  1. My Question is, are all K1 denials treated the same when you move to the K3 / CR-1 process?

    We were denied by the Embassy in Cambodia clearly by not only their set of guidelines (ignoring what we stated or outright calling us liars), but also so ridiculous things that do not even have anything to do with us other denials by other family members). Now facing the issues of a K1 denial, how do we approach the K3 / CR-1 process? Are we starting all over or is this baggage from the K1 come along? Is a lawyer really going to help? I have tried to discuss this with several and either they are incompetent or just playing stupid when I ask if they can help with the issues the Embassy has...

    Depends on why the K1 was denied?

  2. The I-864 is binding. The I-134 isn't.

    Check the USCIS website to locate the form and it's instructions. It's more involved than the I-134 but they're more likely to take it seriously if you include it.

    There's definitely a CHANCE that you'll be approved this way... but there's still also the chance you won't. Usually they allow it for students because the reason they aren't earning money now is to have a better earning potential later.

    I-864 is NOT a requirement for K visas at USEM. Only the I-134. I-864 comes into play when nonimmigrants adjust status in the US.

  4. So I am back again on my previously started topic. I just went through the papers which u´ve to fill out for the embassy ,just to get an idea how they look and what questions are asked. The 156 form ,question # 36 asks about if ever anybody has filed a immigrant visa for you?!

    Like I wrote in my first post in 2009 my nursing angency filed a I-140 petition (emloyment based immigrant visa) on my behalf which got approved and is now sitting at the NVC, rotting there until there will be a visa available.

    Should I just leave it at the NVC or call them and cancel it? Will I have problems at the interview?

    When I filed for that visa I didn´t know my now fiance´at that time, I didn´t know that I´ll meet him in April fall in love and get engaged.

    Im really worried that they might think this is a fraud relationship etc.

    PLEASE HELP

    What are your odds on getting a visa via the I-140 at this time?

    On November 23, 2010, a USCIS office received this case from the State Department with a request that we review it. We will notify you when we complete our review, or if we need something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

    For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

    So...is this good or bad?

    It's good as at least you know they are working on your case. Looks like just a information notice to me.

  6. Thanks alot for your advice ... we had a co sponsor and his still willing to help, is it ok to give her my paper work just for peace to rain ? but i dont know what she is up to ? yes i have two years stamp on my i-94

    im just confuse my wife has already told me she doesn't want a divorce..

    i dont know why she is insisting that i should give her all my paper work and visa page

    If you are going to give her paperwork,

    I would give her copies. NO originals.

    They show where to mail an address change but I can't find anything else?

    The form is terrible. Hardly works for a child adopted in the US.

    Fee goes uo Nov 23.

    I haven't found the new N-600 fee for an adopted child yet either

    Fees go up Nov 22

    Salamat po in advance.

    Current fee for adopted child is $460. Will go up to $600 Nov 23,

    Adopted child currently $420. I've no idea what it will go up to. I'm trying to get the petition in before the fees go up.

  9. It's not a mess at all. She files ROC for herself based on a good faith marriage. Her new partnership is ONLY relevant if it goes to prove her original marriage wasn't based on good faith (meaning it is irrelevant to HER process).

    She needs to show all the proof she normally would for a self-petitioned ROC (joint accounts, joint insurance etc). THAT is her priority if she wants to remain in the US. Then she can deal with all the UK immigration stuff.

    What's the hurry to remarry? Wait until the smoke ckears.

    A friend of mine came to the US on a Fiance visa,but when she got to the airport,her fiance changed his mind and would have nothing to do with her. he even refused to pick her from the airport and a good Samaritan had to take her in as she had no money on her or had any place to go. She refused to go back home to Nigeria because she had sold all that she had to buy her ticket to come to the US and she was too ashamed to return in disgrace would would kill her old mother etc. She continued to live in the US working odd jobs ,but now she just met someone else and has now fallen in love with this new guy. will her marriage to another person after all this time and another guy other the the guy who petitioned for her in the first place help her Status in the US? is there any hope for her if she marries this new man. thanks

    Tell her to get a immigration lawyer as it sounds like she has already gone illegal by overstaying.,

On 16th nov I had an interview for my K3 visa. when I arrived the cons.Officer checked all the required doc. she said to me 100% are fine and correct so please come back tommorw when i go back I met another officer. She asked me proove communication like Email and money transfer phone bills I show her she said well every thing is ok so pleasae bring to me 4 more months for phone bills.& take your visa ......and come back next week. so is any one of you knows this kind of case. so please help me any idea if my visa is ready

    I'd have your petitioner contact his senator or congressman and have them follow up on what's happening at the embassy.

  12. Hi, I'm new here I wanna ask 2 questions.

    My fiance is in China now. After we know each other for about 1

    yr online he came to China on Feb this yr. Since the first time he

    came to visit me he don't want to leave me. Now we know each

    other about 22 mo. We are both cautious persons and for some reasons

    we can't marry in China so we decided to get marry. So we want to

    apply K1. He is from Minnesota.

    1. Could we directly send the application to Nebraska service center

    from China or we have to send it to his sister in Minnesota who he

    live with before coming to China. Then his sister send it. But acutually

    we hope go to Seattle where I have a cousin there. Could we go to

    Seattle to apply for my temp green card?

    2. When we send the application should we send as many proofs as

    we can? But I heard if the package is too heavy then when P3 send from

    US to US embassy in Guangzhou will take a long time for customs

    clearance. Nebraska service center, USCIS and NVC will base on

    those proofs to audit the relationship? After they audit then they will

    also send those proofs to US embassy in Guangzhou then embassy

    audit again? If so then I think the more proofs the better.
