  1. To make everyone clear im not talking about the whole wait time from starting. Right now my problem is the AP is taking longer than normal. I was just telling my whole case and everything from start that its been this much time. Right now under AP it is been more than a year cuz i did submited the ds5355 via email as i was asked in the instructions then after 3 months i was told they didnt get the email. Total waste of 3 months. So im counting from nov 2017 till now date which is more than a year.

I’m not sure I understand this bit.  I presume you mean you updated the i864 to include your new baby, but it sounds like you sent this via email? Did I misunderstand that? Or did you mean you sent the DS5355 via email and only found it wasn’t received when you updated the affidavit of support?

If you have been living in the UAE for some years, do you have a joint sponsor in the US?

No first i submited via email ds5355 then by post i send new affidavit and ds5355 again when they told me to send the email again. So to be for sure they recieve it i sent them again.

OP, so sorry this is happening to you and I wish you all the blessings of God in resolving it soon.  It was not clear from your posts when you submitted the DS-5535.  Was it in February 2018?  If so, it has not even been one year of waiting, and DS-5535 has a lot of information that takes time to investigate, depending on the circumstances of your case.  DS-5535s are recent, but those I have seen here on VJ, from actual cases, have taken a very long time to resolve, often more than one year.  So you could just wait until February when AP has been in process for a year after DS 5535, then move forward with a lawsuit if you choose to and have the cash to fight it with a good attorney who has experience with this type of case.  At least you are living in the UAE with your husband.  That is a great blessing that most of us do not enjoy.  Count yourself lucky in that regard.  You are together during the long wait and others wait years living apart.

Yes thank god for this that im living with him. I submited ds5535 in november and they told me they didnt recieve it for 3 months i was just sitting and waiting for them to do something about my case then feb when i sent new affidavit of support to add my daughter n follow up on the status they said they didnt get my email which is really sad. 3 months were wasted for nothing.

You waited over a year after being married to file the initial CR-1 visa:

Your husband then requested the visa be postponed for a year at the time of the interview (see below):

Because of the intentionally requested delay, a new medical then had to be done and submitted:

That looks to be around 3 years out of the "almost 5 years since we started the case" right there? (if you also include time between CR-1 filing and 2017 interview date).

Of course, not saying it's not difficult to wait for what one wants...however I don't know if one can fully blame USCIS for the overall delay at this point.

My case started 2014 if u can count its 2019 now. Thank you nothing else i want to say to you.

Yes I suggest be very careful on the lawyer. Immigration policy center says re WOM,  that the usual interpretation of the law can make adjustment of status cases speed up but because of the doctrine of consular non-reviewability it’s a different situation for consulates/embassies, and the courts have generally supported this distinction (short version, the warnings in this thread about risking denial by forcing a decision apply in this case because it involves visa issuance by a consulate, but wouldn’t for an AOS case in the US).

OP you can be thankful that your husband isn’t in fact from one of the banned countries that was introduced while you had your intentional delay.  What a pity you didn’t just take the visa when offered even though you’d waited so long already and instead got caught up in new /differently applied policy. I’m sure the others on AP here would have grabbed that chance immediately. Please come back and update VJ on your decision and the outcome.

I will inshallah inform whatever decision we make next and what the outcomes out.

  6. Well it was our decision to hold the visa for one year because of personal reasons which i cant share. And time is not always the same. It changes and people go through tough time it doesnt mean that now they are taking so much time in AP its my fault or i deserve it. I dont deserve it because the difficulties i had that i went through were from god. If you cant say anything nice then please dont say bad either. Thank you

Let us know how the writ of mandamus goes, if you choose to pursue that route.

People who think about/say they will do this hardly report back on how it went, and what the final outcome was.

Yes im thinking about going through this route as i dont have any other choice left. I cant wait any longer. I will definitely let everyone know the result as it will take few months.

I don’t understand why you did this. If you were pregnant surely your husband should have tried to get to you as fast as possible, not asked to wait another year?

This seems to have been part of the issue, the DS5355 as a form was introduced August 2017, during the period of your intentional delay, which then served to delay everything even longer.

Because of some personal reasons we wanted to do the delivery here in UAE. Yeah i know we made a mistake that time but it doesnt mean that it should be delayed that long more than one year.

  9. Thanks everyone for the answers. I just dont know what to do now since everyone’s opinion is different. The lawyer i spoke to he was saying that it will speed up the things and then the embassy will have to make a decision.

My case is since oct 2014 and i got married in 2013 feb. my husband’s interview was January 2017. We took things slowly that time but now my husband is going through a tough time at his work so we want things to get done sooner. The officer was ready to give him visa during his interview he took his passport and gave him that congratulations letter with the green card fees paper and told him to collect the passport within 2-3 days. But i was pregnant so my husband told the officer to hold his visa for one year. He agreed n told my hubs to send new medical with passport after june before june only passport he will need to send. He put all the details in computer. So in November 2017 we sent new medical with passport and we received it back the same day with the letter 221g for for administrative processing. Also an email ds5535 and i also got a call from the officer saying i needsubmit this form then my case will be completed. So in February i send a new affidavit just to check the status. Then i got call from the embassy saying they didnt get my email for ds5535. For 3 month we waiting n they didnt even start the case. He also told me since my husband renewed his passport thats y he need to go through AP. Then i sent the email again and i have sent by post as well. Till now not one single update on my case only when i contact them. This is the whole story.

We have 2 kids and total of 6 years of marriage there is not anything we hid from them. Also my husband only travels to Pakistan with us once a year to visit family. We are currently in uae on resident visa. Now he is having difficulties is in job thats y we want to go through this route but i just dont want to get denied.

Please everyone suggest should we wait more or go ahead with it. The lawyer we found is jim hacking if u know he is good let me know that too.

    thanks everyone

  10. Hello,

i have contacted a lawyer and he is saying if our case is outside the normal time frame i can sue the embassy and the uscis to make a decision on my case. What do u guys think should i go through this route ?? Im just so scared to take this step. The lawyer is saying it wont affect my case but they will make the decision soon but it can be good or bad. My husband’s case is under administrative processing for more than 1 year and almost 5 years since we started the case. Please everyone give ur opinions as we are so frustrated and think this is the last step to do.

    Thank u

  11. Hello,

I would contact your senator and explain the situation to them. They can send an inquiry to the embassy on your behalf. Thankfully I didn’t have to get this done for our case. But i have heard from other people that going to senator may be helpful.

I think the senator doesnt do anything. They just email n gets they same response that we get but i will definitely contact the senator. Thank u

  13. Hello everyone, im so sad nothing is happening with our case. My case is so old n still the embassy is not even working on it. The last update was march 12 which i sent a letter to the embassy n thats y it was updated not because they worked on my case. I think the day they worked on the case was last feb 20. Plz tell me what should i do as im soo stressed out for this long wait. My husband’s interview was last year in january 2017 but held visa for one year. So from feb 4 this AP started.
