angeldaemon13 reacted to JBPB in Visiting Visa While IR1-CR1 Is Pending
I think people make a bigger deal on this forum than it should be.
My wife has been here the whole time with me while i-130 pending. She comes for 90 days at a time, leaves for 6 weeks and comes back. She is from a vwp country. At US customs they asked the first time, what is the point of visit, to see my husband and they let her go through. 2nd time: why are you here? A: to visit my husband Q what does he do? A: hes a doctor Q: did u file paperwork A: yes, waiting on petition approval Agent: enjoy your trip.
Also, she does not have a single tie to her country because she quit her job to spend time here, no car lease, lives with parents while she goes home, they never ask for anything. My two cents, just go visit and stop worrying about POE AGENTS.

Oh I'm rocking the boat and I lodged our first service request earlier this evening. My patience has now completely expired. If the USCIS wants to set their processing timetable in a foolish manner and I can capitalize on it, then so be it.
I know that I'm very, very fortunate that I'm now with my husband in the US but please don't hate on me for that. I know that many are going through serious emotional distress being separated...I lived it...so I know many of you deserve to get answers and approvals fast!
But it still does not justify them sitting on our I-130 for 6 months since being transferred!
Our NOA1 issued on July 2, 2013. Our petition has been transferred and sitting at NSC since Sept 2013...and some people who filed before me are still not approved??? Those transferred to NSC after me and with NOA's after me are getting approved???
    Complete, utter, freaking rubbish!!!
Sorry folks, but I'm mad enough for all of us at this moment.

I don’t think anyone here on VJ does not feel for the illegal immigrants. But my wife will tell anyone what she had to go thru to get here legally, and so have I many years ago. It is not fair to us legal immigrants to help people for no regard of our immigration laws. They know exactly the law, and they brake it anyhow, under the pretense of bettering there life’s. I know many illegals living and working many years in the U.S. having many children, and getting many benefits. NOT FAIR

There is a hope for us - uscis has updated its trends and volumes and they have completed 15,000 cases more in Jan than in Dec.
    http://dashboard.uscis.gov/index.cfm?formtype=4&office=4&charttype=1
as I recall there was a lot of snowy days so still pretty good outcome.
It's getting more and more possible to receive our noa2 by May/June :)

That was my point though: except for "officially approved line-jumpers": illegal aliens & folks from the Philippines. While I'm the first to say that the typhoon that happened waaaay back in November was dreadful, current USCIS approval times of zero days for Philippino beneficiaries do not lessen our feelings of unfairness in this process. Time the administration and USCIS go back to following their own rules.

USCIS... Sigh... If they can't read an original certificate of marriage from England what can they read?
I have one handwritten certificate they gave me on the wedding day and some extra certificates they mailed a few weeks later with the same information printed. I feel both are legible but then again, I don't work at USCIS.
Did you send a handwritten certificate or one of the printed ones?

My life is officially a soap opera.
Yesterday, I received my NOA2, which gave me a choice; AOS or consular processing. We decided to go for AOS because that way we could at least enjoy the Florida sunshine while we are waiting. The NOA2 gave details of which forms to fill in, depending on which route we want to take.
Today, I received my 9,233rd email from USCIS, and it says:
    ------------
Application Type: I130 , IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN
Your Case Status: Post Decision Activity
On March 14, 2014, we shipped this approved or re-affirmed case to the Department of State for visa processing. For more information, please contact them directly.
For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.
    -------
So in effect, we no longer have a choice, because they've sent the petition to the NVC anyway.
British and commonwealth users of this forum may well know the phrase about, um, organising a social event inside a brewery. The phrase applies to USCIS. Just saying.

This is a situation for the authorities.
This is child abuse. It should be reported and investigated.
It's a crime to keep a child captive.
Shame on those of you who say he will be 18 soon and will be an adult and should just move on.
Would any of you allow your child to be treated in such a manner? Kept an illegal visa overstay, not allowed to go to school, etc.
What would you call it if it happened to your child? Would you tell your child to move on?
As a parent, I am aghast at the responses when a child even a 16 years old or 17 years old child is abused - especially by the parent who is there to protect them.
Please report this to the police.
If the authorities finds evidence that he has been abused, he can legally change his status to stay here. At the very least, they will remove him from his current situation.

So he was illiterate at 16.
    And still illiterate at 18.
And wants to go to college?
At 18 he is an adult, buy him a ticket home, problem solved.

It looks like they're updating their site throughout the day now, as opposed to just at midnight. I'm not sure if this means they're worker harder (haha, I couldn't even type that without laughing), or if their system updates in real time now, instead of at the end of the day.
    KEEP IT MOVING, USCIS!!!

Ok, if you thought I was confused before, you ought to see me now.
I just received my NOA2, dated March 7.
When I sent in my I-130, it was very clear from the information I gave that at the time, I was in the US and my other half was in the UK, so I was petitioning for a visa which would then be processed by USCIS and then NVC and then at the embassy in London.
    The NOA2 says:
The above petition has been approved. The petition indicates that the person for whom you are petitioning is in the United States and will apply for adjustment of status. He or she should contact the local USCIS office to obtain for I-485. A copy of this notice should be submitted with the application.
If the person for whom you are petitioning decides to apply for a visa outside the United States based on this petition, the petitioner should file form I-824, Applcation for Action on an Approved Application or Petition, to request that we send the petition to the Department of State National Visa Center (NVC)
    So, basically, #######?
I thought the process was that USCIS sent the application to a service centre (in my case, Texas) and once the I-130 was approved, Texas would automatically send it on to NVC, and NVC would then send it on to the US Embassy in London.
I'm now completely confused - Do I/we have to make a choice as to whether to go down the AOS route or the consular route?
As it happens, my other half is here in Florida with me now. We arrived on Tuesday, and she's here for 6 weeks, and then going back to the UK, but I'm now wondering if she should just stay here and go the AOS route, although I think it costs quite a bit more. Not that I particularly care because this entire process is getting RIGHT ON MY MAMMARIES, and I just want to get it over and done with.
So, is the NOA2 I've received the 'usual' type of NOA2? Does everyone at this point get a choice between consular processing or AOS, and if so, how the hell do I proceed? I have to start sending in more pointless forms just to have Texas send it on to NVC??
    HELP!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
*im at the end of my rope*
