Misha'sgirl reacted to Kathryn41 in Cancelled Interview
If you haven't received anything in the mail advising you about the cancellation, then I would proceed as if the interview is still scheduled. There are many legitimate reasons why an interview may be cancelled - anything from the adjudicator involved going away on holidays to your physical file not yet transferred to the location, or still waiting for security checks to be finished. There have been previous cases, however, where a couple has been notified that their interview was cancelled and then they received notification that the petition was denied due to failure to show up for the scheduled interview! They had delays where they had to appeal the decision to get a new interview date, proving that it was USCIS' error and not theirs that led to their non-attendence. The left hand of USCIS doesn't always let the right hand know, so unless it is a very difficult proposition for you to get to the interview, attend it as if you had not heard of the cancellation, unless you actually get something in writing. The worst is that they will tell you the interview was cancelled and it will be rescheduled; the best is that you will be interviewed that day.

Not to burst your bubble but Christians are some if the most judgemental people on earth. Not to say all of them are but a good few of them I've come across preach acceptance but passionately despise those not of their click. Just my personal experience... I hope you'll understand.

Misha'sgirl reacted to SMR in Have any of you sponsored fiance(e)'s family for wedding?
First off, there technically is no such thing as sponsoring a tourist visa. Your future MIL has to apply for a visa on her own.
That said, you can write a letter. The letter is just a piece of paper that they can take to the interview that the officer may or may not look at. My wife's mother and brother came to our wedding. Both applied for visas while she was waiting for the K-1. I wrote letters for both of them and they both got the visas. Honestly, I don't think that writing the letter can possibly hurt. It doesn't really make it more likely that she will stay in the US. If anything, trying to cover it up may make things suspicious depending on how good your cover story is.
However, it probably also doesn't help very much. A common misconception about the tourist visa process is that you need to demonstrate that you have a good reason to come. They actually don't care about that. They theoretically care about making sure the tourist won't run out of money and get stuck, but in practice that doesn't get much focus. What they care about is making sure that the visitor will go home afterwards. The invitation letter about a wedding etc. does help insofar as it helps to create a believable story. It's a piece of the picture that you are trying to paint.
So in summary, I would write the letter. However, focus on making sure that your fiancee's mother has other ties to home and is not a risk of staying. Those are the most important.

In planning a visit in the next 4-5 years... He has LOT'S of time to work hard and save money ... I would say he should Apply early enough so that if there is a denial, he has time to re-apply as needed. I would not worry too much for a possible visit that far in the future, lots of things can change (personal and geo-political) outside of anyone's control that could affect visa issuance.

Should cases not be transferred, to even-out the work load to make things more equitable, for all that apply!
By, the way, a very big CONGRATS, to the lucky couple!

you just filed two months ago. People have been waiting for a year or more to get a NOA2. Sorry, but you have several more months to wait given the backlog of approximately 500,000 petitions sitting at the USCIS right now. Sit back and relax for now.

There is a nice little disclaimer at the bottom of your timeline that explains the estimates:
*Notice about estimates: The estimates are based off averages of other members recent experiences
(documented in their timelines) for the same benefit/petition/application at the same filing location.
Individual results may vary as every case is not always 'average'. Past performance does not necessarily
predict future results. The 'as early as date' may change over time based on current reported processing
times from members. There have historically been cases where a benefit/petition/application processing
briefly slows down or stops and this can not be predicted. Use these dates as reference only and do not
rely on them for planning. As always you should check the USCIS processing times to see if your application
    is past due

Well for one, I'm just going to point out how f-ing crazy this guy must be to make his kids (even if they are "step kids", it shouldn't matter) pay him money.... "their share"?? Really seems kind of abusive. They're you're kids. They owe you respect and love (that's it), but ONLY if you are also giving them respect and love. Which this guy isn't. I can understand "helping" your parents if you're twenty two and still living within the house. But if you're a damn 12/13 yr old... absolutely no. I completely understand why you would want to move out. And even go as far to say as move back to the Philippines. If you're more comfortable and your life was happier in the Philippines, then you should go back. I'm sure you can take art classes there too... and there's always hundreds of ways to teach yourself art through online vids and even skyping with fellow artists. Not the same as the classroom, but better in some ways. You can still earn degrees through online classes. Do what helps you BE HAPPY.

To add, you can only get a 1-year EAD when you apply with or after AOS. Applying for the EAD with or after AOS is free. If you apply for the EAD before your AOS, you have to pay the fee AND it expires when the I-94 expires, essentially making it a waste of money.

Misha'sgirl reacted to kitthekat in I-765 EAD
If you apply for it before AOS-ing, the EAD will only be valid for the same period as the I-94, i.e. 90 days from the time he arrived in the US. Bear in mind it takes about 90 days to get approved for and receive the EAD in the first place, so there is not much point in applying for it. If working is really important, you should AOS right away and send in the forms for EAD and AP as well. If you can't send in AOS now because of a lack of funds (just hypothesising here) then you'd be better off saving the money for AOS and waiting a bit longer to work.

Misha'sgirl got a reaction from You&Me in Should I call ICE About My Roommate's Sham Marriage?
First off, I'm really sickened to see so many people on this forum keep saying basically, "its up to God". Well, honestly, a lot of it is not up to God. Why is it that people feel they should mix religion in with eveything that is happening in their life... Does using justice for situations that beg for justice, not available any more?
Now I will address what I've put in bold and underlined... Its strange that you have only given the OP two choices in why he would be reporting her. Both are quite extreeme. How about the simple fact that he wants himself and his wife to be happy, as they have slaved away with this process and paid out the wazzoo for it?! Honestly, the only thing that he has to be "envious" of is that this illegal alien is getting the same benefits as he, except does not have to do the same amount of "work" as he.
So since she is not a kidnapper, killer, drug dealer, etcetera... let's let her off the hook because that makes her a good person and good people should always be rewarded. If that were true, this man and his wife should have already recieved their "reward", right? I mean, they're good people, they are law-abiding, and doing all the steps in order. This illegal, on the other hand, I think might have skipped over a few steps. Thanks Obama. You really know how to take care of your illegal ali--I mean, American Citizens!
What about her being a rule bender, a law breaker, using people (ex-husband) to get what she wants. Its one thing if the ex knows she is marrying him bc she needs it for her situation or if he thinks she is back in love with him. Manipulative.
Oh yes, he should not be bitter and should just suck it up because it takes time! Your words are quite insensitive and degrading. I'm sure he entered into this process knowing all of that. I don't think he even mentioned it being a big deal, and yet you brought it up. As if reporting someone's unlawful presence in the US and this processe's processing times have anything to do with the other.
You've only said one thing right. "We should think deeply before we act". So where was this roommate's mind when she made all these illegal choices? Do you think she thought deeply of the consiquences, of what her choices whould do against others? I do not think so. I think she JUMPED on the opportunity to live in the USA. Of course she has kids, grandkids and we should automatically feel super pathetically sorry for her. Oh but I guess she didn't "think deeply" about the fact that, even if the OP does not report her, she could still be found out and deported. And honestly, I do hope she is. It is super wrong what she is doing. It is also, UNFAIR.
WHY SHOULD HE LOOK FOR ANOTHER PLACE? Maybe she should look for another place?! The government is already taking care of her, allowing her to stay, but every law abiding citizen also should make sure she is accomodated. As a US-######-citizen, we are put on the lowest rung of the latter and made to climb it all the way up and when some illegal comes along, we get bumped down because some illegal alien is more important than America's own citizens!

This is from the guides above, http://www.visajourney.com/content/k1guide
1.A copy of the entire I-129f package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one). Your fiance(e) should review this information in advance of the interview (the embassy will have copies of this as well).

2.Send copies of the documentary proof that you submitted with the I-129F for your fiance(e) to have on hand for their interview at the embassy. Your fiance(e) should review this information in advance of the interview (the embassy will have copies of this as well).

3.Send an original letter affirming your desire to marry your fiance(e) and your continued support of the K-1 Visa. Sign and date the form. This will be similar to the letter you provided with the I-129F, but dated much closer to the interview (it will have most likely been several months since you submitted your I-129F).

4.I-134 Affidavit of Support form. Ensure it is signed, with all required supporting evidence. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all.

5.You will need several items (for the above form). Gather duplicate evidence of income and resources as appropriate:

    (A) Statement from an officer of the bank/financial institution with your deposits, identifying the following: 1. date account opened; 2. total amount deposited for the past year; 3. present balance
    (B) Statement(s) from your employer on business stationary showing: 1. Date and nature of employment; 2. salary paid; 3. whether position is temporary or permanent (also include copies of your last two pay stubs and your previous W-2 for the associated employer if available)
© If Self Employed: 1. Copy of last income tax return filed (or IRS transcripts); or 2. report of commercial rating concern
    (D) List containing serial numbers and denominations of bonds and name of record owner(s).

Begin collecting these ASAP after your NOA2 arrives. See this FAQ for more tips and useful information on the Affidavit of Support Form.

6.A copy of the NOA2 that you received in the mail. (backup information; the embassy will have copies of this as well)

7.Proof of your ongoing relationship. This needs to be taken to the interview! Include photos, travel documents, emails, online chat logs (pick several over the prior few months), etc.. from between the time you filed and present (NOA1 until date-now).

Examples: Copies of land line and cell phone bills, appropriate emails and letters you have sent including the stamps on envelopes (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)

The situation is tense there now. My fiancee has her interview in Kiev in about 2 weeks, but told me that, thankfully, the embassy is in a different part of town away from the protests. She was very upset about it when I spoke to her today and doesn't know what will happen - it's not just a small faction that's furious at the government. Police using live rounds on protesters brings it to a new level.
