  1. So I got K-3 visa and will arrive USA on October 15th, what is the first step should I do? I have read that I need to apply for Adjustment of Status and that is form I-485 right?

    Go back and get the CR-1.

    Just a few reasons why to go with the CR-1. If you are eligible for a IR-1 then you would be nuts going with a K3!

    The K3 has to adjust status which cost $1010 + $131 visas application fee.

    Have to go thru the cost and hassles of getting a I-693 also.

    K3 normally has to do biometrics and have a AOS interview. Time off from work cost the petitioner. PLUS the hassles of submitting the paperwork and going for the interview. Tain’t fun.. Especially if denied or questioned. Ever done a Stokes interview?

    That’s the second interview if they are in doubt of your relationship.

    Also a possibility of being deported. Yeah doesn’t happen much but it happens.

    K3 has to wait about 90 days after they file to get EAD or GC so they can get SSN and be able to work.

    CR-1 can work as soon as they get the GC and SS card in the mail. Normally with 6 weeks.

    Can’t do a LOT of things without SSN. Like work or get a drivers license in some states.

    Some K visas don’t get GC for a LONG time.

    If petitioner goes belly up before you get GC you stand a chance of being deported.

    If the petitioner loses his/her job after the interview you don’t have to worry about getting a co sponsor to adjust status!

    CR-1 cost about $470

    Get their GC and SS card in the mail within 6 weeks of arrival.

    No biometrics , dealing with civil surgeons, AOS interviews, going to SSA for SS card.

    I’m sure I’ve missed a few things.

    Bottomline is anyone that goes with the K3 the way things are now are masochist!

    Yeah I did but at that time K3s were a LOT faster. That’s not the case anymore.

  2. Take you Fiance and just travel the country. I usuall start out in Davao and will look at a place far on the map like CDO and just hop a bus and start heading that way. I will make stops at places that look cool or interseting and spend the night or a few days there.

    I make each trip to PI an adventure.

    Do you go thru Cotobato? Good way to lose your head if you do so.

    Central Mindanao is NOT a good place for puti at this time.

  3. Thanks to all the work and help from this site I have been able to put together what I believe to be a complete AoS package for my wife (here via K-1).

    Now I need to assemble the AoS package for her son (4) and I am having trouble figuring out what documents I need for him.

    Clearly some things will not be needed (marriage cert., I-765) but I am worried about sending things I do not need to and not including things I do need to.

    Also, if my wife files with a I-765 work application but her son does not, will that mean that her sons application will take a lot longer to process?

    Finally, is there anything special that should be done in our case because we are filling after the expiration of their visas? I did not know that the AoS should be filed prior to the expiration of the visas as I could find no government document that includes a time limit for the AoS application for K-1, only that we be married within 90 days, which we were.

    Any help would be greatly appreciated.

    No need I-765 for the child unless you want a SS card for it.

    NO problem filing late. LOTS of peeps do so. Be sure you file the I-693 for both

  4. How long are the medical exam results good for? We thought it was one year. Just now we have "heard" that it's 6 months. We're past 6 months, we're a bit over 10 months since the medical exam, and planning to bring her over here within a couple weeks.

    Bel is very discouraged because of what a huge hassle the medical was for her particularly. Psych referral due to a tiny little wrist scar from childhood, had to do the physical exam twice because they handled everything poorly. On the final day at St Lukes she was there until almost 11pm. And I was quite nervous at the hotel waiting for her that late with no cell phone allowed in the clinic! (almost went out and got a taxi alone to go find her)

    I hope we don't have to repeat this. I found a link to the embassy site which says "generally valid for 6 months". The use of the world "generally" possibly indicates that it could be good for more than that in some circumstances.

    She has not been contacted by the embassy about it. What would have happen if I had gone ahead and brought her here without knowing about this 6 month limit?

    When she does get to the US apply for AOS ASAP as she will have to have a complete medical by a USCIS Civil surgeon if it's over 1 year when she applies for AOS. Cost a LOT more than having the CS just fill out the I-693.

    A little late but when my wife did St. Lukes you could take CPs inside. I talked with her the entire time. Maybe that's changed.

  5. Again, you have to see your personal physician or local health center so they can tell you if you need those shots or not --- based on your age and gender. From what I know, polio vaccines are administered when you are a baby...if you have gone past the age requirement for polio vaccine they will not give it to you anymore because of your age.

    You sound like one of the other members I replied to before...with a different ID.

    The CS determines which shots you need. NOT your local doctor or health dep!!!

    got the td ,mmr, hep b, done i have other serries for hep b tomorrow and influenza.then my td say the next is may 2018..i got all my shots free coz my husband is in military..i dnt go to cs yet coz when i called the assistant say to get my shots done then make a appoinment for cs.i still i need to done the polio ,hib,pneumococal?

  7. Up in the air yet on tax returns for my step daughter, we are working on that now as she wants to study in the UK and beneficial to get her US citizenship as she won't need a visa. For her, its just three thin 1040EZ sheets.

    With the 2 photos, N-400, copy of green card, and a check, seems like nothing compared to the one inch stack of stuff we sent in even with the tax returns. Our tax returns are thick. Was also thinking about sending in a copy of her grade transcripts, another sheet, as she is a 4.0 GPA student. But maybe overdoing it.

    Call IRS and get free copies of your tax transcripts. Takes about1 week and each year is only a couple pages.

    They are more valid than returns as they prove you filed where returns don't.

    800 829 1040 24/7.

    No need send in W2s also when you send transcripts.

  8. Hi, 15 days ago, I sent my letter of employment via regular mail and some other paperwork needed. Well, it seems for the first time, the letter is probably lost or held up in customs in Morocco. Usually, my fiance get my letters within 9 days after I send them. His interview is on Tuesday of next week so I was wondering would the Embassy take a faxed copy of Letter of Employment as proof?

    There is always Monday with hopes he may get the letter but if not I was just wondering about the faxed letter.

  9. have any of you gotten Magic Jack here and sent it to the Philippines for family to use ? Will it work there ? I thought it would be a great idea if it works there.

    We've been using Magic Jack for about 6 months.

    It's UNREAL. It's as good as calling on a landline[i guess you are]. Bad thing is if you are in the process there's no records of the calls for USEM!

  10. I agree, the instructions are not clear in regards to Part 5 and the form only says list all children.

    We need to hear more on what others have done.

    Read Who may file this form in the instructions.

    Yeah they screwed up and put ALL later on.

    They care less about how many children you and the petittioner have.

    In part 5 they want to know what children need conditions removed.

    I was RFE'd because I put my adopted daughters name who is already a USC in Part 5. They wanted $80 more for biometrics. Took me months and my senators help to straighten it out.

    LOTS of people have put their USC kids and didn't have any problems tho.

    Hard to get around the word ALL! USCIS screwed up putting ALL.

  11. I sent only a couple of pictures with the initial petition. But My fiancee made all the evidence ready to give during the interview. I hope that was the mistake that we did. However what I am confused now is it good idea to file another petition or just wait and appeal when USCIS send me the paper? Which one better? Thank you for your help.

    I'd cancel current petition make another trip and marry and do a I-130 with a LOT more evidence.

  12. hi there, we have just satarted our K1 visa application and the packet is going to be sent to texas today. My question is: I am a british citizen and my fiance is american and i am hoping to live over there with her. In 1985 i had stupid momnet and now have a criminal record for theft and the only other thing was a minor motoring convection 10 years ago for no insurance, will this stop me from getting the visa......

  14. Just because a person may have criminal charges/convictions in their past doesn't automatically make them any of the negative things you said. Regardless of the crime people should always be given a second chance. Now a third fourth or fifth chance is pushing it.

    When do you stop giving them chances?

    11/09/09 - received I 797C in mail (extension for a year)

    11/16/09 received letter for fingerprinting

    12/04/09 - FP appointment Done

    i receive and email saying Your application has been placed in for scheduling of an interview

    You will be notified by mail on when to appear for your interview

    I would be WELL prepared for your interview if it's for ROC. Most people aren't required to have interviews if they send in enough evidence they have a bonafide marriage.
