  1. Hello all... I have been continually reading up on all that is needed for my next steps and some of those things have me a little confused. Instead of creating numerous posts, thought I'd keep contained in one :)

    All feedback would be greatly appreciated especially those who moved to KY as that's where I'm heading.

    1. So I registered on the CSC website, picked the Loomis here in London and and continued onto scheduling my interview..... The confusing part is the Loomis portion. Is that all I had to do for registering with them? Just tell them that that's where I want it sent and then once my interview is complete I get a waybill?

    2. Importing my car. I have tried to read the ####### out of info on this.... I thought it was something that i did in the State I was moving to, but I'm now thinking that it's at the border? Is that right? I have my compliance letter already and I'm ready to do it whenever, I just wanted to make sure that it's at the POE.

    3. SSN. There are so many threads on the topic and they all say 2 different things. My plan was to go down, get married ASAP and then go and register for my SSN (after the 10 day mark) and do it in my married name.... Some seem to say NO and others say it's not a problem doing it in your married name. I plan on taking all the info stated in the guide portion to help any uneducated on the topic reps that I may encounter. Though the one link that says to print a notice is now dead.

    4. I-134 Affidavit of Support.... my fiance received his tax transcripts from 2010 and 2011... the only thing is that he did those taxes with his ex-wife and they don't show his income separately... Will that be an issue? He is hoping to have his 2012 done and back before my interview, so i'm thinking the others won't matter...

    5. I still haven't received any letters from Montreal regarding pkg 4 and the Dr requires it..... I am hoping that it comes soon, but what happens if I don't get it.... will the email they sent suffice?

    I think that's it for now.... thank you all again for helping me keep my sanity during this process. :)

    We are moving from Canada to KY this weekend via a uhaul. We're not bringing a car but when we were considering it, all I could find was the letter of compliance you mentioned, that its free with a K-1 visa, and they performed the import during your POE. I was looking mostly at the Detroit POE reviews.

    As for the SSN, check back with us in a few weeks as we hope to have everything completed by then so we can give you an idea on what we went through.

    So many questions! I just received my W2 and my income is JUST barely shy of the 125% guideline for a family of 5.

    1. If I have a Court Order for a substantial amount of child support that puts my income far above where it needs to be. Can I count that at income? I can't always show where it has been deposited into my bank account because its sometimes paid in cash and then just used directly to pay bills. If I can Count it with the Court Order as proof, then I'm all set. If not...

    2. I can put enough in savings to cover the difference X 5, but does it matter that I am JUST now putting it in? Does it have to have been there for a while or anything like that?

    3. Suppose we have more than enough to cover the difference in savings. We apply for AOS immediately when the beneficiary arrives, having plenty in savings to meet I-864 requirements. How long must that money remain in savings? We's like to use it for a DP on a home, but must it remain in savings until... AOS is approved?

    Is a co-sponser completely out of the question? Don't mean to dodge your question but it seems a little cleaner.

    I am pretty new to visa journey, but my fiancee and I are in the process of applying for a K1 visa to bring me down to the USA (from Calgary, Alberta, Canada).

    We have sent in the paperwork, etc, and received an NOA1. We have set the wedding for August 31st, 2013.

    The big question is will we have enough time for this wedding date to work? I just filled out the timeline today, and it is predicting our 129F may be adjudicated between June 22, 2013 and July 30, 2013*.

    Is this a pretty good estimate? Or are these playing on the safe side of things?

    If you have been in this situation before, please let me know how things turned out!

    You MIGHT get your NOA2 in that time but I seriously doubt you'll be POE'd by then. This quote:

    "Based on timeline data, your I129f may be adjudicated between June 22, 2013 and July 30, 2013*"

    Means you might get your NOA2 by then. After that, you go to NVC for maybe a couple weeks. Then packet three and four which can take up to another month. Not sure if you'll go to Montreal or Vancover embassy for an interview. We went to Montreal and our initial interview date was 4 months from acceptance of packet 4. We were able to keep an eye out for openings and found a date a little over a month from packet 4. That being said, our entire process was 10 months I believe.

    That would be for NOA2, add 7 days of NVC, 5 days of transit, and 80-100 days in MTL if that is your embassy.

    My guess would be no.

  4. Hi! Everyone! Im new in this site. I will have my interview on monday. January 28 at the us embassy manila for k1 visa. The recent income tax return of my fiance is 2011, but i have his employment certificate just this january 2013. I still dont have the income tax return of 2012 because my fiance said that they file it last week of january. His income tax returns were filed every february of the year. For those who had their interview this jan 2013, did the consul ask you for 2012 income tax return? Ur replies are greatly appreciated. Thank u

    We interviewed on Jan 7th with only the 2011 transcripts and had no issues

At the moment I'm employed in a temporary position that will most likely be wrapping up in the next few weeks (I don't have an exact date of completion right now, it's whenever they tell me they have to let me go). I'm gathering all my I-134 paperwork now and I know that I have to submit, among other things, a letter from my employer, recent pay stubs, as well as stating on my I-134 form what my annual income is.

    My question is: Should I be worried about asking my current boss to write the letter for me, as well as stating my current income and my pay stubs, and then sending all that information along when I won't still be employed at my workplace by the time my fiance gets an interview? I mean, technically I'm not unemployed right now, but I will be soon enough. Should I just send all of that paperwork stating my current employer since that's where I am at the time that I'm collecting the information?

    2. In addition to being a temporary employee, I'm also underemployed and don't earn much so my father is going to be our co-sponsor. He's filled out his own I-134 and will be collecting his own letter from his employer, pay stubs, and necessary tax information.

    My question is: My father has a set base pay salary at his job, but he works *a lot* of overtime and earns an additional almost half of his base pay from his overtime. When he gets his tax return transcripts, they will list his annual income including the overtime pay he earned that year, but when he gets his letter from his employer, they will only state his base pay rate not including the overtime. Will that discrepancy between the tax returns and the employer letter be a problem? Without the overtime he still makes 125% of the poverty level to support our soon to be 3-person household, but he's concerned that the difference between what his income tax return says and what the employer letter says will raise an eyebrow.

    Sorry that's so much to ask! Getting to this part of the process has always made me the most nervous because of my crappy employment situation. Any help or advice would be appreciated more than you could imagine. Thank you!

    1. If you're a temp employee, when you submit a letter from your employer, they need to specify that it is a temp position. This is a quote from the I-134 instructions:

    "Statement(s) from your employer on business stationery showing:

    1. Date and Nature of employment

    2. Salary Paid; and

    3. Whether the position is temporary or permanent"

    That being said, you'll likely need a co-sponser as you have indicated. My point of mentioning this is you need to be clear on your I-134 supporting evidence that you are in a temp position as it specifically asks.

    2. Lots of people are hourly, so I'd just make sure your Dad's employer specifies what he earns and that he is eligible for overtime. The IO will see his transcripts and know what he historically earns. Since all of the income is from his one employer I doubt there will be an issue with the difference. I have quarterly bonuses and they didn't raise any flags.

  6. I was unsure if i should post this question in this forum but here goes.... My roommate has ask me to be a co-sponsor on their behalf, which i have no problem with at all but i'm afraid i don't make the income they are asking for... I brought home 14,500 this year plus have 4,500k and my own personal savings account and I do not have any assets ect. and my household size would be i assume 2 ( me and the beneficiary) since I have 0 dependents.... do i even qualify to help them ?

    You have to make 125% above the poverty line. This is different considering the amount of people you have in your family. If you're single and the two asking you don't have any kids, you have to be 125% above the poverty line for a family of two. (You and the beneficiary).     I think someone with more experience can add to this or correct me so you may want to wait for a few responses.

    YES! This site has been quite helpful to me. In fact, its pretty much given me the confidence to do the next steps of our journey without a lawyer which is a big thing for my pocket book. Lets try to answer questions (or don't if offended) the best we can.

    I will be attending my K1 fiance visa interview soon. I was wondering if I can submit legible scanned copies (sent visa email) of my American fiancee's parents' financial documents in the interview, as support for my affidavit of support? What about form I-134 itself, can I present a genuinely signed but scanned copy? We both live in London and her parents are in America.

    Hi, this was the wording on our packet 4 regarding the documents we needed to bring (I-134 was on the list)

    "Please bring to your interview the original and one photocopy of each of the following documents (as applicable), for each applicant:"

    I also found this in the I-134 instructions under the "Requests for more information or interview" section under the "Processing Information" Heading:

    "We may also request that you submit the originals of any copy"

    Realistically, I would guess that this would all depend on the officer you get or frankly how realistic your printer makes the signature look. I would suggest bringing the original, especially of this form. The I-134 is one of the most important documents relating to your upcoming interview and you can bet that the officer will look the document over carefully. Good luck with the interview!

    Just wanted to update that my interview was originally scheduled for March 4th at the Montreal embassy, however extra spots opened up and we were able to get a January 22nd interview date! Very nervous and excited about this!

    Hoping to be with my future hubby by end March!

    We were able to do the same thing and reschedule to today. WE WERE APPROVED!!! Anyway, since you are going to Montreal like we did, I would highly suggest reading up on the informative Montreal reviews under the embassy reviews sections. I'm sure you've already done this but it never hurts to suggest. We took all the information from the other filers and had zero issues. This site is really invaluable. Thanks to all who share their observations.

  10. We are using the I-864EZ

    It just asks in #18 what your current annual income is.

    Then #19 asks for the income listed on the last three years worth of income tax statements.

    In that case I would do what I did. Current income is what you are making right now. 2011, 2010, and 2009 will be whats on your IRS form 1040 from the last three years tax returns. Mine even mentions using the number on IRS 1040.

    November 14 2012 Interview in Montreal.221(g) please submit another I-864 from joint sponsor with 2011 taxes.Include your passport

    November 27 Mailed required I-864,tax info and passport.

    I was told at the interview to send the requested documents and passport through the courier I had registered with and if it met the requirements they would issue my visa and get it out in about two weeks.The nearest DHL is in London which is several hours away from me.My lawyers office told me that it did not have to be sent through DHL and that they would send the new I-864 and supporting documents some other way(not sure exactly how sent or who used)I asked if it was ok to do this way and was told they have done it before.My concern is that this was unacceptable and might not make it to the correct place,person or department.

    Has anybody heard of sending requested documents to them not through the courier that was registered with,will they accept such incoming mail and process it?

    My Fiance sent our Packet 3 info to Montreal via Canada Express Post and we didn't have any issues. So, they will accept different types of mail. BUT, they specifically told you to use the courier you registered with so you may want to stick with that.

  12. My question numbers do not match up with yours but I'll help how I can. I'm using form I-864, Affidavit of support under section 213A of the Act. Now there are different versions of the I-864 so you may want to make sure you are supposed to be using the same as me. I do have question 23 under part 6 that asks for my "Current Individual Annual Income." Under here I chose my current salary. There is also a question 25 under part 6 that asks for my "Federal tax return information" where I was able to list the last three years. I used my total adjusted income amounts for the years 2011, 2010, and 2009, found on my IRS Form 1040. All three years were different than my current income.

    There's an example form on this site I used to find a few answers. Just go to Example Forms at the top and "USCIS Form I-864" under "Adjustment of Status (Green Card) Related Forms." Its a little outdated but it matched up with my form.

  13. Not many people posting in this thread compared to the other monthly threads. So am I one of the last to be approved from April or are there others who are just silent? Any feedback would be appreciated

    I guess I can't speak for everyone but we are an April filer and got approved Tuesday. 1st NOA April 10th with an RFE. Was an easy one, looks like our lawyer missed the question that asks if I'm a criminal. He corrected and sent back and we received approval about two weeks later.
