  1. If you read the N-400 instructions, you will know that you don't need to send pictures, copy of passport or copy of social security card.  You only need to send copy of green card and divorce decree. Take your IRS transcripts to the interview, you don't need to send them now.  From the last 5 years.

Hey there everyone. I hope someone can give me their opinion  and maybe someone can relate and let me know what the outcome was. So my husband has been a permanent resident in the us since 2010. We have been married for longer since 2007. I am a us citizen. He had a dismissed assault charge about 7 years ago. And this year in September of 2018 we have applied for naturalization. We sent in the verified court papers that show it was a dismissed case and everything has been going smoothly. Already went to his biometrics and now we’re just waiting around for the interview. Long story short. Last night my husband got into an altercation at work with a customer who kept provoking him saying things about his mother ( who is deceased). My husband warned him multiple times to watch what he is saying and have some respect. He kept doing it and my husband out of anger hit the mans driver side window with  his hand and the glass cracked. The man called the police. Police came and asked what happened. Gave my husband a ticket. The ticket said criminal damage. And there is a court date for both. The officer told my husband to call the number on the ticket and see if he can just offer to fix the mans window and that’s the best way to go about it. Hopefully we can just avoid court. My husband had had more than 5years of the gmc needed to apply for citizenship from the time we applied. What should we expect now? Try to resolve this before the interview and hopefully still be ok? I appreciate anyone who took the time to read this and would appreciate any help or if someone can relate to having somthing happen before their interview and how was the outcome??

So he got into trouble with the law while his citizenship application is pending?   Thats nuts!   What was he thinking?   Also, he must mention it during the interview.  Lying in the application or interview is grounds for instant denial or if they find out in the future for denaturalization and deportation!   Be careful!

  4. Yes, if you read the instructions from the n400 it clearly states that they "strongly encourage"  to bring your tax returns from the last 5 years. .  I've read in some forums sometimes they ask for them, sometimes they don't.   Since you are filing based on the 5 year rule and not based on marriage, is less likely they will ask you for them, but you never know.  Just take whatever tax documents you have to the interview.    Good luck!

  5. I have a similar experience (divorce waiver) and I have my citizenship interview coming up pretty soon.   I don't really expect it to be a problem because Im filing based on the 5-year rule.   I've heard the IO will have all my immigration files and he may or may not ask about the previous marriage, but it wont be a big deal unless he/she thinks there are really big red flags.

  6. I filed online.   What I liked about it is that USCIS receives your application instantly and you get a case number instantly too.  Also the fees are taken from your account the same day.   If you send them by paper it takes a few days to do that.   So its faster that way, even if for a few ways.   I found it really easy to fill out and your online account keeps all your information, documents, etc.   I would recommend it for many reasons.

  7. My petition for Removal of Condition with a divorce waiver was approved on 10/29/2014. I added my name and date to the timelines. Good luck to all! I didn't get any RFE or interviews. It took les than 3 months from application to approval. I divorced on July 29, got my General Dissolution of Marriage the same day (In my state you can divorce and get your dissolution the same day, yay!) and sent my package on August 4th.

If anybody has a question about my experience, please let me know. For many people is scary to think that because you divorce you will have lots of trouble to keep your residence or to lose it. Fortunately, if you enter your marriage in good faith and you have the necessary documents, you will have no problem keeping it!!

This is a list of the documents I sent, in the form of a cover letter I sent them

  8. Fill it anyway with the name, address, social security and date of birth of your former spouse. The application itself say -Name of the spouse or former spouse-. The only difference is that he or she doesn't have to sign the application in part 6. Remember to choose waiver on Part 2 of the application (1.d if it was terminated by divorce). Noroc!

    Hi everyone,

Im almost done with my file, I'm just not sure about the part 3....should I leave it blank since I file as a waiver? (divorce is already over)

    Thank You,

  9. Thanks for all your testimonies and help! I divorced a few days ago and I'm preparing my packet to remove my conditions. This forum has been very helpful and I'm more confident now. The following is is the cover letter I'm preparing. If anybody has any suggestions, they will be appreciated. I will be sending the packet next week. I will let you guys know whats going on with my case.

    Best regards,

  10. I received my GREEN CARD this Saturday 21. Very happy! I had been out of status for 18 years since I overstayed my visa. It has been a fast process. Only 73 days from application to approval. The interview was very tough but everything else has been very smooth. No RFE's, we didn't hire a lawyer. I just checked boards like these for many months before we applied. I wish you good luck to all of you. I will travel very soon to Mexico to see my family, most of whom I haven't seen close to 2 decades. dancin5hr.gif

I just received the following email from USCIS:

Application Type: I485 , APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS

Your Case Status: Card/ Document Production
On September 13, 2013, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you.

We had our interview yesterday. It was a nightmare! The interviewing officer was very hostile and said things like: why did you overstay your visa? What if Americans stayed illegally in Mexico? Would you like that? Why did you stay so long with your visa expired? She asked my wife things like: why did you divorce? (She had been divorced for a year before she married me) Why do you guys don't have more documents together? She was rude and we felt like we were treated like criminals. We didn't expect that. We were so worried that our application would be denied. We left the office and she only said we'll let you know later. I was so worried the whole day yesterday. This morning I woke up and saw a text and e-mail from USCIS with the good news.

The process has been very fast for us. Only 73 days from application to approval. I just have to wait to received my green card in the mail and continue to live my American Dream. It has been hard being undocumented for 18 years. I feel like waking up from a long, terrible nightmare. Is time to live life at it's fullest!!!!!!
