing 1040 will get you by. Apparently, you did provide it...that it wasn't asked for doesn't mean that it does not need to provided. The instructions are explicit...1040 with W2 AND pay stubs. So, let's not set these people up for failure. To say that it depends on the consulate is absolute rubbish! I'd like to hear what others immigrating from Canada have to say about this. I'm sure that your particular situation with the CO that interviewed the beneficiary had enough info not to ask. Failing to provide the info is a guaranteed 221(g)!

    I used to live in NY and never heard of having to to have "points." (I am USC). Are you trying to get a driver's license or just an ID? Go to the NY State DMV website...look up what documents are required. Go to the DMV, fill out the paperwork. As long as everything is in order, you should be able to walk out of the office with an ID card.

    Your Visa should be enough - you came in as a CR1/IR1...

    You mentioned that she is a legal immigrant...she came here on a CR1? As others have asked...has her husband filed the AOS? There are some unanswered questions that need to be addressed before anyone can offer useful advice/suggestions.
    Your friend needs to re-think his responsibilities. He brought her here...now, after a few months...wants to send her back...like unwanted baggage? Hardly fair of him. "Jerk" is the nicest term I can think of. Nonetheless, perhaps you can convince him to follow through on whatever needs to be done to allow her to stay. Naturally, there are two sides to a story. But, as he is your "friend," I suspect that he's told you that he just doesn't want the responsibility anymore. And, as you said, he's really not cut out for marriage. Fine, but does he have to ruin his wife's and her daughter's life for his whimsical nature? He needs to step up to the plate!
    Kudos for helping his estranged wife and daughter!! That's very kind of you and your wife. I hope everything works out well.

    Nicer...ok. But, really, the point was not about being nicer but to be more accurate in what you're calling out. As I said, you've been on point in many instances throughout...in this case...not so much, sorry to say. LOL. I should also say...having compassion for someone's real plight ...(I know...there's a fair amount of questionable situations broadcast here) and offering various suggestions to help someone who is in dire need of very useful information...that would be more helpful. Sometimes, you have to put yourself in that person's situation...realizing that people from different cultures respond differently. Not everyone is cut from the same cookie cutter! '

    Harpa...I'm not sure that anyone was providing misinformation...someone just posted what is on the I-864 form with regard to the Petitioner's responsibility. Everyone here does agree that the husband should take responsibility for his actions, as a man and a human being, and not leave his estranged wife and her child stranded - after all, he is the one who decided that he doesn't want the marriage to continue. Divorce costs money and settlements take time. She's relatively new to the US...and it will take time to find a job. And, she has a 6 yo to support. While I usually respect your comments as being on-target, straight-forward and to the point...in this instance...hmmmm....

    well...As for things going smoothly after NOA2...not sure where you came up with that idea. There are just so many different factors that can affect progress. Such as the computer system crashing at State Department - which really messed things up. It could be Obama putting one of his famous DACA programs in place...which has had a drastic delaying effect on everyone! It could be that at the consular interview, your fiance may get a 221(g) - stopping everything dead in it's tracks. Add to this list, natural disasters...causing "emergency" situations at an embassy...if you can imagine it, it can happen...
    You see...none of this is made up...all of it has happened to many of us here - at this time - so, don't pin your hopes on a specific approval date or month or, for that matter, year. As another has said - remain flexible. Until your fiance has that visa in the palm of their hand...then you can start to make serious arrangements. The government and the people working for it don't care about your plans nor your time table.
    Hopefully, everything works out well for you and yours...just don't set yourself up for disappointment! With that comes aggravation, stress and a bunch of emotional ####### that you nor your intended needs to deal with.I'm fairly sure that many here will tell you of how this waiting game can put a terrible strain on you and yours and on your relationship. Do yourselves a favor - plan to make plans once the visa is in hand - not when your fiance has been approved - not even when it says ISSUED on CEAC website. Too many things can go wrong - and have for many people! And all of us thought that it couldn't happen to us.

He did that at the expense of American citizens petitioning for spouses and family. His actions directly impacted thousands of petitioners and their loved ones. Perhaps you've been hiding under a rock?

    You're right on the first point.
    On the 2nd point...I disagree...based on personal experience...
    On the third point...I agree on the 2nd part of your statement...on the first...not without Congressional approval! Obama acted unilaterally - completely not his right to do that...making and changing laws is strictly under the Legislative Branch (Congress and the Senate), per our Constitution. Obama circumvented it...not even with an EO but rather a "Directive" to then Homeland Security Secretary Janet Napolitano. It was a very sneaky move on his part.

    I would say not to waste your time writing to Obama...he's a lame duck prez and could care less. Better to write to Congressmen and Senators. Yes, it's nice to release emotions through sarcasm...but, as others have said, it will fall on deaf ears. I have written to 30 Congressmen and Senators. My Congressmen has been helping us with my wife's immigration...Van Hollen in MD. His office has been very helpful...and, he's a Democrat. But, his voting record on immigration is more conservative than many of his fellow members. Anyway...I agree that this process is "painful" and that Obama's actions were deplorable!
    Fixing immigration is not going to be an easy task. We want the system to be streamlined, more efficient, etc. Yet, considering what is involved in the process...and all of the agencies involved...it will be difficult. Not having a president muddling with immigration affairs - with programs like DACA - would be very helpful. The flood of illegals to this country is mind-boggling. What the senate and Prez O propose to do about it is unacceptable.
    All of us here have taken this issue to heart as we are directly affected. Unfortunately, many American citizens are clueless and could care less about our own journeys. If everyone on VJ wrote a letter to their congressmen, senators and committees that deal with immigration issues...perhaps Congress would then take up the issue in earnest.
    Anyway...we can't allow the actions/inaction of others to negatively impact our relationships. It's important to remain focused on constantly building our relationships in a positive and loving way. Don't allow some outsider you don't even know destroy your life.

    Yes I have contacted my Senator Barbara Muluski of MD and Congressman Elijah Cummings. They support what the President is doing. That's why I changed parties and now I am a Republican. This illegal immigration has gotten out of hand and I pray the Republicans take over Congress so these people can be deported back to their countries and stop overloading our system. I have not seen my husband since last year. I am a freaking American citizen. This is not how it is supposed to go down for us. So I don't want to hear the b.s argument its not Obama's fault. It's his fault and the fault of the Democrats!
