It does not signify a demonstrated immigrant intent which the DS260, which is the visa application a selectee wishing to process their DV selection subsequently submits. Same way being a DV selectee does not demonstrate an immigrant intent. Let’s not mix up terminologies nor confuse others needlessly. 

    Can you explain this more please? I’m not if I got what you’re trying to say. Are you saying they won’t pull up previous entries?

Being divorced is also a flag for asking about step kids, that’s how that guy in Joburg got found out - he just totally didn’t think he had to list them so got a nasty surprise.  Anyway, it’s only what $800 or so to spend between the visa fee and medical costs for him to find out. Make sure he doesn’t sell up before his interview.

    So based on what you’re saying here he won’t get a visa regardless and there is no chance for him to get it because he didn’t list his step kids. Right?

    is he planning to lie under oath to a consular officer if they ask him about kids and step kids?
     

    If they ask him he will explain the situation. He wasn’t able to add the step kids without the pictures. Anyways I hope they won’t ask him about it. He does have a divorce decree that doesn’t mention anything about the kids because they weren’t his.

    They are very clear. The CO’s job is to ensure that the applicant has followed the instructions for all potentially disqualifying issues. This is one of them. They always ask about kids for anyone, and step kids for anyone with a previous marriage. Even without prior applications (which yes they’ll check) he’d be caught out. And he does not want to lie to a CO, because lying about something like this is at best material misrepresentation and in an instance where it is knowingly done to mislead a CO specifically to get a visa it is fraudulent misrepresentation. That’s a lifetime ban from the US.

    I will let him know. Hopefully they won’t ask. Someone told me that they don’t go back to previous entries especially that he’s divorced now and the DS260 asks if he has any children. He wasn’t able to get pictures of the kids because he doesn’t have any contact with their mom I think USA is penalizing people and pushing them to lie if they ask about these kind of things. It’s insane to ask for step kids if you can’t even get passport photo of the kids because their mom decided to disappear.

    so as it turns out - the reason for this rule is that as long as a de facto stepparent/stepchild relationship continues to exist after dissolution of the marriage, this is still a valid basis for an immigrant petition under US law as long as the step-relationship was created by marriage before the stepchild turned 18.

    Well he doesn’t have any contact whatsoever with their mother not with the kids. They will disqualify him because of step kids that he no longer have contact with? 
     

    Is this a for sure thing that they will ask him about the step kids that are not listed in the current  application, or it’s up to the officer to ask?

    No the kids are not listed. He was selected this year DV2023 he applied by himself and he got selected. Will they ask him about the kids at the interview based on previous entries? 

  9. I think I confused you guys. The kids are not his he’s not a biological father of the kids. So when he was separated with the kids mom he applied with kids without the mother. But last year when the divorce is finalized he applied by himself only. 
     

    the question here he with his step kids when he separated with their mother before the divorce was finalized, but the divorce was finalized he applied by him self only and got selected. I asked what he chose under the kids option when he applied with the kids and he said that he chose children not step children. This is his only concern now? 
     

    he has 2 question: 

    1- is applying with step children without their mother while separated an issue?

     

    2- is not choosing the option of step children instead of children on the visa application years back an issue?

On the last DV where he was selected he applied by himself with the step children. 
     

    if you are asking if he lies I guess he did even though it wasn’t intentional when he entered biological children instead of step children. 
     

    that’s the only concern that he has. He never applied for non immigrant visa or anything. He applied for DV many times with the ex wife and step kids as biological kids and without a wife couple times with step kids as biological kids. This last time he applied as divorced with no kids and he was selected. 
     

    any advice on this delama?

    i had a question about previous DV entries where one wasn’t selected. Do consulates or NVC have access to the data entered their? 
     

    A friend of mine was selected this year DV2023 and he’s worried that if they have access to previous entries where he wasn’t selected because the info(marital status, education, step children) he entered to apply for DV2023 are different from the previous ones.

  13. I need some help. My petition was approved on June 18, 2015 and according to the letter I have received, the case will be forwarded to NVC and they will reach out to me within 30 days. There is an email address to contact NVC in case no correspondence is received within 30 days.

    I have not received anything from NVC. I sent out an email to the NVC last weekend and have not received a response. Do you guys recommend calling them or wait and give them more time? What number should I call them at?

    Any help will be appreciated.
