Yes, being free to marry means you are both single and able to marry someone legally. For a K-1, it has to be legal in the state where the petitioner resides and they intend to marry. People have been talking about 1st cousin marriages for example. First cousins can marry in some states and in others they cannot. If someone files a K-1 for a 1st cousin, it does not have to be legal in the foreign fiance(e)'s country because that is not where the marriage will take place. It has to be legal in the USC petitioner's state where they intend to wed.

So nice for people to weigh in on the OPs personal life - especially the part where you are regaling us with religious beliefs or feelings of disgust that are totally irrelevant to this conversation. We live in a nation of secular laws. We do not live in a theocracy.
The OP is wanting to know what rights he and his long time partner have under (secular) immigration law, especially in light of the DOMA ruling yesterday.
So, same sex married couples are now federally-recognized, legally married partners in the eyes of the law. That is the reality. The focus should be on answering the OP's query and helping him find the info he needs.
This forum should be a place where people seek information, and not be insulted by other readers.

On another ANGRIER note. Its because of people like you doing like this that honest, real couples who are in love (aka me and my husband) have had to live in near poverty because the government makes such tight guidelines.

Not true. DOMA was struck down yesterday. Same sex marriage that has taken place in a state/country in which it is legal is now recognized by the federal government for immigration purposes among about 1000 other things :-)

I cannot imagine the level of selfishness it would take to be upset because you have a slight longer wait caused by people who've been waiting for ages finally being allowed to apply... and I'm a pretty selfish person.

We're doing this on our own and it's been pretty straight-forward so far. With all the help VJ gives you really shouldn't need a lawyer, and honestly, even though I've only been here a few months, I've seen dozens of stories of peoples' lawyers really messing up their application, sometimes intentionally (so they can charge more to "fix it"), sometimes unintentionally or through negligence... like not telling their clients about RFE's (requests for more info/items), giving clients wrong embassy information, forgetting to list children, etc. It almost seems like you're better off doing it yourself!

Did you see the news story last week about the British family who emigrated to Australia and came back after two months because they couldn't buy Robinsons squash?! I was in stitches!
I drink a lot of squash too and I've never seen any apart from Ribena in the small Brit foods section some stores have :-(

Americans often don't get our British humour, especially irony. A lot of my jokes need to change before I move. I'm going to miss the standard workplace/pub humour but luckily my wife is a kindred spirit when it comes to a sense of humour.
A good very recent example of the US lack of irony... "These charges [against Edward Snowden] send a clear message, the spokesman said. In the United States, you can't spy on people."

Pffff, everyone has wedding pictures. Nothing says "I went through a harrowing, drawn-out, expensive ordeal for my love" like chest x-rays!
You could even put a sticker on it that says
I paid the US Government $______, waited for ___ months, and filled out ____ forms, and all I got was this stupid x-ray.
Oh, and the love of my life.
How awesome would that be?

A New York City immigration judge immediately stopped the deportation proceedings of a gay Colombian man who is legally married to an American citizen soon after the Supreme Court struck down the Defense of Marriage Act (DOMA) for being unconstitutional, as was first reported by Americablog on Wednesday. The federally-sanctioned DOMA only recognizes marriage between a man and a woman, so Sean Brooks and his Colombian husband Steven’s marriage did not exist in the eyes of the U.S. Citizenship and Immigration Services (USCIS). Therefore, USCIS cancelled Steven’s green card petition.

The ordeal for the couple started in 2011 when Sean, the American citizen tried to file a green card petition for his husband based on their same-sex marriage. This left Steven in a visa limbo and vulnerable to deportation. Steven, who had not been back to Colombia for twelve years, applied to have his deportation cancelled based on the hardship that his deportation would incur on his spouse. The request was denied because federal law does not let the immigration judge recognize their marriage as valid.
As seen in the immediate cessation of Steve’s deportation, the ruling has a profound impact on the LGBT community, not least of which 24,700 other binational same-sex couples can now breathe a sigh of relief, knowing that they will not be torn away from the people their love. For a population of about 267,000 LGBT undocumented individuals, the Supreme Court ruling comes as a future goal post to look forward to now that federal laws has ended the discrimination against their love. It also will finally allow the federal government to treat all LGBT families equally by allowing them access to federal benefits and protections.
